Per the attached memo from John Smyth, please refund this escrow. Also attached is a
copy of the cash register receipt.
With this kind of escrow we are supposed to be proactive and make sure the buffer is
established and maintained for two years, so there's no requirement for the property
owner to make a written request for its return. Actually Mrs. Kosek asked about it when
she was paying another escrow.
Please send a copy of John's memo along with the check.

I reviewed the site on 8-10-10 to determine if the site is in compliance with the wetland buffer
requirement. The turf area has been converted to native vegetation per the City requirements.
Overall the buffer meets the requirements of the ordinance. There is some thistle encroachment
along the edge of the buffer and lawn that should be spot treated with herbicide, but this is minor.
The site is currently in compliance and it is recommended that the $800 escrow be returned.

WITNESSETH:
The Grantor(s), in considera.tion of good and valua.ble consideration paid by the City, the
receipt and sufficiency of which is hereby acknowledged, hereby crea.te and grant unto the City a
permanent flowage and conservation easement for the purposes set forth in this instrument, over,
under, and across the wetland buffer as described in the legal description and site plan attached
hereto as E�ibit A(the "easement premises").
The Grantor(s) on behalf of themselves,their heirs, successors and assigns, hereby covenant
and agree as follows:
1. That the following aze prohibited in perpetuity within the wetland buffer:
A. Constructing, installing, or maintaining anything made by ma.n, including
but not limrted to buildings, structures, walkways, fences, fireplaces,
clothes line poles,playground equipment, roads or hardcover of any nature
whatsoever, except: 1) feeders, bird houses, and other devices intended to
foster wildlife; 2) docks or boardwalks when allowed by City ordinance
and under a valid City permit; 3) retaining walls when allowed by City
ordinance and under a valid City permit.
B. Cutting, mowing or removing shrubs or other vegetation, and cutting or
removing trees greater than four inches in diameter, except for tree disease
control by or as directed by a governmental agency. Grantor(s) may
remove brush, diseased or dead trees of ar�y size, and noxious weeds.
C. Excavation or filling or material alteration of grade, including changes to
the size, depth or contour of the wetland; dredging, mining or removal of
earth,loam,peat, gravel, soil or any other natural material.

In May 2006 the Kosek's escrowed $800 to guarantee seeding of a buffer area required in
conjunction with a swimming pool. Mrs. Kosek was in today taking care of another
escrow. After I explained that she would have to make a written request to have it released
she told me they had made this escrow in 2006 and didn't know they had to request its
return. She said the seeding had been done.
So when you are in the area please check it out and let me know if the escrow can be
released.

Remarks:
The applicant consultant has proposed to seed the below native grass seed mixture at a rate of 9 Ibs per
acre (21bs for site) and the below wildflower seed mixture at a rate 3 Ibs per acre (0.5 Ibs for site). This
mixture meets the native vegetation requirement of the Orono Wetland Ordinance.

Wildflower Mix: $10.35 per oz., $155.25 per lb.
2% Yarrow, 3%Fragrant giant hyssop, S%Leadplant, 1% Common milkweed, 2%Azure aster, 4%Smooth

the wetland ordinance it is recommended that the City take an escrow amount of $800.00. The escrow
must be valid for up to two years and will be used by the City to replace any vegetation if dies or is not
successful. A successful planting will have at least one plant from the seed mix per each foot of the site.

Re: Proposed Planting Plan for Buffer
Remarks:
I have reviewed the submitted planting plan for the buffer area for compliance with the City Wetland Ordinance.
As shown a portion of the property has a natural buffer of trees and shrubs that can be preserved and will
accomplish the vegetation requirements of the buffer ordinance. The existing turf area requires planting and/or
seeding. Due to the applicant's consultant including plant names with genus only and not the full common or
scientific name I am not able to recommend approval as submitted. Many of the plants listed are not or may not
(depending on full name) be native to Minnesota. I discussed this with Chad Holland of Holland Bobcat Service
and he requested that I provide him with list of species from Prairie Restoration, Inc. which is a supplier that he
utilizes that would be acceptable. Included as the second page of this memo is a seed mix with species that
are acceptable. This was pulled off Prairie Restoration, Inc. website and could be purchased as a seed mix or
selected species could be purchased as live plants. If the plan involves planting as currently proposed a mix of
native grasses and wildflowers should be utilized. If planted the density should be at least 1 plant per every 4
feet using triangular spacing to insure adequate coverage of native vegetation. The planting plan should be
resubmitted for review and approval. The scale of the drawing should be provided to allow it to be reviewed.
We will need to discuss what the City will require as far as a recording of the buffer area so if the property ever
changes hands the new property owner will be aware that the buffer must be preserved.

