The certificate of survey is completed by Gronberg and Associates.
Approximately 400 yards of fill dirt was brought in and spread out smoothly over an area
Of the backyard that is 75 ft. x 105 ft.
150 ft. of silt fencing was installed around the lower perimeter. Additionally I have laid
down a layer of straw over the surface area for erosion control.
A check is included for Escrow.

Your application for an after-the-fact land alteration permit was received by this office on October 7, 2011. After a
preliminary review, we have determined your application is incomplete.
The following items must be submitted or revised in order for your application to be considered complete and for
the plan review to continue:
1. Certificate of Survey. Please provide three (3) copies of an updated, scaled certificate of survey meeting
the City's survey standards (enclosed) indicating the location of the existing house and proposed
.accessory structure (and any proposed grading) as well as all existing structures, landscaping, retaining
walls and hardcover on the property.
2. Calculations. Please provide calculations of fill imported, exported and/or moved around the site.
3. Erosion Control Plan. Please provide an erosion control plan or a copy of the Minnehaha Creek
Watershed District Erosion Control Permit. The site must be protected with erosion control measures
until vegetation is established.
4. Escrow 8� Escrow Agreement. Building permits involving grading and/or review by the City's engineer
require submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee
reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally
this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and
stormwater. The required escrow amount for this project is $2,000. The escrow agreement is enclosed.
The property owner must sign the escrow agreement and submit a check for$2,000.
Because the material has already been brought to the site and the work (for the most part) is completed, this is an
after-the-fact review. We request submittal of the above information by Monday, November 14, 2011 to avoid
becoming a violation. Also, please be advised our review may result in required changes to your project as
constructed.
Additionally, the City's wetland regulations and wetland buffer requirements may be triggered by the project.
Please review the enclosed information sheet regarding Construction near a Wetland and following the
instructions provided. The above information is required in order for the plan review to continue. Please feel free

ZONING PERMIT ESCROW AGREEMENT

AGREEMENT made this �/ day of �C�t/ , 20�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Gary Frazier("Owners").
Recitals
1. A building permit application has been filed for a zoning permit for a property located at
4555 Spruce Way the ("Subject Property"), legally described as the East Half of the West Half of the Northeast
Quarter of the Southwest Quarter of Section 30, Township 118 North, Range 23, West of the 5t" Principal
Meridian, lying South of the railroad right-of-way, Hennepin County Minnesota.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,000 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering or legal consultant review) or will
incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible
for under a zoning permit application. The escrow will also guarantee reimbursement to the City for all out-of-
pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater
Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be
used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to
public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant
review) associated with permit#2011-01213 if compliance with the approved zoning permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
sub� erty pursuant to Minn. Stat. §§415.01 and 366.012.

� ZONING PERMIT ESCROW AGREEMENT

AGREEMENT made this !�l day of NC�1/ , 20�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Gary Frazier("Owners").
Recitals
1. A building permit application has been filed for a zoning permit for a property located at
4555 Spruce Way the ("Subject Property"), legally described as the East Half of the West Half of the Northeast
Quarter of the Southwest Quarter of Section 30, Township 118 North, Range 23, West of the 5th Principal
Meridian, lying South of the railroad right-of-way, Hennepin County Minnesota.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,000 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering or legal consultant review) or will
incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible
for under a zoning permit application. The escrow will also guarantee reimbursement to the City for all out-of-
pocket costs the Ciry has incurred to assure that the work is completed in accordance with the Stormwater
Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be
used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to
public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant
review) associated with permit#2011-01213 if compliance with the approved zoning permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
sub' erty pursuant to Minn. Stat. §§415.01 and 366.012.
