A RESOLDTION GRANTING
VARIANCES TO
• MONICIPAL ZONING CODE
SECTIONS 10.22, SIIBDIVISIONS 1 � 2,
10.25, SIIBDIVISION 6 (B) , AND
10.55, SIIBDIVISION 8

' WHEREAS, Joe and Sandy Rauschendorfer (hereinafter "the
applicants") are the owners of the property located at 3895
Shoreline Drive within the City of Orono (hereinafter "City") and
legally described as follows:
Exhibit A attached, (hereinaf.ter "the property"); and
WHEREAS, the applicants have applied to the City for
variances .�to Municipal Zoning Code Section 10.22, Subdivision 1
and Section 10.55, Subdivision 8 to allow construction of a new
• foundation under� the existing house and a new attached garage
addition, both located less than 75' from the shoreline of Lake
Minnetonka �where a 75' setback is normally required, and a
variance to Section 10.22, Subdivision 2 to allow hardcover in
the 0-75' and 75-250' lakeshore zones in excess of the hardcover
amounts normally aI lowed in those zones, and variances to Section
10.25, Subdivision 6 (B) to allow a side yard setback of 4.6' to
- the west side Iot Iine and 3' �to the east side Iot Iine where 10'
side lot Iine setbacks are normally required, and to a1low a 7'
street setback where a 30' street setback is normal ly required.
NOW, THEREFORE, BE IT RESOLVED by the City Counci I of
Orono, Minnesota:
FINDINGS
1. � This appl.ication was reviewed as Zoning File #1261.
2. The property is Iocated in .the LR-1C Single Family
Lakeshore Residential Zoning District.
3. The Orono Planning Commission reviewed this app Iication
. on March 20, 1989, and recommended approval of the hardcover
variance subject to hardcover not exceeding pre-existing
square footages of hardcover on the property, recommended
approval of the foundation replacement under the existing
• house, and recommended that the garage addition be no closer
than 10' to the west Iot Iine.

4. The City Council makes the following additional findings
. of fact regarding the proposed application:
A) Maintaining a 10' setback from the west Iot line
wi11 not allow applicants to construct the 2-car garage
that is necessary for security of their vehicles,
privacy, and storage of Iawn and property maintenance
equipment currently stored in a steel shed on the
' property. .
B) Approval of variances to allow a west side lot line
setback of 4.6' will sti11 maintain the required 10'
setback from the neighboring residence necessary for
fire safety and drainage purposes.
C) The applicants have revised the application to
exclude the originally proposed 4' expansion lakeward
from the existing house.
• D) There is no additional property available for
acquisition by the current property owners to relieve
the existing substandard setbacks. Also, there is no
feasible means by which the property owners can
relocate the existing house within the property
boundaries to meet the required setbacks from the
street sides and lalce, hence repositioning of the house
normal ly required during foundation reconstruction is
not feasible.
� E) A variance to aI.low the garage corner to be as
close as 7' to the street Iot line where a 30' setback
is normally required, is justified by the need for
adequate security of the applicants' property and is
� supported by the fact that the location of the proposed
garage doors would be at least 20' from the existing
sidewalk and at Ieast 27' from the existing curb line
of County Road 15, Ieaving adequate room for parking of
vehicles outside the garage without affecting
pedestrian or vehicu3.ar traffic in the right-of-way.
Furthermare, the proposed driveway width will allow
enough room to maneuver applicants' vehicles in order
to enter traffic moving forward.
5. The City Council has considered this application
• including the findings and recommendations of the Planning
Commission, reports by City staff, comments by the
applicants and the effect of the proposed variances on the
health, safety and welfare of the community. ,

� 6. The City Counci 1 f inds that the conditions existing on
this property are peculiar to it and do not apply generally
to other property in this zoning district; that granting the
variances would not adversely affect traffic conditions,
light, air nor pose a fire hazard or other danger to
neighboring property; would not merely serve as a
convenience to the app Iicant, but is necessary to alleviate
a demonstrable hardship or difficulty; is necessary to
" preserve a substantial property right of the applicants; and
would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City. '
CONCLQSIONS, ORDER AND CONDITIONS
Based upon one or more of the findings noted above, the
Orono City Council hereby grants a variance to Municipal Zoning
Code Section 10.22, Subdivisions 1 and Section 10.55, Subdivision
8 to allow construction of a new foundation under the existing
• house and a new attached garage addition, both located 58' from
the shoreline of Lake Minnetonka where a 75' setback is normally
required, and a variance to Section 10.22, Subdivision 2 to allow
hardcover in the 0-75' and 75-250' Iakeshore zones in excess of
the hardcover amounts normally required in those zones, and
variances to Section 10.25, Subdivision 6 (B) to allow a side
yard setback of 4.6' to the west side Iot line and 3' to the east
side Iot line where 10' side Iot Iine setbacks are normally
required, and to allow a 7' street setback where a 30' street
setback is normally required, subject to the following
condi�tions:
1. Hardcover on the property shall be limited to the

The existing sidewalk leading from the house to the
lakeshor.e shall be removed prior to inspection of footing
forms for the garage addition. The steel storage shed shal 1
be removed from the property when the garage addition is
complete. ,
• Final hardcover layout shall be as shown in Exhibit B
attached.
2. When the foundation for the existing house is replaced,
the basement f loor elevation shall be raised to elevation
932.5' or higher, to be above the flood plain level.
3. Applicants shall mazntain suitable grades around the
house so that no additional drainage is directed to the
neighboring properties on either side.
� 4. The applicants are advised that any future additions
resulting in additional hardcover on the property wil 1 not
be approved, but might be approved only in conjunction with
concurrent removals of existing hardcover, resulting in no �
net increase in hardcover on the property.
5. Authorities granted by this resolution run with the
property not with the applicants, but are permissive only
and must be exercised by application for a building permit
within one year of the date of Council approval, or this
variance will expire on that date (May 8, 1990).
6. Violation of or non-compliance with any of the terms and
conditions of this variance shall constitute a violation of
the zoning code, shall automatically terminate any authority
• granted herein, and shall be punishable as a misdemeanor.

7. The undersigned applicants have read, understood and
� hereby agree to the terms of this resolution and on behalf
of themselves; their heirs successors and assigns, hereby
agree to the recording of this resolution in the chain of
title of the property.
Adopted by the City Council of the City of Orono,
Minnesota at a regular meeting held on the 8th day of May, 1989.
