DRAINAGE EASEMENT
THIS INDENTURE , made this 24 c�ay of A{�ril ,
1989 , between George H. Partridqe and Patricia McF. Partridqe, * of the *husband
County of Hennepin and the State of and wife
Minnesota , on behal.f of themselves ,
their heirs , successors and assigns , (hereinafter referred to as
Owner) , and the City of Orono , a municipal corp�ration under the laws of
the State of Minnesota (hereinafter referrE�d to as City) .
W I T N E S S F: T H:
Owner , in consic(eration of the sum oE One Dollar ( $1 .00) and
other good and valuable consideration to Owner zn hand paid by the City,
the receipt and sufficiency whereof is herE�by acknowledged , does
Grant , Bargain, Quitclaim, and Convey unto i:he City, forever , the
following perpetual drainage easement over and under and across
property located in the County of Hennepin and the State of Minnesota ,
and Iegally described ir, Exhibit A attached hereto; (hereinafter
described as Landl .
Said easement includes the free right of the City or its
agents to enter upon, under and over said Land , to remove trees, brush ,
grass and dirt and other structures therefrom and to construct ,
maintain, repair , reconstruct and use dr�inage ways and other
improvements related thereto , and to enter upon said easement for the
purpose of inspecting , repairing , removing ��nd reconstructing such
facilities. The City shall return the area ..t disturbs to grade and
seed the same and replac� the surface soil with the originai type
material .
The Owner agreE�s to the followinQ :
A. No trees , shrubs or other vegetation shall be
destroyed , cut or removed frc,m the Land except as
authorized by written consent of City.
B. No earth , loam, peat , gravei , sc�il or any other natural
material or substance shall be mc�ved or removed from the
Land and there shall be no dredging or excavation of any
nature whatsoever or any change of the topography of the
Land without the written consent of City.
C. No soil , sand , gravel , or other substance or material as
landfill shall be placed , dumped or stored upon the Land
and no waste, trash or garbage shall be placed , dumped
or stored upon the Land .
D. No use shall be made of the Land except uses, if any,
which will not change or alter the natural condition of
the Land, and no use which would tend to change the
drainage, flood control , water conservation, erosion
control , soil conservation, fish and wil.dlife habitat
characteristics shall be made of the land or the water
situated thereon.
Owners herein do hereby remiss, rel.ease, acquit and forever
discharge, forever, the City and any and all of its officers and
employees of and from any and aII claims , demands or causes of action of
any kind or nature whatsoever� which may arise or accrue by virture of
any flowage or trespass with water .
Owners do not intend that the public should have any
interest in the above Iand by virture of this indenture or otherwise,
except as hereinabove set forth.
The Owner does covenant that the owner is in possession of
the above described property and easement and has lawful right and
authority to convey and grant the easement herein granted .
State Deed Tax Due Hereon: Exempt
IN TESTIMONY WHEREOF, Owner has hereunto set owner ' s hands

EXHIBIT "A" TO DRAINAGE EASEMENT
All that part of the SW$ SW� of Section 25, Township 118 N,
Range 23 W lying Southeasterly of the Southeasterly right of way
line of Spring Hill Road, as said right of way was established
pursuant to that certain Vacation Order recorded as Document No.
, and lying Northwesterly of the following
described line, to wit:
Corr�r�encing at the SE corner of said SW� SW�; thence running
West (assumed bearing) along the South line of said SW� SW�
a distance of 452.00 feet to the actual point of beginning of
the line to be described; thence N40°00'00"E a distance of
' 108.00 feet; thence N23°16'S6"E a distance of 222.03 feet
to a point 7.50 feet Southeasterly of (measured at right
angles) the Southeasterly right of way line of Spring Hill
Road; thence N28°38'57"E, parallel with said Southeasterly
right of way line, a distance of 133.00 feet; thence continuing
parallel with said Southeasterly right of way line along a
curve to the right, with a radius of 675.7 feet and a
central angle of 20°00' , for a distance of. 235.86 feet;
thence deflecting 90°00'00" to the left a distance of
7.50 feet to said Southeasterly right of way line, and there
terminating.
