AGREEMENT made this�day of r 20,�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City")and Q� ("Owners").
Recitals
1. A building permit application has been filed for a new principal structure located at
4300 Sixth Avenue North, the ("Subject Property"), fegally described as Lots 2 and 3, all in Block 1, Sharon Hills
and Outlots A and B,Winters Plentywood, Hennepin County, Minnesota.
2. Owners request the City to review this appiication.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, If any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escraw is to guarantee the establishment and
development of the required native wetland buffer and reimbursement to the City for all out-of-pocket costs the
City.has incurred (including planning, engineering, in excess of$500, or legal consultant review) or will incur in
reviewing the plan. Eligible expenses shall be consistent with expenses the Owners woufd be responsible for
under a building permlt application. The escrow will also guarantee reimbursement to the City for all out-of-pocket
costs the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution
Prevention Plan and the provisions of Orono Clty Code Chapter 79. The financial security may also be used by
the City to eliminate any hazardous conditions associated with the work and to repair any damage to pubEic
property or infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with Demolltion Permit #2013-00088 8� Butlding Permit # 2013-001126 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BIl.LING. As the City receives consultant bills for incurred.costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeftame outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the revisw has been completed,the buffer is established and written notification is received
from the Owners requesting the funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn..Stat. §§415.01 and 366.012.

We received a demolition permit application for the principal structure at 4300 Sixth Avenue North. Before we
can issue the permit we need some additional information.
Zoning Disclosure 8� Declaration. Attached is a copy of the Zoning Disclosure & Declaration. Please sign
the document and return to the City.
Demolition Escrow Agreement. In conjunction with the demolition permit, a $2,500 escrow is required.
Please sign the attached Demolition Escrow Agreement and return it with a check for $2,500.
Demolition Permit Application. We will need your contractor to provide us with the survey's showing
buildings and erosion control. (Items #1 and #2 as listed on the Demolition Permit Application, copy attached.)
What is the status of your building permit application submittal? Since you plan to build soon after demolition,
it would be helpful if we had your building permit application to review.

Sec. 78-72. - Lots of record.
(a) A lot of record is any lot for which a deed or registered land survey has been recorded in the
office of the Register of Deeds or the Registrar of Titles for Hennepin County prior to January
1, 1975, and after approval by the council if required.
�b) A lot of record existing upon January 1, 1975, in an R district, which does not meet the
requirements of this chapter as to area or width may be utilized for a single-family detached
dwelling purpose, provided that in the judgment of the council or administrative approval by
the planning director, such use does not adversely affect public health or safety and the
following requirements are met:
`� (�) In R districts of one acre or less and served by public sanitary sewer. A lot of record

existing upon January 1, 1975, in any R district of the city of up to and including one
acre, which lot is serviced by public sanitary sewer and which does not meet the
requirements of this chapter as to area or width only, may be utilized for single-family
detached dwelling purposes without council approval if all other requirements of the
underlying zoning district are met, including but not limited to required yards,
setbacks, lot coverage by structures, hardcover, etc. However, the lot of record shall
not be more intensely developed unless combined with one or more abutting lots or
portions so as to create a lot meeting the requirements of this chapter.
�� (2) In R districts of greater than one acre and served by public sanitary sewer. A lot of
record in any R dis nct in e city in excess otone acre which does not meet the
requirements of this chapter as to area or width only may be utilized for single-family
detached dwelling purposes by administrative approval if the planning director finds
that the following conditions are met:
a� It is at least one acre in size, and the average width of the lot is at least 100
feet;
b� It is served by public sanitary sewer; and
�� It otherwise meets the requirements of this chapter or other applicable Code
provisions.
�, T (3) In R districts not served by public sanitary sewer. A lot of record in any R district in the
�J city not served by public sanitary sewer must meet the area and width requirements of
this chapter and shall not be utilized for single-family detached dwelling purposes
without council approval. Administrative approval may be granted for a lot of record
not meeting the lot area and width requirements if the planning director finds that the
following conditions are met:
✓a� The lot area and lot width each meet at least 50 percent of the district standard.
b� Suitable primary and alternate septic sites are identified on the property and
are protected from future development by execution of a covenant.
�� All other zoning ordinance requirements must be met, including but not limited
to the following:
�� Setbacks.
2� Hardcover.
3• Lot coverage by structures.
4� Accessory structure requirements.
(�) A lot of record located in any shoreland district, including the shoreland overlay district, RS
seasonal recreational district, and lakeshore residential districts, that does not meet the
requirements of this chapter for lot size or lot width shall be subject to the following
regulations:

