DRAINAGE AND UTILITIES EASEMENT
THIS INDENTURE,-made this 41 day ori'l Gr , 2001,, by and
between William J. M. Franklin and Pauline Franklin hereinafter referred to as "Grantor(s)",
and the City of Orono, a municipal corporation, its employees, interests and assigns, hereinafter
referred to as "Grantee".
WITNESS, THAT Grantor(s), in consideration of the sum of One Dollar ($1.00)
and other good and valuable consideration given by Grantee, the receipt of which is
acknowledged by Grantor(s), do(es) hereby grant, bargain, sell and convey to Grantee, its
successors and assigns, a perpetual easement for drainage and utility purposes, including the
right to construct and maintain the same, together with the right of the public for access over,
above, under and across the land located in the State of Minnesota, County of Hennepin, legally
described as follows:
See attached Exhibit A which is made part of this document.
In addition to any other remedy the Grantee may have, the covenants and
restrictions contained herein may be enforced by injunction.
Grantor(s) covenant that they are in fee title to the above property, have a lawful
right and authority to convey and grant this easement, and that the land is free from all
encumbrances except:
Grantor(s) have executed this document the day and year set forth above.

An easement over those parts of Lots 21 through 29 inclusive, Block 1, "Baldur Park", which lie
within 10.0 feet on the southwesterly side and 20.0 feet on the northeasterly side of the following
described centerline,:
Commencing at the most southerly corner of said Lot 21;thence on an assumed bearing of North 33
Degrees 35 minutes West along the southwesterly line of said Lot 21 a distance of 11.00 feet to the
point of beginning of the centerline being described;thence North 45 degrees 22 minutes East a
distance of 93.00 feet; thence North 9 degrees 45 minutes West a distance of 47.00 feet; thence
