I apologize for the length of time it's taken me to reply to your questions. According to Citv Code Section 78-1405(9)(i)(7)a gate can be constructed but must be a minimum of 40'from the edge of the paved road. A fence may be constructed, up to 42 inches high along the property line. There is not a current copy of a survey on file for your property so the property line must be identified by a surveyor to show a gate would meet the required setback and the fence would be within your property boundary and not within the right-of-way. A building permit application is required for a gate. A zoning permit is required to create a berm,and depends on the amount of fill moved (copy attached). Grading,filling or excavating 51 to 500 cubic yards requires a Minor Land Alteration. If the grading,filling or excavating exceeds 500 cubic yards, a Major Land Alteration is required which also requires a Conditional Use Permit and requires council approval. Regardless of the permit type, preliminary submittals include an updated survey showing where the berm will be constructed,the amount of cubic yards to be brought and/or moved around the site and existing& proposed topography. The berm must be constructed with your property boundary and not within the right-of-way. According to Citv Code Section 78-967(b)(3), no grading is allowed within 5' of the property line without a Conditional Use Permit. There has been an increase in heavy semi traffic rushing past the house, along with an increase in general overall traffic. Also, we seem to be the turnaround spot of choice for lost motorists. We regularly have cars come down our driveway to turn around. We have been looking at options for barriers—either some kind of fence with a gate, a berm with trees or a combination of each. I have reviewed the Non-Lakeshore Propertv Fence Re�ulations— if I'm interpreting the information correctly it looks like I'm limited in height to 3.5 feet in mv zone. I would like to go to 6 or more feet in total height, especially because the house sits up higher than the road. Our neighbors immediately next to us had a berm built—we are considering that as a possibility as well — but I haven't been able to find any City rules that pertain to berms. If there are rules for berms —can you point me to them? Basically— I am looking for a solution that provides the most privacy and sound protection —while following city rules and keeping the cost down as much as possible. Any guidance or recommendations you can provide would be appreciated. Thanks!
