Good Morning Rich,
City Administrator,lessica Loftus and Joe Brennan had a conversation regarding the after-the-fact(double fee) and have
come to the agreement that the following will be paid:
$191.75 Building Permit Fee based on $9,500 estimated construction value
95.88 Half of after-the-fact(double fee)
57.53 Additional plan review fee
4.75 State surcharge
$349.91
Once the above amount is paid,we can start the escrow refund process. Please note,we refund escrow funds to the
property owner. According to the application received and the signed escrow agreement, Robin Grierson is the
property owner,yet Hennepin County shows the property owner is Hockey Bros, LLC. The escrow will be refunded to
the property owner of record. If the property has recently sold, please provide a copy of the deed for the new owners.

Rich,
On August 28, 2013, we received an as-built survey dated August 23, 2013 for 145 Smith Avenue. Based on
our review of the survey and a site inspection, the deck and false gable we discussed this summer, were
constructed without proper building permits. Construction without a building permit is in violation of City Code
Section 86-68. A copy of the code section is below.

This property is considered to be in violation. In order to resolve the violation you must address the after-the-
fact permit requirements. Please note, no further permits will be issued until this is resolved. We have noted
in our file for this property, the deck and false gable were constructed without inspections.
According to the City's 2013 Fee Schedule when construction begins before a building permit is issued, an
after-the-fact (double fee) is required, see attached. An advanced plan review feel of$67.11 was paid on
5/17/13 based on an estimated construction value of$4,000. A corrected building permit application was
submitted by you in June and the estimated construction value increased to $9,500. The building permit fee
based on $9,500 is $191.75, this amount doubled $383.50 plus an additional advanced plan review fee of
$57.53 and a state surcharge of$4.75 equals $445.78. The after-the-fact amount of$445.78 must be paid
before Monday, September 16, 2013. Please note, the City will continue to hold the $700 escrow deposit
until $445.78 is paid.
Be advised, if you fail to comply with this notice, this matter will be sent to the City Attorney for review and may
result in criminal prosecution.

permit for each such building, structure or separate component from the city.

On May 17, 2013 the City received a building permit application for a deck. Your appiication is incomplete.
The following items must be submitted or revised in order for your application to be considered complete and for
the plan review to continue:
1. Certificate of Survey. Please provide 2 copies of an updated, full size certificate of survey which meets
all of the City's survey standards (enclosed) indicating the location of the proposed deck (and any
proposed grading) as well as all existing buildings, structures, landscaping, retaining walls and hardcover
on the property. The last survey on file is dated 1977 and it does not show any decks. This property is
located in the RR-1 B zoning district and required principal structure setbacks 50' from the property line on
all street frontages. The interior side setback is 30'.
2. Building Permit Application. The building permit application submitted is for Maintenance/Renovation.
Please complete a Building Permit Application for New Structures. A copy is attached for your
convenience.
3. Escrow 8� Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee
reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally
this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and
stormwater. The required escrow amount for this project is $700. The escrow agreement is enclosed.
The property owner must sign the escrow agreement and submit a check for$700.
Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please
contact the MCWD regarding your project. Please note, the City of Orono will not issue a building permit without
a copy of MCWD permits or documentation from the MCWD stating the proposed project does not trigger any of
their permitting requirements. The above information is required in order for the plan review to continue. Please

