Application Summary
Dave Mariani (3020 6`h Avenue) requested Council support to expand the MUSA boundary to
incorporate his property on January 1 l�'. The Council directed Staffto review the implications
with the Met Council and report back.
Background
The 2030 Comprehensive Plan provides for the addition of new housing within an expanded
MUSA boundary at a rate of 3.29 units per acre. The Met Council will not approve any Plan
amendment that results in an overall density ratio below 3 units an acre.
On January 27`"staff inet with Met Council representatives to understand the implications of a
number of proposed developments;the results of that discussion are summarized in the attached
spreadsheet. It appears that expanding the MUSA boundary to accommodate Mariani could be
accommodated within our current limits. Assuming development of the James property at the
density supported by the Council, our density would drop below 3 units/acre; additional density
will need to be identified.
Further,the Comprehensive Plan guides the Mariani property for Park, Recreational and Open
Space,to accommodate future expansion of Three Rivers Park District's Baker Park. The
expansion of urban services may be considered inconsistent with the Plan as it implies long term
support for residential land use. We anticipate close scrutiny by both the Met Council and the
Park District.
Planning Staff Recommendation
Staff does not recommend the MUSA be expanded as a Type III system is a viable option and
extension of the urban service does not appear consistent with the long term plan for the area.

Item Description: Mariani Request to Expand MLTSA boundary
Application Summary
The property owner at 3020 6t"Avenue requests Council support to expand the MUSA boundary
to incorporate his property. The Property owner also requests the Council waive the connection
fee, estimated at$14,110.
Background
The property was the subject of a lot line rearrangement in June of 2015. As part of that process,
the developer submitted a survey and report with two septic sites for each lot, prepared by a
certified septic designer, Ende. As is practice, our inspector received and reviewed the report,
but did not conduct a site inspection. A site inspection is not commonly completed at this stage.
Shortly thereafter,Mr. Mariani purchased the property. He applied for a permit to remodel the
existing home. As part of that permit, a site inspection was conducted and it was noted that the
sites identified by Ende were not viable because they did not meet separation requirements
(water table)and soil conditions (previously disturbed fill soils)that would allow a Type I
system which is required by City Ordinance.
A type III system could be installed, consistent with city and state requirements. The differences
between a Type I and Type III systems are illustrated in the attachment. Mr. Mariani would
prefer a Type I system, in part due to its consistent track record and maintenance needs.
Since a Type I system is not available, Mr.Mariani is requesting a connection to the sanitary
sewer that serves the properties on the south side of Sixth Avenue, approximately 325 feet south.
This connection will require an expansion of the MUSA area and a modification of the
Comprehensive Plan.
Mr. Mariani is also requesting waiver of the connection fee. This area is served by the 2006
Jamestown Road project, and parcels were charged a connection charge plus SAC and permit
fees,totaling$16,645. Properties in the area were also responsible for the costs for the service
line from the street to the house.
The intent behind this request is to gauge Council desire to expand the MUSA prior to
completing the full Comprehensive Plan Amendment application. The expansion of the MUSA
into an area developed at .5 unit per acre will decrease the overall density of the city's urban
area, impacting the city ability to make other amendments to the Comprehensive Plan in the
future. Given the density reduction supported by the Council for the James property and other
development activity,the density of the city's urban area would drop below 3 units per acre, a
key analytic employed by the Met Council. Full analysis will be complete if a formal application
is made.
Planning Staff Recommendation
Staff does not recommend the MUSA be expanded as a Type III system is a viable option.
Should the Council support the expansion, Staff does not recommend a waiver of the connection
charges.

This is a harcishEp request to approve the connection of the property located at 3020 8th AvQ N.in Qrono
to city sewer, and also to waive the city oonnection fee for the project,due to the city's approval of a non-
compliant septic plan.What follows is justification for the request.
We purchased property ID numbers 2811823320002(3020 8th Ave N)and 281182332Q001 (1150
Homestead Trail)in June of 2015. As a condition of closing and subdiv[sioNlot line rearrangemerrt of the
properties,the Seller provided to the City of Qrono septic plans for two Type 1 septic systems sites per
property as stated in city code,dravm up by Ende Septic Services. The aty elected not to inspect the
sewer s[tes attested to by Ende Septic servioes at that time.The City of Orono coilected leg�anc!
engineering c�onsultancy fees and a lot subdivislon fee betore approving the proposaE. We purchased the
properties based upon the city staff and City CounciPs assurances that the property we were purchasing
met an city cbdes(rtcluding two Type 1 septic sites. Atter taking passession of tl�properties,we applied
for a permit to have the Type 1 septic system instailed at property ID 2811823320002(3020 6th Ave
N.) WEtien the City of Orono inspectecf the site theyfound it not suit�ble for a Type 1 septic system and
rejected the application. We oonducted addi�or�al site testing and learned that there is not a viable sike
for a Type 1 septic system anywhere on the 2.8 acres. Additlonally,the septic design for the othe�new
parceE at 1150 Hom�tead Trail was designed under an Excel power line with no easement from Excel
Energy.
Over the past fve months.we have worked with the City Building Official, Roger Pie�tso, on options for
replacing the non-0ompliant septic system. Without assuming undue risk,c�st,and longevity issues of an
inferio�system,the best way to closely repEicate a Type 1 system would be to aonnect fio city
sewer. Michael Saffron,Orono Senior Planner, advlsed that there is room for our property in Met
CounciUMUSA to be hooked up to ciry sswer. We would like to pursue this optian. How�ever,we are
asking for the city to waive theK connecfion fee due to the city personnel and city council approval of an
invalid sep8c plan,and our relianoe on their assurances. Had the plan not been approved, the property
sale w�ould not have gone through.We are willing to pay the oourtty fee of$2,750 and the$20,OQ0 to
oonnect the sewer pipe to the house.
We are very motivated to fix the non-compliant septic system before the ground freezes. We have
aiready had a sewer backup. Please call us with any questions.We await your review and timdy

Comparison of Type I vs Type III sepfic systems

Type I System Type III System
1.Type I systems have specific design requirements 1.Type III systems deviate from this known criteria so
that have been used and tested for many years so the it's performance is not as well known. Measures are
longevity and performance are consistent. usually taken to compensate for the departure from
this criteria such as replacing soils with sand and or
sizing the Type III system the same size as a Type I.
2. A Type I system requires a minimum separation of 2. A Type III system is not required to have a 12" sep-