, • (1) A nonconforming single lot of record may be allowed as a building site without
variances from lot size and width requirements, provided that:
a• All setback requirements can be met;
b• A Type 1 sewage treatment system consistent with Minnesota Rules, chapter
7080, can be installed or the lot is connected to a public sewer; and
�• The impervious surface coverage meets all hardcover location and square
footage restrictions of this chapter and the total square footage of hardcover
does not exceed 25 percent of the entire lot area.
d• All other zoning district standards can be met.
(2) In a group of finro or more contiguous lots of record under a common ownership, an
individual lot must be considered as a separate parcel of land for the purpose of sale
or development, if it meets the following requirements:
a• The lot must be at least 66 percent of the dimensional standard for lot width
and lot size for the shoreland classification consistent with Minnesota Rules,
chapter 6120;
b• The lot must be connected to a public sewer, if available, or must be suitable
for the installation of a Type 1 sewage treatment system consistent with
Minnesota Rules, chapter 7080, and local government controls; and
�• Impervious surface coverage must meet all hardcover location and square
footage restrictions of this chapter and the total square footage of hardcover
must not exceed 25 percent of the entire lot area; and
d• Development of the lot must be consistent with the comprehensive plan.
(3) A lot subject to either subsections 78-72(c)(1)or(2) remains subject to the hardcover
restrictions of this chapter, as follows:
a• Where the hardcover square footage allotment as calculated based on the
assigned tier exceeds 25 percent of the entire lot area, hardcover shall be
limited to 25 percent of the entire lot area.
b• No portion of the impervious surface square footage allowed shall be placed
within in 75 feet of a lake OHWL or tributary bank, except for those items
normally allowed in such location as regulated elsewhere in this chapter.
(4) A lot subject to subsection 78-72(c)(2) not meeting the requirements of subsection 78-
72(c)(2) must be combined with the one or more contiguous lots so they equal one or
more conforming lots as much as possible.
(5) Notwithstanding subsection 7 -72(c)(2), contiguous nonconforming lots of record in
shoreland areas under a common ownership must be able to be sold or purchased
individually if each lot contained a habitable residential dwelling at the time the lots
came under common ownership and the lots are suitable for, or served by, a sewage
treatment system consistent with the requirements of Minn. Stat. § 115.55 and
Minnesota Rules, chapter 7080, or connected to a public sewer.
(6) In all variance requests, zoning and building permit applications or conditional use
requests, the property owner shall address, when determined as appropriate by the
city engineer or city staff, storm water runoff management, reduction of impervious
surfaces, setback increases, restoration of wetlands, vegetative buffers, sewage
treatment and water supply capabilities, and other conservation-designed actions.
(7) A portion of a conforming lot may be separated from an existing parcel as long as the
remainder of the existing parcel meets the lot size and sewage treatment
requirements of the zoning district for a new lot and the newly created parcel is
combined with an adjacent parcel.

We have not received the items required for us to complete our review of the demolition permit application.

Also, we have not received a building permit application for the new principal structure. If we receive all the
outstanding items needed for the demolition permit application and haven't received a building permit
application, our attorney will need to draft a document outlining the timeline for the accessory structures to
remain on the property. All costs associated with the drafting of the document are passed through to you, the
property owners.

AGREEMENT made this �r� day of � , 20�; by and between the CITY OF
ORONO, a Minnesota municipal corporation ("City") and Mega Jason Gehrman("Owners").
Recitals
1. Construction of the new residence located at 4300 Sixth Avenue North the ("Subject
Property°), legally described as Lots 2 and 3, all in Block 1, Sharon Hills and Outlots A
and B, Winters Plentywood, Hennepin County, Minnesota, is the subject of building
permit application number 2013-00126 has been completed.
2. Winter conditions currently prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittal of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any damage to public property or
infrastn.icture that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2013-00126 and demolition permit #2013-00089 if compliance with
the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incuRed costs, the City will
in tum send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners'receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when the review has been completed and written notification is received from the Owners
requesting the funds.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose
of inspecting and completing any exterior improvements, final grading, establishment of vegetation and
the restoration of the subject property should the Owners not complete the work by the specified dates.

AGREEMENT made this�day of 'r 20�, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City")and Q�CI ! ("Owners").
Recitals
1. A building permit application has been filed for a new principal structure located at
4300 Sixth Avenue North, the ("Subject Property"), legally described as Lots 2 and 3, all in Block 1, Sharon Hills
and Outlots A and B, Winters Plentywood, Hennepin County, Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee the establishment and
development of the required native wetland buffer and reimbursement to the City for all out-of-pocket costs the
City has incurred (including planning, engineering, in excess of $500, or legal consultant review) or will incur in
reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible for
under a building permit application. The escrow will also guarantee reimbursement to the City for all out-of-pocket
costs the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution
Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used by
the City to eliminate any hazardous conditions associated with the work and to repair any damage to public
property or infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with Demolition Permit #2013-00089 & Building Permit # 2013-001126 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed,the buffer is established and written notification is received
from the Owners requesting the funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

Recitats
1. An applicatlon for a demolition permit has been flled for the principal struciure located at
4300 Sixth Avenue North ("Subject Property")legally described on attached Exhibit'A".
2. In conjunctlon wlth the demolitfon, erosion control measures are required as shovm on attached
Exhibit'8".
NOW,THEREOFRE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the executian of this Escrow Agreement,

associated with the work and to repair any damage to public property or infrastructure that is caused by the work. If
compliance with the approved Lend Disturbance Permit is�ot accomplishec3 within the allowable tlme pe�lod,the City
may bring the project into compliance by use of the security.
3. RIGHT OF ENTRY. The Owne�s hereby grant the City, its agents, employees, ofFicers and
contractors the right to enter the property to pertorm all work and inspecdons deemed appropriate by the Ciry in
conjunction with the required erosion control measures,including but not limited to constructing or completing any and
all of the agreed upon improvements should the Owners' contraetor not complete those improvements by the date
specified herein.

completion and inspection of all such measures and the establishment of final stabilization for the Subject Property.

incuned by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn.Stat.§§415.01 and 366.012.
