Background
In 1979 the City approved a subdivision of property at 1405 Sixth Avenue North to create two
large buildable lots - one lakeshore lot and one abutting County Road 6. A requirement of that
subdivision approval was granting to the City a Flowage and Conservation Easement
encompassing wetlands within the peninsula extending into Long Lake on the southerly parcel,
and wetlands/creek located in the northerly parcel. That easement was granted and recorded as
Document #1378053 (see Exhibit B). The portion of the easement in question is depicted in
Exhibit C.
The area of the easement is a low peninsula extending into Long Lake at the base of a bluff. The
residence on the property is above the top of the bluff, and the dock serving the property extends
southeasterly from the shore at the base of the bluff.
Mr. Crotteau is contemplating a sale of a portion of his peninsula property to the adjacent owner
directly to the east. The portion to be sold includes the shoreline from which Crotteau's dock
currently extends. He would like to relocate his dock to the west side of the peninsula, which
means he would have to construct a lengthy dock or walkway through the wetland.
Until 2005 this would have been prohibited via the Zoning Code as well as via the existing
Conservation Easement which states in Paragraph lA: "No structure shall be constructed,
erected or placed upon, above, or beneath the Land including without limitation, fences,
fireplaces, steps, docks, piers, hard-cover or roads of any nature whatsoever, or any other
structure or improvement inconsistent with the natural state of the Land. " However, in 2005 the
City's wetland ordinances were completely updated. The City's current ordinance since 2005
states that "Docks which provide reasonable access to the lakeshore and do not exceed 8 feet in
width" are now a permitted use in the Wetland Overlay District. Mr. Crotteau is now seeking

approval to amend the Conservation Easement to allow construction of a dock through the
wetland within the parameters allowed by current Zoning Code.
Staff Recommendation
The 2005 Code revisions do not nullify the Easement provisions that are more restrictive than the
current Code. Council action is required to approve an amendment of the Easement conditions
to allow construction of a dock through the wetland. Based on the current code provisions this
would seem reasonable, as long as all Code requirements and limitations for that construction are
adhered to. Note that based on the topographic map attached, access to the lakeshore at either
the existing or proposed location appears to require crossing near or over some portion of
wetland in order to remain within the property boundaries.
COUNCIL ACTION REQUESTED
Provide direction to staff and Mr. Crotteau as to whether the Council would approve an
amendment of the Easement to allow construction of a dock to the southwest. If so, the property
owner should have his attorney draft the appropriate amendment for staff and City Attorney
review and Council action.

length of the dock in this process.

application process with the MCWD.

Sec. 78-1606. - Permitted uses.
(a) Within the wetland overlay districts no land may be used except for one or more of the
following uses:
��) Native wetland vegetation, provided that no change is made to the ground
elevation;
�2) Wildlife and nature preserves;
�3) Overhead utility lines and poles that are less than two feet in diameter;
� �4) Docks which provide reasonable access to the lakeshore and do not exceed -�-
eight feet in width;
�5) Public and private flood control structures, ponding and drainage facilities and
associated accessory appurtenances as approved by the city; or
�6) Environmental monitoring or control facilities, including those related to water
quality and wildlife regulation.
�b) Within wetland buffer areas no land may be used except for one or more of the
following uses:
��) Native vegetation, provided that no change is made to the ground elevation;
(2) Wildlife and nature preserves;
�3) Boardwalks, docks or other reasonable access to the wetland not exceeding
eight feet in width, poles that are less than two feet in diameter to be used for
boardwalks and bridges;
(4) Public and private flood control structures, ponding and drainage facilities and
associated accessory appurtenances as approved by the city;
�5) Environmental monitoring or control facilities, including those related to water
quality and wildlife regulation;
�6) Overhead utility poles and lines that are less then two feet in diameter, under-
ground utility lines and distribution equipment, light poles, traffic signals, traffic
regulatory signs, mailboxes and other equipment that provides an essential
public service;
��) Retaining walls if the city determines that the retaining wall will protect the
' wetland from conditions of erosion, when approved as part of a wetland permit
application.

(a) Within the wetland overlay districts and the wetland buffer areas no land may be used
for the foilowing except by conditional use permit and except in conformance with the
standards specified in section 78-1608 of this article:
��) Private and public recreational uses, including golf courses, impervious trails,
picnic grounds and boat ramps;
�2) Public utilities, including necessary structures;
�3) Other non-structural facilities similar to those permitted by this section which also
meet the intent of this section, as determined by the city; or
�4) Public structures associated with recreational uses permitted by this section or
by section 78-1606 of this section that are designed in an environmentally
sensitive manner and will withstand periodic flooding, except for structures
designed or used for habitation or the storage of equipment.
�5) Unpaved hiking, skiing and horseback riding trails which comply with WCA
standards.
�b) No conditional use permit will be granted unless its approval will not adversely impact
wetlands, the wetland buffer area, and surrounding properties, the intent of this article
or the goals and policies of the community management plan. If applicable, granting of
a conditional use permit will be conditioned upon approval of the request by all other
appropriate regulatory governmental agencies, including but not limited to the
Minnehaha Creek Watershed District (MCWD), the Lake Minnetonka Conservation
District (LMCD), or the Minnesota Department of Natural Resources.