receipt and s�ciency of which is hereby acknowledged, hereby create and grant unto the City a
permanent flowage and conservation easement for the pur�ses set forth in this instrument, over,
under, and across the wetland buffer as described in the legal description and site plan attached
hereto as Exhibit A(the "easement premises").
The Grantor(s)on behalf of themselves,their heirs,successors and assigns,hereby covenant
and agree as follows:
1. That the following are prohibited in perpetuity within the wetland buffer:
A. Constructing, installing, or mainta.ining anything made by man, including
but not limited to buildings, structures, walkways, fences, fireplaces,
clothes line poles,playground equipment,roads or hardcover of any nature
whatsoever, except: 1) feeders, bird houses, and other devices intended to
foster wildlife; 2) docks or boardwalks when allowed by City ordinance
and under a valid City permit; 3) retaining wa11s when allowed by City
ordinance and under a valid City permit.
B. Cutting, mowing or removing shrubs or other vegetation, and cutting ar
removing trees greater than four inches in diameter, except for tree disease
control by or as directed by a governmental agency. Grantor(s) may
remove brush, diseased or dead trees of any size,and noxious weeds.
C. Excavation or filling or material alteration of grade, including changes to
the size, depth or contour of the wetland; dredging, mining or removal of
earth, loam,peat,gravel, soil or any other natural material.

D. The deposit of waste,yard waste, or debris.

F. Application of fertilizers,whether natural or chemical.
G. Application of chemicals for the destruction or retardation of vegetation.
H. The application of herbicides, pesticides, and insecticides, except for
noxious weed control by Qr as directed by a govern�nental agency.
I. Outside storage of any kind.
J. Activity detrimental to the preservation of the scenic beauty, vegetation,
and wildlife.
3. Establishment and Maintenance of Wetland Buffer. The wetland buffer, measuring
fifty(50)feet in width at all points surrounding the wetland and as shovv�in E�6it
A, shall be established and impmved to become an "acceptable buffer area" as
described within City Ordinances, and shall thereafter be maintained by Grantor(s)
in perpetuity free from mowirig or other vegetative d.isturbance, fertilizer
application, yard or other waste disposal, the placement of structures or any other
alteration that impedes the function of the buffer in protecting the quality of water in
the wetland or buffering flows into the wetland.
4. Grantor(s) for themselves, their heirs, successors and assigns, further grant the City
the affirmative right, but not the obligation to do the following on the easement
premises:
A. Preserve, improve, and enhance the slope, trees, vegetation, and natural
habitat by altering, clearing, and removing trees or other vegetation, by
changing the contour of the land, and by planting trees or other vegetation.
B. Enter upon the easement premises at any time to enforce compliance with
the terms of this instrument
5. Grantor(s) reserve for themselves and for their heirs, successors and assigns and
their invitees, the right to enter upon the easement premises and to do and perform
on the easement premises such acts as are not inconsistent with the easement
rights granted to the City herein. Such uses shall be deemed to include,but not be
limited to planting of trees, flowers, and other vegetation consistent with a
conservation easeinent; wa�king along trails and paths; bird watchi�g; the study of
nature; and all other acts of a similar nature or purpose.
6. Grantor(s) hereby grant, gift, quit claim and convey to the city, a perpetual
flowage easement and right and privilege to trespass with water over and upon
any or all of the Easement Premises.
7. Grantor(s) herein do hereby remiss, release, acquit and forever discharge, forever,
the City and any and all of its officers and employees of and from any and all
claims, demand or causes of action of any kind or nature whatsoever which may
arise or accrue by virtue of any flowage or trespass with water within terms of
these agreements.
8. Grantor(s)do not intend that the public should have any interest in the above land
by virtue of this indenture or otherwise, except as hereinabove set forth.
IN WITNESS WHEREOF, the parties hereto have set their hands effective as of the
day and year set forth above.
