RE: Home Occupation Licease AppGcation
Dear Mr. and Ms. Timm:
The City of Orono is aware of a home occupation being run from your property located at 2885 Sixth
Avenue North. The operation of a home occupation requires a license to be issued from the City
Council. Several months ago a home occupation license application was hand delivered to you.As
of the date of this letter we have not received your application.
Home occupations are defined in Section 10.02 of the Municipal Code. This section states:
"Any gainful occupation meeting ail of the following requirements when engaged in oniy by
persons residing in their dwelling, when that occupation is conducted within the principal
structure only,when evidence of the occupation is not visible from the street.No signs other
than those permitted in"R"Districts are present,no excessive stock in trade is stored on the
premises,over the counter retail sales aze not involved,and entrance to the home occupation
is gained from within the structure. A professional person may use his residence for
consultation,emergency treatment or performance of religious rites but not for the general
practice of his profession when such general practice will involve the need for more than
three off-street parking spaces for the occupant and visitors."
Additionally, the Orono Planning Commission is considering adopting a new Home Occupation
Ordinance. Under the existing and pmposed regulations relating to home occupations the use of
your property for a home occupation does require a license.
Please fill out the enclosed application form and retum it to our office prior to January 28, 2002.
Shortly after your application is received your request will be considered by the City Council.

Dear Mr. Timm:
This letter is regarding the dump truck business that is running at your property. The City
Zoning Department has deternuned that your business falls into a level 2 home occupation of
City Code 10.63. This classification requires you to get and annual licence issued by the City
Council. You must complete the attached Home Occupation application and return it to our
office. Shortly after your application is received,your request will be considered by the City
Council. In order to be considered for the license you will need to follow all requirements for a
level2 home occupation.

Dear City of Orono:
We are writing this letter as requested to inform the city of Orono that there is no
home occupation operated at our a�idres�: ?QQS �'nur.ry Rnad 6, Orone, MI�T.
None of the home occupation regulations apply to us. According to the
regulations listed in section 10.63, subd. 3, we are not doing the following:
• We have no employees or associates working on the premise
• We have no customers
• We have no hours of operation
• We have no shipments or deliveries
• We do not sell or store products
• We have no signage
• We have done no alterations or modifications to change the appearance of our
dwelling unit or accessory structures
• We have no home occupation income

prior to the purchase in the spring of 2000. The man in charge told us "it was ok to park
one such vehicle on our property, as long as we were the owner or operator". After we
were given permission, we proceeded to buy the dump truck.
We were contacted last fall regarding a home occupation. We again called the city
office and spoke with Matt, and he again assured us "that it was permissible to park the
truck on our property". We were sent a copy of the ordinances, including 10.61 with
section G highlighted. In section G, it states, "one such vehicle may be parked at the
residence of the owner or operator of said vehicle".
I, Chuck Timm, work as owner/operator of the dump truck. I work for a broker,
and earn a paycheck from that broker.
We hope this letter will clarify any remaining questions to the city of Orono.
