The properties you have inquired about include: 1200/1230/1290 Orono Oaks Drive; 1180 Lyman Avenue; 365 Old Crystal Bay Road North; and 375/380 Silver Meadow Drive. All of the above properties are located in the RR-1B Rural Residential Zoning District requiring a minimum lot area of 2.0 dry buildable acres and a minimum lot width of 200'. Required property setbacks for principal structures are 50' front and rear, 30' sides, 50' side street. None of the above listed properties are provided with municipal sanitary sewer; they are all served by septic systems. Each non-served property is required to have a conforming septic system and an alternate site available for future use. We have not been provided with septic testing reports or system designs for each of the lots noted above,but we are aware that some testing has been done. We have not been provided with"before"and"after"lot surveys or lot area infortnation to confirm the exact final lot boundaries after the takings. Therefore,the information provided below for each specific property is primarily from an analysis done by City staff in 1998 based on MnDOT drawings at that time. 1200 Orono Oaks Drive (Developed residential lot) Legal Description: Lot 6, Block 1, Orono Oaks - Gross area(no wetlands): 3.4 acres -Approximate area in r-o-w: 0.95 acres -Net dry area after taking: 2.5 acres+ -House setbacks not affected. -Existing system is nonconforming and must be replaced by 2010. -Impact of taking on existing system is believed to be minimal or none but this needs to be verified to us. If sites are available within the area of property remaining after the taking,then this property could continue as a conforming building site. 1230 Orono Oaks Drive (Developed residential lot) Legal Description: Lot 5,Block 1, Orono Oaks - Gross area incl. wetlands: 3.05 acres -Approximate area in r-o-w: 1.4 acres -Net area excl. wetlands: 2.85 acres -Net dry buildable area after taking: 1.65 acres+ (lot area becomes substandard) -Northerly corner of house will end up 25'+ from rear lot line(50'required). -Taking will eliminate part or all of existing drainfield(which is nonconforming and must be replaced by 2010) and previously tested alternate site. - Existence of additional sites within Lot 5 is questionable due to topography. It is the City's understanding that MnDOT plans to either combine vacant Lot 4 with Lot 5, or combine a portion of Lot 4 with Lot 5 and the remainder with Lot 3. We have not been provided with a survey showing the proposed new lot lines.It is also the City's understanding that MnDOT is having new septic system sites tested for this property but we have not been provided with the results. Lot 5 after the acquisition will be nonconforming as to lot area and the residence on it will be nonconforming as to location. Assuming that additional dry buildable acreage is added to result in at least 2.0 dry buildable acres via combination with all or a portion of Lot 4,Lot 5 would then be considered as conforming in area but still with a house in a nonconforming location. 1290 Orono Oaks Drive (Developed residential lot) Legal Description: Lot 3,Block 1, Orono Oaks - Gross area incl. wetland: 3.5 acres -Approximate area in r-o-w: 1.9 acres -Net area excl.wetland: 2.7 acres -Net dry area after taking: 1.5 acres (lot area becomes substandard) -Rear corner of house ends up 20' from rear lot line (50'required). - Existing and identified future septic sites not affected. Post-acquisition,this propertywould be considered as anon-conforming developed building site with a house in a nonconforming location. Lot 3 could potentially be combined with a portion of vacant Lot 4 to make it conforming in lot area. Steve Evans August 28, 2003 Page 3 1180 Lyman Avenue (Developed residential lot) Legal description: (metes and bounds) - Gross area(no wetlands on site): 1.48 acres (Area variance granted in1987) - Approximate area in r-o-w: 0.36 acres -Net dry area after taking: 1.12 acres+ (becomes more substandard) - House will end up 40' from rear lot line, 50'required. - Taking will eliminate existing trench drainfield. - Taking will eliminate both previously identified alternate drainfield sites. -Very questionable whether additional septic sites exist. Septic testing is needed to confirm the existence of suitable primary and alternate drainfield sites. If sites can be confirmed, this property would be considered as a nonconfomung developed building site,with an existing house in a nonconforming location. If septic sites do not exist, choices are 1)MnDOT extend municipal sewer to the property, or 2)remove house, site becomes unbuildable, attach to adjoining lot(s) as additional yard area. 380 Silver Meadow Drive (Developed residential lot) Legal Description: Lot 4,Block 1, Meyer Dairy Addition - Gross area(no wetlands): 2.4 acres - Approximate area in r-o-w: 0.7 acres -Net dry area after taking: 1.7 acres+ (lot area becomes substandard) - Existing house setbacks may not impacted; additional information needed to determine if required north(rear) setback of 50'will be maintained. - Existing septic system not impacted. - Taking will eliminate part or all of tested alternate site Testing is needed to confirm existence of one alternate site. This property will be considered as a nonconforming developed residential lot. Unknown whether house location becomes nonconforming. 375 Silver Meadow Drive (Developed residential lot) Legal Description: Lot 3, Block 1, Meyer Dairy Addition - Gross area(no wetlands): 2.1 acres -Approximate area in r-o-w: 0.9 acres -Net dry area after taking: 1.2 acres+ (substandard) - Existing house has been removed by MnDOT -Re-usability of existing mound system is unknown - Tested alternate site impacted by taking. The post-taking lot size of 1.2 acres is nonconforming.If MnDOT can show that suitable primary and alternate drainfield sites are available, and that a new home can be constructed meeting all City location requirements, then a variance for lot area might be granted if applied for.The alternative is to sell this land to an adjacent property owner as additional yard area. 365 Old Crvstal Bav Road N. (Developed residential lot) Legal Description: (metes and bounds) - Gross area(no wetlands): 9.3 acres -Approximate area in r-o-w: 2.0 acres -Net dry area after taking: 7.3 acres - Existing house has been removed by MnDOT - Substantial area of topsoil has been removed from site, which may severely limit the capability for septic systems. This area is not provided with municipal sewer. The post-taking lot size of 7.3 acres is conforming. City does not have enough information to know whether 200' lot width will remain.If MnDOT can show that remaining site has 200'width at 50'front setback line,and that suitable primary and alternate drainfield sites are available,then this site could be used for a conforming building site. It is unknown whether the property is subdividable without additional detailed information. You also questioned whether the City has an interest in acquiring any of these properties. The City does have an interest in the 365 Old Crystal Bay Road property, as it would provide access to City open space parkland immediately west of that properly. This has been discussed in the past with MnDOT staff. As to the other properties,the City may have an interest in acquiring trail easements along the south side of the corridor east of Old Crystal Bay Road.