Joe,
We received a survey dated June 27, 2013 for the property addressed 145 Smith Avenue. The survey submitted is not to
scale and does not reflect all existing hardcover on the property. Even though the property is not located in a
Stormwater Quality Overlay District,the property should accurately reflect all existing buildings, structures, landscaping
and retaining walls,as indicated on our survey requirements, copy attached. Please have the survey updated and
submit two full-size, scalable copies so we can continue our review.
Also, Rich,you inquired if the abutting property(PIN 02-117-23-21-0018) is a buildable lot. The PIN 02-117-23-21-0018
is also located in RR-1B zoning district which requires 50'front and rear setbacks and 30'side yard setbacks. According
to City Code Section 78-72(b)(1), Lots of Record (see below),the lot is not eligible for administrative approval;a number
of variances would be necessary to build. Further,the deck being proposed or the existing house will not meet the
required sideyard setback of 30' if the PIN 02-117-23-21-0018 is not included in the setback measurements.
To simplify the PIN 02-117-23-21-0018 could be combined with the property addressed 145 Smith Avenue. The City can
request Hennepin County to combine the two PINs into one PfN. We will need written request from the property owner
and a copy of the deeds for each PIN.
If you are going to pursue a variance to attempt to build on PIN 02-117-23-21-0018 the deck permit will not be allowed
because it will not meet the sideyard setback. You should set up an appointment with stafF to discuss. A variance
application fee is$700 and it is non-refundable. A variance request requires Planning Commission and Council
approval...usually about 2%: month process.

this chapter as to area or width may be utilized for a single-family detached dwelling purpose,provided
that in the judgment of the council or administrative approval by the planning director, such use does not
adversely affect public health or safety and the following requirements are met:
(1) In R districts of one acre or less and served by public sanitary sewer. A lot of record existing
upon January 1, 1975, in any R district of the city of up to and including one acre,which lot is
serviced by public sanitary sewer and which does not meet the requirements of this chapter as to

On August 28, 2013, we received an as-built survey dated August 23, 2013 for 145 Smith Avenue. Based on
our review of the survey and a site inspection, the deck and false gable we discussed this summer, were
constructed without proper building permits. Construction without a building permit is in violation of City Code
Section 86-68. A copy of the code section is below.
This property is considered to be in violation. In order to resolve the violation you must address the after-the-
fact permit requirements. Please note, no further permits will be issued until this is resolved. We have noted
in our file for this property, the deck and false gable were constructed without inspections.
According to the City's 2013 Fee Schedule when construction begins before a building permit is issued, an
after-the-fact (double fee) is required, see attached. An advanced plan review feel of$67.11 was paid on
5/17/13 based on an estimated construction value of$4,000. A corrected building permit application was
submitted by you in June and the estimated construction value increased to $9,500. The building permit fee
based on $9,500 is $191.75, this amount doubled $383.50 plus an additional advanced plan review fee of
$57.53 and a state surcharge of$4.75 equals $445.78. The after-the-fact amount of$445.78 must be paid
before Monday, September 16, 2013. Please note, the City will continue to hold the $700 escrow deposit
until $445.78 is paid.
Be advised, if you fail to comply with this notice, this matter will be sent to the City Attorney for review and may
result in criminal prosecution.

On August 28, 2013, we received an as-built survey dated August 23, 2013 for 145 Smith
Avenue. Based on our review of the survey and a site inspection, the deck and false gable we
discussed this summer, were constructed without proper building permits. Construction without
a building permit is in violation of City Code Section 86-68. A copy of the code section is
below.
This property is considered to be in violation. In order to resolve the violation you must address
the after-the-fact permit requirements. Please note, no further permits will be issued until this is
resolved. We have noted in our file for this property, the deck and false gable were constructed
without inspections.
According to the City's 2013 Fee Schedule when construction begins before a building permit is
issued, an after-the-fact (double fee) is required, see attached. An advanced plan review feel
of $67.11 was paid on 5/17/13 based on an estimated construction value of$4,000. A corrected
building permit application was submitted by you in June and the estimated construction value
increased to $9,500. The building permit fee based on $9,500 is $191.75, this amount doubled
$383.50 plus an additional advanced plan review fee of$57.53 and a state surcharge of$4.75
equals $445.78. The after-the-fact amount of$445.78 must be paid before Monday,
September 16, 2013. Please note, the City will continue to hold the $700 escrow deposit until
$445.78 is paid.
Be advised, if you fail to comply with this notice, this matter will be sent to the City Attorney for
review and may result in criminal prosecution.

