Sec.13.04 RIGHTS OF S[JBJECTS OF DATA
Subd. 1. Type of data. The righu of individual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall
be informed of: (a)the purpose and intended use of the requested data within the collecting§tate agency,political subdivision,or statewide system;
(b)whether he may refuse or is legally required to supply the requested data;(c)any known consequence arising from his supplying or refusing to supply
private or co�dential data;and(d)the identiry of other persons or entities authorized by state or federal law to receive the data. This requirement shall
not apply when an individual is asked to supply investigative data,pursuant to section 13.82, subdivision 5, to a law enforcement officer.
The commissioner of revenue mav place the notice required under this subdivision in the individual income tax or oronertv tax refund
instrucrions instead of on those forms.
Subd.3. Access to data by individual. Upon request to a responsible authority,an individual shall be informed whether he is the subject
of stored data on individuals,and whether it is classified as public,private or conf'idential. Upon his further request,an individual who is the subject
of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content
and meaning of that data. After an individual has been shown the private data and informed of iu meaning,the data need not be disclosed to him for
six months thereafter unless a dispute or acdon pursuant to this secdon is pending or addidonal data on the individual has been collected or created.
The responsible authoriry shall pmvide copies of the private or public data upon request by the individual subject of the dara. The responsible authority
may require the requesting person to pay the actual cosu of making,certifying,and compiling the copies.
The responsible authority shall comply immediately,if possible,with any request made pursuant to this subdivision,or within five days of
the date of the request,excluding Saturdays,Sundays and legal holidays,if unmediate compliance is not possible. If he cannot comply with the request
within that time,he shall so inform the individual,and may have an additional five days within which to comply with the request,excluding Saturdays,
Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private
data concerning himself. To exercise this right,an individual shall nodfy in writing the responsible authority describing the nature of the disagreement.
T'he responsible authority shall within 30 days either: (a)correct the data found to be inaccurate or incomplete and attempt to notify past recipiena of
inaccurate or incomplete data, including recipiena named by the individual;or(b)notify the individual that he believes the data to be correct. Data
in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data.
1'he detemiinadon of the responsible authoriry may be appealed pursuant to the provisions of the administrative procedure act relating to
contested cases.
DATA PRIVACY ADVISORY
In accordance with M.S. 13.04, Subd.2, "Rights of subjects of data", we would like to inform you that your request
for a permit or license from the City of Orono or any of its departments may require you to furnish certain private or
confidential information.
You are notified that:
1. The information you fumish will be used to determine your qualification for the permit or license requested.
2. You may refuse to supply data, but refusal may require that the City deny the permit or license.
3. The information may be shared with other local, state or federal agencies to the eztent necessary to process
the pemut or license.
4. If your requested permit or license requires Council action to approve, some information may become
public.

To approve the vacation, subdivision and variances per the fmdings and conditions of the attached
resolutions.
Please arrange to sign the 3 original variance resolution copies. These must be notarized. I
understand that JoEllen Hun was given these for delivery to you. All persons with an interest
in the property must sign the resolutions.
Final Metes and Bounds Suhdivision Approval
The vacation and subdivision approval resolutions, the survey, and other required documents will
be recorded as necessary with Hennepin County Tax Office by the City Attomey. The following
items must be received by the City before such filing can take place:
1. A title opinion or other conf'umation of legal ownership of the properry in a form
satisfactory to the City Attorney.
2. Executed drainage easement over the drainageways shown on the survey, such drainage
easements to be 15' in total width, 7.5' either side of the defined center lines. Applicant
shall provide legal description for said easements. The standard form drainage easement
is enclosed for your use.
3. Executed easement for sanitary sewer lines located within Parcels A, G, B, D and/or F (if
your title opinion reveals that no such easement already exists). The standard format
document is enclosed. The City shall provide a legal description for said easements if
required.

4. Executed legal combination form to accomplish the following:
a. Parcel E shall be combined with Parcels A and G.
b. Parcel F shall be combined with Parcels B and D.
5. Quit claim deed to the City of the portion of Lot 5, Block 2, Saga Hill�evised and portion
of vacated Portland Place identified on E�ibit B as Parcel E. You may wish to have your
attorney draft this document; a standard form is attached should you wish to use it.
6. Submit three copies of the subdivision survey, signed by the property owners on the lines
provided.
You may be contacted by the City Attomey if additional information is required. Lot line
rearrangements which result in the transfer or exchange of parcels will not be recorded on your
title until deeds are exchanged and filed by the property owners. Deed exchange and filing is the
responsibility of the property owners.
Variance Approval & Building Permit
Variance approval is limited to the extent shown on the approved plan and as noted in the approval
resolution. Changes in approved plans are subject to further review by the City. Variance
� approval expires one year after date of approval if not used. A complete permit application must
be submitted no later than August 25, 1998. _
Staff is advised by the Building Off'icial that your contractor submitted an application for building
permit on September 2, 1997; however that application is incomplete in a number of respects, and
no permit can be issued until the following items are completed:
OThe signed and notarized variance resolutions must be retumed to the City.
� Filing by the City Attomey of the subdivision, vacation and all related documents must
be completed.
3. The following items must be completed or submitted for permit review:
a. Contractor must fill out the data privacy advisory on the back of the permit
application.
b. A survey including only the property involved with the proposed house, including
Parcels B, D and F.

c. A grading and drainage plan indicating all proposed changes in grade on the
Property•
d. Revised hardcover calculations, since the footprint of the house has changed
slightly from that proposed in the surveys submitted for variance approval.
