PO Box 784 Excelsior, MN 55331 Re: 745 Spring Hill Road Zoning Permit Application#2012-00470 The City is in receipt of your zoning permit application which was received by this office on May 30, 2012. After a cursory review, your application is incomplete. The following items must be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Proof of Ownership. According to Hennepin County the property owner for 745 Spring Hill Road is not David Ericson. Please provide proof of current ownership. 2. Total Earth Movement Calculation. Please provide the calculation of total cubic yards of earth movement. Will there be any imported or exported material? If so, the numbers must also be included in the calculation. If the earth movement (grading, filling or excavating) exceeds 500 cubic yards a Conditional Use Permit will be required. 3. Construction Plans. Please provide a cross section of layers regarding the field construction. What type of materials will be used? Will the field be grass or some other type of material? 4. Escrow 8� Escrow Agreement. Building permits involving grading and/or review by the City's engineer require submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is $2,000. The escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a check for$2,500. The above information is required in order for the plan review to continue. If more than 500 CY of material is needed a Conditional Use Permit would be required. • Are the contours actual contours from an actual topographical lot survey or air flown contours? The contours shown on the plan should be field verified. • The contours should be shown further into the property to the east. • The plan shows proposed draintile in the ditch area. Any pipes under the proposed soccer area should be shown on the proposed plan. • The soccer field is currently shown to be build right up to the drainage and utility easement line. No part of the actual soccer field playing surface can fall within the easement area. • What is the pump tank and PVC pipes called out on the west side of the proposed soccer area for? • The grading shows it will be extending into the neighboring property. It appears Jamie Wilson is the owner of both properties so no agreements between property owners will be required. • Our wetland buffer requirements will be triggered. Lydiard Lake is considered a preserve wetland and natural environment lake. A 50' buffer will be required along the length of the property along the Lydiard Lake. Our engineer has requested more information or clarification as noted below. Please provide the information as requested. In order to address the required 50'vegetative buffer in item #8 you can either submit a wetland delineation or our wetland specialist can make a very conservative determination to set the edge. A buffer planting plan will be required along with a financial security relating to the buffer establishment. I have attached Orono's wetland regulations below. Purpose and intent. (a) The purpose of this section is to recognize, preserve and protect the environmental,aesthetic and hydrologic functions of the city's wetlands by regulating the use of wetlands and their adjacent properties in conjunction with the goals of the environmentat protection plan within the community management plan.These functions include,but are not limited to,sediment control, pollution control,filtration,fish and wildlife habitat and aquifer recharge.The surface water management plan will provide guidance for stormwater treatment requirements and wetland restoration opportunities in order to protect the integrity of wetlands. (b) The intent of this section is to protect wetlands to the maximum extent possible while allowing a reasonable use of the property.This section adopts the regulations and standards of the Wetland Conservation Act of 1991 (WCA), Laws of Minnesota 1991,chapter 354,as amended,and the rules adopted pursuant to the WCA. It also establishes a wetland overlay district.This overlay district further regulates the underlying land use as allowed by other districts or the WCA. (c) This article applies to,and wetland buffer areas must be created or existing buffer areas must be maintained around,a protected wetland located partially within,wholly within,or directly adjacent to the property in the following situations: (1) When the wetland is required to be replaced or restored,or when the wetland is being altered; (2) When new development occurs. For purposes of this subsection, new development means: a. Any subdivision that creates a new lot that has no principal structure on it; b. Construction of a principal structure on an existing vacant parcel of land; (3) When redevelopment occurs that has the potential to adversely impact a wetland. For purposes of this subsection redevelopment means the removal of the principal structure to the extent of more than 50 percent of its market value and volume and reconstruction on the same property.This requirement does not apply if construction is the result of less than 75 percent of the building being damaged by an involuntary force,such as fire,wind,or vandalism; (4) When any construction or land alteration activity that does not fall within the meaning of'redevelopment'has the potential to adversely impact a wetland. For purposes of this section,"the potential to adversely impact a wetland"exists when all of the following three conditions exist: a. The portion of the property disturbed by construction or land alteration activity drains to the wetland; and b. The amount of grading exceeds 50 cubic yards or the construction activity involves the disturbance of more than 5,000 square feet of area;and 2
