Rietow, AIA 1123 IDS Center Minneapolis, MN 55402 RE: Trinity Lutheran Church, 2060 Sixth Avenue In response to your request during our meeting on February 10`}', I have listed several City Code sections regarding parking, conditional use permits, and setbacks on the enclosed page for your information. A searchable version of Orono's City code may also be found online at: www.municode.com. The proposed additions and parking lot expansion of the Trinity Lutheran Church require a conditional use permit amendment. Orono City Code does not specifically address institutional uses within Residential districts other than to specify them as conditional uses. Therefore, many of the B-1 District requirements will be referenced in the review of this conditional use. As we discussed in our meeting, City sewer is available for this property and as part of the conditional use review Trinity Lutheran Church would be encouraged to connect. Please contact Greg Gappa, at 952-249- 4600 for more information on connecting to City sewer. Regarding setbacks, all open parking lot areas are to be setback at least 10' from the side and rear property lines. In addition, all church buildings shall meet 50' setbacks from any lot line. Several aspects of the site will be reviewed at the time of the conditional use permit review. Some of those specific aspects are as follows: • signage, • building height, • building materials, • parking lot standards, • lighting, • and landscaping. I would recommend contacting the Minnehaha Creek Watershed District(MCWD) to determine whether changes in the structure and parking lot would require their review far puiposes of starm water evaluation and approval. Within any RR-1B one family rural residential district, no structure or land shall be used for the following uses without a conditional use permit: , (3) Churches, including those related structures located on the same site which are an integral part of the church proper, and convents or homes for persons related to a religious function on the same site, provided no building other than a residence shall be located within SO feet of any lot line of an abuning lot in an R district. Sec. 78-IS16.Required off-streetparking. Where the principal use of the structure served is as listed, the minimum parking facilities(open or enclosed)shall be as shown. (S) Churches, auditoriums, undertaking establishments, at least one for each four seats based on the design capacity of the main assembly hall. Building height means the vertical distance between the highest adjoining ground level at the building or ten feet above the lowest ground level, whichever is lower, and the top of the cornice of a flat roof, or the deck line of a mansard roof, or the uppermost point on a round or other arch-rype roof, or the average height of the highest gable of a pitched or hipped roof. Topographic changes which elevate the adjoining _ ground level above the existing terrain shall not be considered in determining building height. Sec. 78-1491 (g) Size of parking spaces. Each parking space shall be not less than nine feet wide and 20 feet long, and each space shall be served adequately by access drives. For purposes of calculating parking space reguirements, one parking space for one vehicle shall equal 300 square feet of storage and maneuvering area, including access drives. Sec. 78-IS15.Design and maintenance of parking areas. (a) Access. Parking areas shall be designed so as to provide an adequate means of access to a public alley or street. This driveway access shall not exceed 30 feet in width at the public walk centerline and shall be so located as to cause the least interference with traffic movement.All off-street parking spaces shall have access off driveways and not directly off a public street. (b) Fractional spaces. When the determining of the number of required off-street parking spaces results in a fraction, each fraction of one-half or more shall constitute another space. (c) Signs. Signs located in any parking area necessary for orderly operation of traffic movement shall be in dddition to accessory signs otherwise permitted. (d) Surfacing.All of the area intended to be utilized for parking space and driveways for four or more vehicles shall be surfaced with material to control dust and drainage. (e) Lighting. If lighting is provided, it shall be accomplished in such a manner as to have no direct source of light visible from the public right-of-way or adjacent land. (fi Curbing.All open off-street parking areas designed to have head-in parking along any lot line shall provide a tire bumper or curb of adequate height and properly located to ensure that no part of any car will project beyond the required setbacks. (Code 1984, §10.61(9)) Sec. 78-420.Area, height, lot width and yard requirements. (a) Height. No structure or building in any RR-I B district shall exceed 2 12 stories or 30 feet in height except as provided in section 78-1366. (b) Lots. Rietow, AIA CITY pN pRO O N DATE: February 10, 2004 SUBJECT: Trinity Lutheran Church Commission No. 0411 On Tuesday, February 10, 2004, I met with Melanie Curtis, the City Planner for Orono to review the proposed expansion program. It was confirmed that the church will be required to obtain a new Conditional Use Permit; attached to this memorandum is a copy of the application instructions which were revised January 1, 2004. We also discussed available utilities to the site, and attached is a letter confirming the availability of sanitary sewer and other information. It was confirmed that "City water" is not avail�ble to the site. Ms. Curtis agreed to do some research on the site regarding easements and the setback from the north property line for parking. cc: Melanie Curtis Ken Jenson
