Thank you for meeting with me yesterday. As you know, the construction project at 465 Spring Hill Road falls under the
City's requirement for submittal of an as-built survey prior to release of the Certificate of Occupancy (CO). The purposes
for the foundation survey prior to framing and the as-built survey prior to CO are several:
The foundation survey assures that, before additional resources are put into framing the structure, the foundation for the
structure is placed in the correct, approved, location and at the correct elevation.
Further, the as-built survey certifies the final topography of the site; assures that the property grading is conducted
according to the approved grading plan to verify drainage; hardcover and structural coverage as installed conforms to
both the City Code and approved levels for the project; and all other improvements to the properly not addressed by the
foundation survey are of the correct size and installed in the correct location. The as-built survey also serves as a final
"snap shoY'of the property to use as an accurate reference in the future as to what is approved and conforming on the
property.
I spoke with our engineer this AM and can offer a compromise regarding the as-built. Because hardcover is not a concern
and because the property involved allows for significant spacing between adjacent homes, we can allow you to submit an
as-built of only the areas where work was conducted on site, specifically the house location and driveway. I think this is
a significant reduction in area considering the size of the property as a whole. I hope this helps you as it is below the
standard but still fits the spirit of the code requirement.

Thanks for the email. Our as-built survey requirement was adopted, along with the foundation survey requirement, in
September of 2008. Our permit paper work was updated not long after that. The permit application form you used to
submit the Zona permit is dated 9/29/09 and the informational packet attached to the permit form included our updated
requirements.

The Building Permit packet dated 9/29/09 that was available when we bid this job in August 2010, does not list an as built
survey as a requirement.
The revised Building Permit packet dated 4/26/2011 now has it included.
From your email below, I now know that City code requires an as built survey, even though we were not notified of this
requirement by way of the Building Permit packet being issued in August 2010.
Since we do not know all of Orono's codes and ordinance, the cost of this survey was not included in our bid to the owner.
The first we were made aware that this might be a requirement was seeing it listed on the permit card. This was well after
we submitted our bid to the owner.
The owner authorized us to proceed to build this home based on the bid we gave him.
The owner is not willing to pay for the additional charge for this survey.
We build homes in many municipalities and need to trust that the information we receive from that municipality is
comprehensive and complete in order to give an accurate bid to our owners that they can trust.

� BUILDING PERMIT APPLICATION SUBMISSION REQUIREMENTS (continued)
J. COSTS OTHER THAN BUILDING PERMIT FEES
1. Orono Code provides that directly assignable consuitants' costs for review of building permit
applications must be paid by the applicant or property owner:
a. City Engineer's costs in excess of$500
b. City Attorney's costs for review of legal questions and documents
c. Other unusual charges for outside consulting services of appraisers, other engineers and
unusual technical reports after notification to the applicant and property owner that such
services are necessary for review of the application.
In making an application, the applicant or property owner agrees to pay these costs as they occur.
Failure to make payment may results in the withholding of the permit inspections or certificate of
occupancy and certification to the property taxes of the unpaid balance.
2. An escrow of$2,500 is required. Escrows are required for:
a. New Home Construction
b. Additions
c. New Buildings(Garages, Accessory Structures)
d. Grading Projects
3. Once a building application is received, the appropriate escrow agreement will be prepared by staff
and sent to the homeowner for their signature(s).
K. PERMIT APPLICATION; INFORMATION REQUIRED
1. The application for a construction permit shall include such information as may be required by the
city, which may vary between types of construction projects.
2. Surveys required:
a. lnitia!survey. The certificate of survey shall conform to the standards on file in the office of
the building official.
b. Foundation survey. The foundation survey will certify lot dimensions; front, side, rear,
lakeshore, and wetland setbacks; and foundation elevation. A foundation survey must be
submitted before proceeding with framing or further construction. In fieu of a survey a letter
prepared by a Minnesota Registered Land Surveyor containing the same information as a
foundation survey may be submitted.
c. As-built survey. The as-built survey shall certify the final topography of the site; verify
drainage patterns; and provide hardcover calcuiations for lots in the Shoreland Overlay
District. An as-built sunrey must be approved before the issuance of a certificate of
occupancy. In the event that weather or other conditions prevent the completion of an
as-built survey at the time the Certificate of Occupancy is requested, a temporary
Certificate of Occupancy may be issued upon receipt of a $10,000 financial guarantee
and establish an escrow agreement to ensure completion of the as-built survey and all
site improvements.

Dear Melanie:
We have reviewed the as-built plans for 465 Spring Hill Road. The plans are dated 10-3-11. We have the
following comments with regards to engineering matters:
• The site and grading plans are generally acceptable from an engineering standpoint.
• There several proposed items that were not included in the as-built drawing that may not have been
constructed, but should be addressed for the future. The 10-5-10 plan shows entrance monuments,
a bocce court, and a driveway to the existing garage. If these items were constructed, they should be
shown on the as-built plan. If they were not, constructing these items at a later date may trigger
additional review.
