WHEREAS, Spring Hill Land Company, a limited partnership, (hereinafter "the applicant" ) is the owner of property at 725 Sixth Avenue North located within the City of Orono (hereinafter "City") and legally described as follows: � Refer to Exhibit A, attached (hereinafter "the property), and WHEREAS, the applicant has applied to the City of Orono for a Conditional Use Permit to permit Woodridge Church to use portions of the existing conference center facility per Municipal Zoning Cocie Section 10.29 Subdivision 1. NOW, THBREFORE, B$ IT RBSOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #1637. 2. The property is located in the RR-1B-1, Rural Residential Sub-district requiring a minimum of 2 acres in area. The total property consists of 20+ acres . 3. Woodridge Church shall lease the facility for a specified period of time. The church use sha 11 be a temporary use of the facility. 4. The congregation is proposed at 250 members. 5. The Orono Planning Commission reviewed this application as proposed and recommended approval of the conditional use permit based upon the following findings: a) The proposed church use is permitted within the RR-1B-1 Zoning District with a conditional use permit. ' . .�.. . � , : . . � � O � O ,� �� _, �, C ITY of ORONO �� `� ,,y G�' RESOLUTION OF THE CITY COUNCIL ���t'EggO�'� NO. 2 9 5 6 b) A11 performance standards are met by the proposed church use as follows: 1) All structures meet the required 50' setback from adjacent residential lot lines. 2) There is adequate parking to support the 250 , member congregation of the church. c ) The church is a non-profit organization and is compatible with the intent and objectives of the RR-1B-1 Zoning District conference center use. d) The use wi 11 require no permanent physica 1 changes to the exterior or interior of the buildings. 6. The City Council finds that granting a conditional use permit to allow church use of the existing conference center facility wil 1 not be detrimental to the hea lth, safety or general welfare of the public, would not adversely affect light, air nor pose a fire hazard or other danger to ne�ighboring properties, nor will it depreciate surrounding property values ancl that the proposed leve 1 of use of the property wi 11 be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. 7. The Cfty Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. , CONCLDSIONS, ORDBR AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a Conditional Use Permit per Municipal Zoning Code Section 10.29, Subdivision 1 to permit the applicant, Spring Hill Land Company, to lease portions of the conference center to Woodridge Church. subject to the fol lowing conditions: Page 2 of 5 � � � °� 0 0 � � C ITY of ORONO � . �;,, F , '� � G�' RESOLUTION OF THE CITY COUNCIL ���ESii��� NO. 2 9 5 6 1. Applicant is placed on notice that at any time should the church's special functions or regular attendance exceed 300 that applicant must obtain a large assembly permit from the City of Orono. 2. Applicant shall submit an annual� log on March lst of each , year to the City of Orono listing various functions of the church and/or other organizations associated with the church use of these facilities. 3. Applicant shall apply for the legal combination of PIN 25- 118-23-33-OOOl and PIN 25-118-23-33-0002, from the City of Orono prior to the commencement of church use of the facility. 4. Authorities granted by this resolution run with the property not with the applicant, but are permissive only and must be exercised within one year of the date of Council approval, or this conditional use permit will expire on that date (April 22, 1992 ) . 5. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the Zoning Code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of Spring Hill Land Company, its successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
