PER MUNICIPAL ZONING CODE
SECTION 78-966
FILE NO. 04-3034
VVHEREAS, Robert P. Mack and Ardell Mack, husband and wife
(hereinafter "the applicants") are the owners of the property located at 1580 Sixth
Avenue North �vithin the City of Orono (hereinafter the "City") and legally described as
follows:
Tract D, R.L.S.No. 1418, Herulepin County, Minnesota
(hereinafter the "property"); and
WHEREAS, tlie applica�lts have inade applicatio�z to the City of Orono
for a conditional use permit per Orono Municipal 7oning Code Section 78-966
Subdivision A to allow for the construction of a berm within the property along Sixth
Avenue North.
NOW, THEItEFORE BE IT RESOLVED by the City Council of
Orono, Miiuzesota:
FINDINGS
1. This application was reviewed as Zoning File#04-3Q34.
2, The propei-ty is located in the RR-1B, One Family Rural Residential
Zoning District which requires a minimum lot area of 2 Acres and a
minimum lot width of 200'.
3. The Planning Commission reviewed this application at a public hearings
held on July 19, and August 16, 2004 and recommended approval of the
conditional use permit based on the following findings:
a. The applicants will meet all of the standards and conditions of City
Code Section 78-1286 Subdivision E.

b. The applicants will comply with the recommendations of the City
Ei�gineer which are as follows:
i. Metal fence posts shall be required for all silt fence installation
due to the potential of winter construction issues; and
ii. Construction entrance detail plate is required. Included must
be geotextile liner, size of material accepted and ininimum
dimensions. 50' loi��by 16' width recommended; and
iii. Indicate locations of blanlcet on plan, all 3:1 slopes or steeper;
and
iv. Indicate limits of clearing aiid grading, as well as any land
disturbance on plan; and
v. Silt fence should be indicated around septic locations; and
vi. In the SE corner of lot where concentrated drainage may be an
issue, consider adding a second wrapped row of silt fence to
control concentrated flow issues; and
vii. In NW corner of lot, the end of the silt fence shall be wrapped
towards the proposed hoine to contain runoff conditions, rather
than abruptly ending the silt fence line; and
viii. Install silt fence on the north side of the driveway to control
runoff situations. There is currently no storage voluine for
sediment laden water to store; and
ix. Note on plan locations for stockpiles and temporary cont�ol
measures for stockpiles during construction; and
x. Under Erosion Control Note 4, change "send"to "seed"; and
xi. Under Erosion Control Note 3, indicate when removal of
triangular silt dikes should be completed; and

xii. Supply the City with the appropriate individual for a 24 hour
emergency contact for erosion control related issues; and
xiii. When NPDES pennit coverage is obtained, provide the City
with NPDES certificate of coverage; and
xiv. Indicate who will be completing weekly ESC ins�ection log,
and provide city with weekly copies of such log.
4. The City Council has considered this application including the findings
and reconmzendation of the Plaiuiing Commission, reports by City staff,
conunents by the applicants and the public, and the effect of the proposed
variance on the healtl�, safety and welfare of the community.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants a conditional use permit per Orono Municipal Zoning Code Section 78-966 to
allow a benn to be constructed subject to the following conditions:
1. Council approval is based on the site and grading plaii submitted by the applica�zts
and annotated by City staff, attached to this Resolution as Exhibit A. Any
amendments to the site plan which are not in conformity with City codes will
require further Planni.ng Commission and City Council review.
2. The applicants shall comply with the recommendations of the City Engineer.
3. The applicants shall coinply with Municipal Zoning Code Section 78-1286
Subdivision E, standards for conditional uses.
4. Authorities granted by this resolution run with the property not with the
applicants, but are pernlisssve only and must be exercised by obtaining a land
alteration permit from the City prior to commencing site work.
5. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.

6. The undersigned applicants have read, understood and hereby agree to the teinzs
of this resolution and on behalf of the applicants and the applicants' heirs,
successors and assigns, hereby agree to the recording of this resolution in the
chain of title of the property.
Adopted by the Orono City Council on the 23�d day of Auoust 2004.
