The property has an existing lot area of 0.994 acres and approximately 230' of defined width per Hennepin County tax records. The defined width exceeds the 200' minimum. Principal structure setback requirements are 50' from the front and rear property lines and 30' from the side property lines. The existing house appears to meet these setbacks per aerial photography on file at the City Offices. The lot is nonconforming in area at 0.994 acres when 2.0 acres is required. If the existing structure was destroyed, a variance to lot area would be required in order to rebuild on the site within the same footprint. Based on the history of lot area variances for teardowns/rebuilds it is likely that the City Council would grant a lot area variance. In my estimation, the property contains adequate area and currently meets the required setbacks and that a conforming residence could be constructed on the lot. Box 66 Orono, MN 55356 Crystal Bay, MN 55323-0066 April 20, 2009 RE: 3240 Sixth Avenue North —Zoning Compliance The above referenced property is zoned RR-1 B, One Family Rural Residential District, requiring a minimum lot size of 2.0 acres and 200 feet of width at the right-of-way. The property has an existing lot area of 1.0 acre and approximately 230 feet of defined width per Hennepin County tax records. The defined width exceeds the 200 feet minimum. Principal structure setback requirements are 50 feet from the front and rear property lines and 30 feet from the side property lines. The existing house appears to meet these setbacks per aerial photography on file at the City Offices. If the existing structure were destroyed, a structure could be rebuilt in-kind, same footprint, volume, roof pitch, etc. If a different structure were constructed it would need to meet hardcover and setbacks. Variance for lot area would be required in order to rebuild a different structure on the site. Based on the history of lot area variances for teardowns/rebuilds it is likely that the City Council would grant a variance, however hardcover requirements and setbacks must be met. Also of note, there is a Manage 1 wetland adjacent to the property. The exact location of the wetland is not known at this time, but a 35 foot buffer and a 20 foot setback from the wetland would be required for any structure.
