3. The prop��sed plat centajris two lots (designated as proposed Lot 1, I31ock 1 and �
proposed Lot 1, Block 2), each containing an e�:istina resic�etice str�cture, ;
proposed Lot 1, 13iock 1 being 2.75 acr�s in area, and proposed I,ot 1, Block 2
being 1.94 acres in area. Prorased Lot 1, Biack 2 technically requires a lot area
variatice, but will retain cwnership of ar�additional 0.Q7 acre outic�t and may gain
up to an addi�i<3nal 0.2$ acres as noted bt;low, in order to meet fit?� 2.0 acr�
miriirr.urr� iot �ar:;a requiremerit.
4. The septic systern serving the residence on proposed �.at 1, Block 1 is i'ailing and
` is intezided to be replaced. Oii-sit� sewage treatmezit system site evaluation data
indicates that primary and alternate drainfield sites fc�r current and future use are
available within p:oposed Lot 1, Block 1. No septic testing is c�equired for the
existing residence on proposed Lot 1, Bl�ck 2 since it is a pre-existing lot.
_5. In addition to proposed Lot 1, Biock 1 and proposed Lot 1, Block 2, four outic�ts
are prcposed to be cr�ated with the following intent for each:
(a) Outlot A: 0.28 acre remainder parcel to be combined with propQsed Lot
1, Block 2, at such time that Outlots B and D are used for private
driveway or road access to Uutlot C.
(b) Outlot B: 0.32 acre 50' f�ature road corridor providing access for f�ture
dPvelopment of Outlot C. In the event that Outlot C is further developed
using road access from adjacent properties not requiririg the use of Outlots
E and D, Outiots A and B will be 1Pgally combined with proposed Lot 1,
Block 1.
(c) Outlot C: 14.13 acre parcel intended for future development into single
family residential lots. Outlot C is intended to not be buildable for even
a single residence unless or until it is funher subdivided and/or replatted
into ane or more building sites.
(d) Outlot D: 0.07 acre future road corridor segment to complete continuous
a�cess izl conjunction with Outlot B for future development of Uutlot C.
In the event that Outlot C is further developed using road accesses from
adjacent properties not reyuiring the use of Outlots B and D, Oirtlot D will
be legally combined with the proposed Lot 1, Block 2.

1, Bay��iew Farms in favor of Lot 2, Block 1, Bayview Parms. Tlte ir�cic�sion of
Lot l, Block 1, Bayview Fanns in this prapased plat is the sul�ject of an '
agreement attached to this resolutiun as Exhibit A, which cJe�ails ihe app:icants'
intent regarding the izxture use and dis�osition of Outlots A, B and T3.
7. It is the C:ity's ii�tent that if Outlots B and D are developed for future road to
serve Gutlot C, t�len the existing residences on proposed Lot 1, Block 1 and
proposed Lot 1, IIlock 2 shall cnnstrUcl driveway accesses onto said new road and
eliminate the existitlg direct driveway accesses to 13a�side Road.
8. It is the City's intent t�at in the event Uutlots B acid D are usec� in the future for
road purpuses tliat such road shall Ue ccsustructed to City staiidards. Further, it
is the City's intent that in ordPr to guaraniee the firture access to Outic�t C,
applicants shall ��ravid� to the City standard road and utility easettients over
Uutlots 3 and D. It is tlie City's furt;�er inteut that if Outl�t C is develo�ed
without the need for access via Outlots B an� ll, that such road and utility
easements will be vacate�l upon formal request of the property owners.
9. It is t'r.e City's intent tliat Outlots A, B and C sh�11 remain in comman own�rship
until Outlot C is f'u:the�• �ie��eloped, and that Gutlot D shal! remair. in comn�on
ownership with proposed Lat ?, Block 2 until �utlot C is futth�r dev4�c�pf::d.
10. It is the City'S intent that at the time Outlot C is further cieveloped, the City will

necessary and appropriate public easements witl�ir► Outlots A, B, C az:d D.
11. It is the City's intenk that propased Lot 1, Block 1 and proposed Lot l, Black 2
grant the standard perimeter utility and drainage easemer�ts based on the
assumption that Outlots B and ll will in the future become a roadway.
12. Although Hennepin County Department of Public Works has requested additional
right-of-way for County Rc�ad 84, no additional County road right-of-way �,�ill be
required of the developer consistent with the standards for a collector road in the
Oro�io Comprehensive Plan.

Surveys Company Inc., si�bject to the fellowing condi±ions:

weeks prior to the regularly scheduled Council meeting on the second and fourth Moi�days of
the month:
