Review of Renewal Application
Mr. Meinhardt has operated his electrical contracting business from his residence since
1986, review E�ibits D and E. The existing large barn was to serve for storage of his trucks
and equipment. The only employee to come to the site was an electrician who worked for
Meinhardt's business that would park his vehicle at the site and pick up the business truck. Mr.
Meinhardt's business and of�ce were operated from his residence. This level of home
occupation use by a contractor has been found to be acceptable as long as all commercial
equipment and vehicles are stored within an enclosed structure and not visible to adjacent
property owners. Mr. Meinhardt's wife served as secretary.
Since 1986, Mr. Meinhardt's wife's arthritic condition proceeded to worsen requiring a
part-time nurse who also took over the secretarial responsibilities, i.e. answering the phone.
Mrs. Meinhardt was able to take over the clerical responsibilities in the afternoon. In 1994,
Mrs. Meinhardt's condition worsened such that she was in the hospital off and on and passed
away a few months ago. The former nurse continues to do secretarial work for Mr. Meinhardt
up to about 1:00 p.m. An electrician continues to bring his vehicle to the property and pick up
the company truck. Per the original staff review memo of 1986, Exhibit E, it was the City's
understanding that all employee vehicles would be parked within the large barn. Mr. Meinhardt
advises that it is very difficult to facilitate the parking exchange within the barn on certain days
forcing the electrician's vehicle to be parked to the rear of the barn the majority of time.

On February 1 st, staff inspected the property noting certain commercial trailers and
building material (steel forms) stored in the rear yard. Staff took photos for Council's review.
Staff also noted that a boat and trailer for yard work was stored to the rear of the barn. The
conditions of the original home occupation license would find that the storage of the commercial
trailers and material were in violation of that license. Staff inet with Mr. Meinhardt to review
the storage of the commercial equipment and construction material. Applicant advised that the
commercial equipment and materials were his son's and he would see that his son removed his
property so that his license would not be invalidated. Staff reaffirmed the City's position in a
follow-up letter to applicant, Eachibit F.
Staff advised Mr. Meinhardt that we would go ahead and recommend approval of the
home occupation license as long as the exterior commercial items owned by his son were
removed and that we would recommend to the Council that we would monitor the property for
a period of six months and then bring back the matter before the Council for a status report.
Staff felt that recommendation would be most applicable with the current situation as Mr.
Meinhardt is in a transition period in an attempt to adjust how he plans to proceed with his
business, specifically regarding clerical assistance. Meinhardt did advise that in approximately
two years he would be considering retirement and selling the business. The applicant plans to
continue the use of Mrs. Grabill as a part-time secretary during the six-month interim period.
This would be a violation of the home occupation code. Applicant should be advised of the need
to pursue other m�:ans of clerical/phone back up in the operation of his business.
COUNCIL ACTION REQUESTED:
To adopt or amend staff recommendation to conditionally approve the home occupation
renewal license for Ben Meinhardt at the property located at 3585 Sixth Avenue North for a six-
month period (August 13, 1995) and to direct staff to submit a status report on the final resolve
of the business operation and to further determine if the use involves violations of the code and
if variances would be appropriate or acceptable to the City.
