within the Minnehaha Creek subwratershed

• dredging within the beds, banks or shores of any protected water or wetland

Mr. Ellingson
I apologize if we have caused you frustration. The March 22"d letter was a preemptive effort to obtain more accurate
information prior to our City Engineer's review as each subsequent review by our City Engineer could result in a review
cost passed through to you. In short Christine's letter was an attempt to save you monex.
However as you will see by the attached letter and annotated email there were items left unaddressed by your submitted
survey. The omitted information must be submitted on the survey and the erroneous information should be corrected or
clarified. Upon receipt of revised and corrected survey information we will continue our review of your permit for the
addition.

the approach your taking to reviewing this permit is very time consuming and costly. You had similar
questions you posed several weeks ago and I had the surveyor update the survey accordingly. Now
someone else from city is posing a whole new set of questions which will take more time and the
surveyor will charge more $$$ to update the survey yet again.

On March 15, 2013 the City received a building permit application for an addition to the house at 2905 Sixth
Avenue North. Your application is incomplete.
The following items must be submitted or revised in order for your application to be considered complete and for
the plan review to continue:
1. Certificate of Survey. A survey dated February 20, 2013 and building plans dated 03-13-13 were
submitted with the application. Please have the survey updated to include the following:
� a. Retaining Walls. TMe proposed retaining wall shown on the building plans must be shown on
the survey, including top and bottom height indicated.
b. Grading. Existing grades are shown, the proposed final grade must also be shown on the
survey.
c. E�osion Control. Please show the location of the silt fence on the survey.
2. Hardcover Calculations. The property is located in Tier 3 of the Stormwater Quality Overlay District
where hardcover is permitted up to 35% of the entire lot area. The surveyor must prepare the hardcover
calculations. Attached are the hardcover calculation worksheets and hardcover information packet.
3. Well. The well is shown on the survey, but it is unclear the way it is shown if it meets the three foot
setback from all structures, including overhangs. Please clarify.
4. Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require
submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee
reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally
this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and
stormwater. The required escrow amount for this project is $2,500. The escrow agreement is enclosed.
The property owner must sign the escrow agreement and submit a check for$2,500.

AGREEMENT made this�`day of vt, , 2013, by and between the CiTY OF ORONO,
a Minnesota municipaf corporation("City")and Jorg n &Yumiko Ellingson("Ownersu).
Recitals �
1. A building permit application has been filed for an addition Iocated at 2905 Si7cth Avenue North '
the{"Subject Property"), legally described as Lot 2, Block 2, Garden Grove, Hennepin County Minnesota.
2. Owners request the City to review this application. '
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursernent to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cast in administering the escrow account.
2. PURpOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incu�red (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee '
reimbursemen#to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with bullding permit #2013-00172 if compliance with the
apprbved building permit is not ac�omplished.
3. MONTHLY BILLING. As the City receives consultant bills fa�incurred costs, the City will in turn
send a bi[I to the Owners. Owners shall be responsibfe far payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESGROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay afl expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAfD CHARGES. lf the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow,the City shall have the right to certify the unpaid balance to the
subj erty o Minn. Stat. §§415.01 and 366.012.

On March 12, 2014 we received an as-built survey for your permit. The addition to the home was inspected and
approved on February 14,2014. City Engineer,Jesse Struve visited the property on April 25,2014 and found the site
with areas of exposed soil. Once grass is established, please contact me to schedule anothe�site visit in order to close
out your escrow account.
Also, our engineer noted two piles of dimensional lumber on the property,one near the home and the other on the
south side of the property near the detached garage. Please be advised exterior storage of construction materials is not
allowed long-term. We assume this outdoor storage is a result of the addition project ar�I�will be removed from the
property before we receive a call for the site visit re-inspection.
The escrow money will be refunded once grass has been established and the engineer approves of the as-built grading
shown on the survey.
