The property abuts <br /> two streets/roads. Unfortunately, we are unable to issue the permit because the structure is in the front yard. The <br /> City defines the front of the property as the boundary of a lor which abuts an existing or dedicated public or private <br /> street, and in the case of a corner lot it shall be the shortest dimension on a public or private street. The front of this <br /> property is considered County Road 6. City Code Section 78-1435(copy enclosed)states, no detached garage or other <br /> accessory building shall be located nearer to the front or street lot line than the principal building on that lot. <br /> Staff conducted a preliminary review based on the information provided and has the following comments: <br /> 1. Accessory Structure. The proposed location of the accessory structure cannot be approved administratively <br /> as shown. You may apply for a variance to request to have the accessory structure forward of the principal <br /> structure. Attached is a variance application. <br /> 2. Septic Site. The current septic site on the property is a Type IV installed in 2007. The application was reviewed <br /> by the Septic Specialist who has the following comments: <br /> a. According to City Code Section 58-47(d),copy enclosed a future drainfield site must be designed and <br /> preserved prior to the issuance of a building permit construction to an accessory building. An alternate <br /> septic site needs to be identified by a licensed designer,verified and approved by the City. A Type I or <br /> a Type III is required by the City's ordinance. <br /> b. If a Type I or Type III septic site cannot be identified a variance must be requested to depart from this <br /> requirement. <br /> c. City code also requires a 20'setback from the structure to the absorption area. Updated information <br /> must be provided to ensure the setback is met. <br /> 3. Driveway. According to City Code Section 18-136(a), copy enclosed, one driveway per property is allowed. <br /> The access to the accessory structure must be off of the existing driveway. The second driveway/curb cut must <br /> be removed. <br /> The building permit forthe accessory structure cannot be administratively approved at this time.
