Previous to that time, the property had been held by the Department of Nat�ral Resources for a period of three years. In 1986 the City assumed responsibility for demolishing the former residence with the understanding that the DNR would finally release the lot for sale to adjacent property owners. An adjacent property owner purchased the parcel in April of 1987 and the contract to purchase was canceled as of October 1992 for non-payment of the installment payment and delinquent real estate taxes due on property. Hennepin County's letter of September 9th releases the property once again to the City for consideration. Note also that the DNR has also released the land for sale in their letter of September 3, 1996. A new owner of one of the adjacent properties has been in contact with the City and County advising of their interest in acquiring the land. The City staff recommends that the property once again be released for sale to adjacent land owners. The City has sent a copy of the memo and the release for sale resolution to both adjacent properry owners. COUNCIL ACTION REQUESTED: To adopt the resolution releasing the tax forfeit land located at 1290 Spruce Place for private sale to adjacent land owners. ch TAX FORFEITED LAND RELEASED FOR PRIVATE SALE TO ADJACENT PROPERTY OWNERS, LOT 4,BLOCK 1, SAGA ffiLL REVISED WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, pursuant to Minnesota Statutes 282, the City has received from Hennepin County a listing of a land within the City which has become the property of the State of Minnesota for non-payment of the installment payments on a purchase contract entered into as of Apri121, 1987 and for non-payment of delinquent real estate taxes; and WHEREAS, the City Council has reviewed said lands for compliance with local zoning ordinances, for the amount of outstanding special assessments remaining unpaid to the City, and/or for the public use by the City as authorized by the statutes. In addition the Council has reviewed said lands and pursuant to Minnesota Statutes 85.021; 92.461, Subd. 8; 282.018, Subd. 1 or 282.018, Subd. 2 makes the following findings: 1. The property as lakeshore property located at 1290 Spruce Place was released by the Department of Natural Resources for sale in a letter dated September 3, 1996. 2. The parcel does not meet applicable zoning standards and is an unbuildable lot. 3. Adjacent land owners have indicated an interest in purchasing this property. 4. There is an outstanding special assessment on this property of$2,955.66. 5. The City has incurred expenses amounting to $2,220.50 in 1986 for the demolition of a former residence and has yet to recoup these costs. NOW, THEREFORE,BE IT RESOLVED,that the City Council of the City of Oro�o,pursuant to Minnesota Statutes 282 hereby approves the classification of the property as non- conservation land, and furthermore approves the public sale of said parcel of land as listed below to adjacent property owners. The property is unbuildable and may be usable only in combination with other adjoining parcels. First the classification as Conservation and Non-Conservation Land must be approved. II. Next, the parcel(s) should be formally recommended for either public auction, auction to adjacent owners if M.S. 282.01, subd. 7a is applicable (unbuildable lots), or request of a conveyance to your governmental subdivision for a public use. I11. Further, eacF parce! may be eligibla to b� wi:hheld froni auction for up to one yaar, �or investi�ative purposes. To do this please send a written request to this office within the 90 days. IV. Next, each parcel should be verified as to the Special Assessments shown as certified to the county before forfeiture. These specials were canceled at forfeiture and a percentage will be paid from any sale proceeds. Should any portion remain unpaid your city has the right to reassess the unpaid balance against the property. However, please keep in mind that the forfeiture process is intended to be a "cleansing" process attempting to turn a bad scenario around. V. Special Assessments levied after the forfeiture should be certified to this office. These specials are added to the appraised val�e and paid from any sale proceeds. VI. Each parcel should be reviewed for Public Waterfront, Wetland, Peat and Timber issues, or any public nuisance conditions and duly noted in the municipal resolution. We ask your assistance in determining if any parcels on List 942-NC have wells. If any of the parcels on the list have wells, please request a Minnesota Department of Health Well Disclosure Certificate from this department. Please provide available information about parcels such as zoning, known soil conditions, known environmental contamination, or special municipal restrictions. Such information may assist the county in managing and marketing the properties in order to facilitate its return to a tax productive status. If you request conveyance to your governmental subdivision, please submit a properly completed and executed form PT962.RAR, titled, "Apqlication bv a Governmental Subdivision for Convevance of Tax Forfeited Land" for each parcel requested. Minnesota Department of Revenue requires use of this form. Enclosed is form PT962.RAR. You may copy this form for future use only providing that the printing ends up on both sides as it is on ihe originally I sent you. Call if you choose to have us provide you with the forms. Conveyance to a governmental subdivision for a public pu�pose is subject to the recommendation of the County Board, except as provided in M.S. 282.01, Subd. 1b (targeted neighborhood lands). The County Board policy requires that a specific public purpose be identified in the request; Use of the phrases "public purposes" or "other public purposes" is not acceptable. For your convenience, I have enclosed a copy of Hennepin County Resolution No. 87-8-612, which covers the guidelines for what is deemed an acceptable "public purpose". This parcel has forfeited to the State of Minnesota for non-payment of property taxes. The Hennepin County Auditor, is the Trustee/Administrator of Minnesota owned Tax Forfeited Lands lying within Hennepin County, pursuant to laws providing for the forfeiture of real property. The lands as described on Conservation/Non-Conservation Classification List, were classified as either conservation lands or non-conservation lands, as is appropriate, by the Administrative Review Board of Hennepin County, evidenced by County Auditor's Directive No. 96-29, pursuant to authority granted by the Hennepin County Board of Commissioners by Resolution No. 95-8-556R1, and in accordance to Minnesota Statute 282.135. It is our opinion that since this lot was a tax forfeiture and a public expense as well as a nuisance in the neighborhood for years, it should have been offered for sale to the general public if it was, in fact, buildable. We, and other neighbors, were lead to believe that it was not buildable and, as such, would be offered far sale only to the ajoining properties.
