Building Permit Application
The City is in receipt of your building permit application which was received by this office
on February 2, 2006. During the plan review it was noted that the location of the proposed
building does not conform to City Code 78-1435 (see page 2). Therefore, a building permit
cannot be issued at this time. Please revise the location of the proposed building to be even
with or behind the existing home in order for your application to be considered complete
and for the plan review to continue.
Should you choose to proceed with the proposed building located nearer the front property
line than that of the house a variance application and required materials must be submitted
by February 22, 2006 prior to 12:00 noon. Per our phone conversation today, a request to
construct an accessory building nearer to the road than the principal building will not likely
receive staff support, or a favorable recommendation from staff during the variance review
process as a viable hardship inherent to the land must be demonstrated per State Statute. In
order to apply for a variance the following must be submitted in addition to the Variance
Application(enclosed):
1. Completed application form and $600 application fee
2. Completed Hardship Documentation Form
3. Certified Property Owners List. This is a list of property owners within 150' of
your property, labels and plat map. List, labels and map may be obtained from
Hennepin County Department of Finance, Government Center, A-603 300 South
6th Street, Minneapolis, or by calling 612-348-5910.
4. Two copies of a Certificate of Survey (signed by a licensed surveyor), meeting all
the requirements listed below. Also provide one copy 8.5" x 11" or 11" x 17" for
reproduction.
• Septic system including the primary and alternate treatment areas,
• Driveway,
• Existing topography — as during our telephone conversation you sited
topography as a reason for the proposed location of the shed,
• All existing and proposed structures.

Sec. 78-1435. Location.
No detached garages or other accessory building shall be located
nearer the front or street lot line than the principal building on that lot
except on lots which have frontage on a lake and rear yard adjacent to a
street, accessory buildings located within the street or rear yards of such
lots are subject to the setback requirements of section 78-305(b), section
78-330(b) and sectaon 78-350(b); except that detached garages may be
located ten feet from the street or rear lot line when doors face away from
the street and a turnaround is provided on the site. This section shall not
apply to lakeshore lots divided by roadways or corner lots.