We received a survey dated lune 27,2013 for the property addressed 145 Smith Avenue. The survey submitted is not to
scale and does not reflect all existing hardcover on the property. Even though the property is not located in a
Stormwater Quality Overlay District,the property should accurately reflect all existing buildings,structures, landscaping
and retaining walls,as indicated on our survey requirements, copy attached. Please have the survey updated and
submit two full-size,scalable copies so we can continue our review.
Also, Rich,you inquired if the abutting property(PIN 02-117-23-21-0018)is a buildable lot. The PIN 02-117-23-21-0018
is also located in RR-1B zoning district which requires 50'front and rear setbacks and 30'side yard setbacks. According
to City Code Section 78-72(b)(1), Lots of Record (see below),the lot is not eligible for administrative approval; a number
of variances would be necessary to build. Further,the deck being proposed or the existing house will not meet the
required sideyard setback of 30' if the PIN 02-117-23-21-0018 is not included in the setback measurements.
To simplify the PIN 02-117-23-21-0018 could be combined with the property addressed 145 Smith Avenue. The City can
request Hennepin County to combine the two PINs into one PIN. We will need written request from the property owner
and a copy of the deeds for each PIN.
If you are going to pursue a variance to attempt to build on PIN 02-117-23-21-0018 the deck permit will not be allowed
because it will not meet the sideyard setback. You should set up an appointment with staff to discuss. A variance
application fee is$700 and it is non-refundable. A variance request requires Planning Commission and Council
approval...usually about 2%: month process.

Sec. 78-72. - Lots of record.
(a) A lot of record is any lot for which a deed or registered land survey has been recorded in the office of
the Register of Deeds or the Registrar of Titles for Hennepin County prior to January 1, 1975, and after

(b) A lot of record existing upon January 1, 1975, in an R district,which does not meet the requirements of
this chapter as to area or width may be utilized for a single-family detached dwelling purpose,provided
that in the judgment of the council or administrative approval by the planning director, such use does not
adversely affect public health or safety and the following requirements are met:
(1) In R districts of one acre or less and served by public sanitary sewer. A lot of record existing
upon January 1, 1975, in any R district of the city of up to and including one acre, which lot is
serviced by public sanitary sewer and which does not meet the requirements of this chapter as to
area or width only,may be utilized for single-family detached dwelling purposes without council
approval if all other requirements of the underlying zoning district are met, including but not
limited to required yards, setbacks, lot coverage by structures, hardcover, etc. However,the lot of
record sha11 not be more intensely developed unless combined with one or more abutting lots or
portions so as to create a lot meeting the requirements of this chapter

On May 17, 2013 the City received a building permit application for a deck. Your application is incomplete.
The following items must be submitted or revised in order for your application to be considered complete and for
the plan review to continue:
1. Certificate of Survey. Please provide 2 copies of an updated, full size certificate of survey which meets
all of the City's survey standards (enclosed) indicating the location of the proposed deck (and any
proposed grading) as well as all existing buildings, structures, landscaping, retaining walls and hardcover
on the property. The last survey on file is dated 1977 and it does not show any decks. This property is
located in the RR-1 B zoning district and required principal structure setbacks 50' from the property line on
all street frontages. The interior side setback is 30'.
2. Building Permit Application. The building permit application submitted is for Maintenance/Renovation.
Please complete a Building Permit Application for New Structures. A copy is attached for your
convenience.
3. Escrow 8� Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee
reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally
this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and
stormwater. The required escrow amount for this project is $700. The escrow agreement is enclosed.
The property owner must sign the escrow agreement and submit a check for$700.
Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please
contact the MCWD regarding your project. Please note, the City of Orono will not issue a building permit without
a copy of MCWD permits or documentation from the MCWD stating the proposed project does not trigger any of
their permitting requirements. The above information is required in order for the plan review to continue. Please

Recitals
1. A building permit applicatinn has been filed for a deck located at 145 Smith Avenue the("Subject
Property"), legally described as , Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $700 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in aaministering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2013-00379 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills fo�incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING E$CROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners wnen the review has been completed and written notification is received from the Owners requesting the
funds.
S. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
