You contacted me recently regarding the property at 3585 Si�cth Avenue North. As you are aware the property
contains an existing barn which was left after a taking of the north portion of the property (including the house) for road
right-of-way. The removal of the home from the property made the existing barn a non-conforming accessory structure
(without the principal structure). Our City Code nonconforming structures and uses regulations (LINK) will allow you to
maintain the barn or make improvements which do not result in a physical expansion of the structure (footprint or
volume).
You inquired about installing a well, septic system and half-bath in the barn. The City's code allows accessory structures
to contain plumbing fixtures in a few ways, a toilet and sink(aka half-bath) are permitted as an accessory use upon the
owner recording a covenant regarding the use of the structure in the chain of title of the property see the Code Section
78-1437 (LINK), or the addition of a shower or bath tub via a conditional use permit. I do think the City would approve a
CUP for a full bath absent the principal structure; however I believe the half-bath would be acceptable provided the
covenant is properly recorded.
