Box 633 Delano, Minnesota 55328 Dear Mr. Stevens, Mr. Moe, and Mr. Hirsch: Subject: Request for a Variance From Minnesota Rules, Chapter 4725 on the Wyatt Moe Property, 1230 Spruce Place, Orono, Township 117 North, Range 23 West, Section 8, Hennepin Count�Minnesota This letter is in response to your request for a variance from Minnesota Rules, Chapter 4725 to construct a we1138 feet from a floor drain located in the basement of the neighboring property at 1220 Spruce Place, Orono Minnesota. Minnesota Rules, part 4725.4450 requires that a well be located at least 50 feet from a buried sewer line or at least 20 feet from a buried sewer line constructed of cast-iron or approved plastic pipe with air-tested, watertight joints. Mr. James Stevens, well inspector with the Minnesota Department of Health (MDH), inspected the site on October 24, 1997. Mr. Stevens' inspection indicates that there is no location on the property that satisfies all of the required isolation distances. Based on the information submitted with the variance request, the site inspection by Mr. Stevens, and in accordance with Minnesota Rules, Chapter 4725, the variance is granted. The variance is granted because there is no location in the house on the above-mentioned property where it is feasible to place the sewer line and which satisfies all other required isolation distances. The proposed location, 38 feet north of the existing sewer, provides the most feasible separation between the existing floor drain and the proposed new well. Records of wells in the area, including wells on Spruce Street, indicate the presence of a clay confining layer extending from the surface to a depth of at least 60 feet. The presence of the confining layer and the requirement to grout through the confining layer should provide additional protection for the well. The well must be located a minimum of 5 feet from the buried gas pipe. If the well will be between 5 and 10 feet of the gas pipe, the well must be marked with a permanent sign warning of the gas pipe. 2. The well casing must extend to a depth of at least 50 feet. 3. The annular space between the casing and the bore hole wall must be filled with neat-cement grout as defined in Minnesota Rules, part 4725.0100 or high solids bentonite grout that is NSF approved and marketed as a well sealant. H'igh solids bentonite grout must be mixed to the manufacturer's specifications, or must meet the minimum requirements of 15 percent by weight bentonite as specified in Minnesota Rules, Chapter 4725, whichever is heavier. Grout must be inserted through the casing or through a tremie pipe from within 10 feet of the lower termination of the casing to the ground surface or base of the pitless unit or adapter. 4. All new sewers installed on the property between 50 and 20 feet of the well must be constructed of cast-iron or plastic pipe meeting the material specifications and installation methods described in Minnesota Rules, parts 4715.0530 and 4715.2820. The pipe must be successfully air-tested after installation by a licensed plumber, sewer installer if a plumbing license is not required, or in the presence of a local plumbing or zoning official, or 1Vlinnesota Department of Health(1ViDI� representative. The tester must submit written verification that the pipe was successfully tested at a uniform pressure of S lbs per square inch for 15 minutes as required by Minnesota Rules, part 4715.2820(Plumbing Code). Installation of the sewer must also meet the requirements of the city of Orono. 5. You must contact Mr. Stevens at 612/215-0830 or Mr. Ronald Thompson at 612/215-0831 at least 24 hours prior to starting well construction so that an inspector may be present during the construction of this well. 6. All other provisions of Minnesota Rules, Chapter 4725, shall be in effect. Alternative measures or conditions attached to a variance have the force of rule and effect of applicable rule. If the party violates the alternative measures or conditions attached to the variance, the party is subject to enforcement actions and penalties provided in the applicable law rule. This variance is conditioned upon the applicable acceptance of and compliance with the conditions of the variance. Failure by the applicant to comply with the conditions prescribed in the variance will result in the immediate expiration of the variance.
