The City of Orono passed Resolution#4485 approving the County's proposal on June 26, 2000. A copy of the signed resolution was transmitted to the District on November 17, 2000. The District reviewed the permit application and requested additional information. The information was complied and submitted to the District on August 10, 2000. The permit application was approved by MCWD staff with recommendation for approval with two conditions: 1) a maintenance agreement for the sump catch basins and expanded wetland must be executed and recorded, 2) a declaration for preservation of the wetland buffers must be executed and recorded. The MCWD Board of Managers met on August 24, 2000, with the Board tabling the application. The Board requested that MCWD staff work with the County on minimizing the impacts to wetlands and their associated buffers. The MCWD and County staff inet on December 13, 2000, for historic aerial photo review to determine if the wet area in question is a wetland or an excavated stormwater pond. A revised notification form and wetland delineation report were submitted on July 20, 2000 with plans regazding erosion control measures, rate control of storm water runoff and re-vegetation of disturbed areas. These plans were revised again based on comments by District staff and resubmitted on August 10, 2000. District staff determined that the revised plans met District requirements and approval of the revised plans was placed on the consent agenda for the District's August 24 meeting. Mr. Guy Nowlan, Hennepin County Transportation Department, attended the August 24 meeting to answer any questions the Board might have concerning the project. The District Board expressed concern regarding the proposed wetland impacts and ta.bled the application. In addition, the Board directed District staff to meet with County staff regarding the application. Prior to meeting with District staff, County staff reviewed the submitted plans as well as eazlier preliminary drafts. The development of the site plan is summarized in the following paragraphs. The original site inspection and delineation was conducted on September 2, 1999. The inspection confirmed that the site had no wetlands protected by the Minnesota Department of Natural Resources (DNR) and three wetland areas were delineated. The proposed project did not result in any wetland areas being filled. One wetland area would be impacted by excavation activities. At that time, the Minnesota Wetland Conservation Act (WCA) did not require , replacement of excavation impacts provided the excavation did not result in a change of type. The proposed excavation would not result in a change of type. The proposed excavation impacts (less than 0.1-acre) were below the U.S. Army Corps of Engineers threshold for wetland mitigation. The impacted area was not on the City of Orono's protected wetland list or map. Although not required, the preliminary plans did create 4,064 square feet of type 1/2 (PEMA/B) � new wetland credit (NWC) and 9,767 square feet of buffer. Replacement credits, if required, would total 7,112 square feet (4,064 ft2 NWC + 3,048 ft2 PVC = 7,112 ft2) and exceed a 2:1 replacement ratio. Due to the nature of the project, the limited impact and the creation of wetland credits not required by the WCA, County staff did not expect problems with the approval of the project by the District. Since problems were not anticipated with approval of the project, County staff did not review historical aerial photos of the site to try to resolve questions regarding whether or not the impacted wetland qualified for exemption from WCA requirements. The project was delayed due to changes in the building design required by the City of Orono. During this period the WCA requirements regarding excavation impacts were changed. WCA rules now require that impacts resulting from excavation in type 3, 4 and 5 wetlands be replaced. County staff did not view this rule change as a serious problem because the voluntary wetland mitigation originally proposed was sufficient to meet WCA requirements. The final submittal was made on August 10,2000. After the County's application was tabled, whether or not the impacted area qualified for exemption from WCA requirements was now germane. County staff reviewed aerial photographs from 1953, 1957, 1964, 1969, 1975, 1979 and 1989. The aerial photographs indicate that the area was filled between 1957 and 1964. Additional review showed that the County excavated a storm water pond on this site. Over time this pond has developed wetland characteristics but is exempt from WCA requirements (Minnesota Rules 8420.0122 Subp. 5). County staff inet with District staff on December 13, to review the aerial photographs. Although the District staff agreed with the interpretation of the photographs presented by County staff,they requested that a technical evaluation panel (TEP) review the photographic evidence and confirm that the area is exempt from WCA requirements. The TEP, based on the photographic evidence, found that the impacted area was excavated to create a storm water pond sometime between 1979 and 1989. The TEP confiimed that the azea is not a jurisdictional wetland and the proposed excavation does not require any wetland mitigation. I believe the findings of the TEP and District staff should address the Board's concern regarding this project. Sincerely, ��, � Joel C. DATE �'W!����r. ia�-i .�i,li .•vl•1� 161:1:. ,�: �.�,,�,., „1=��,.r�.-..i•. � �, �i ..,�,��, • . . • ATTACHMENT B � ��� STORMWATER FACILITY MAINTENANCE These terms apply to the stormwater facilities constructed pursuant to Minnehaha Creek Watershed District permit application number WHEREAS,Hennepin County has applied for a permit from the MCWD pursuant to MCWD Rule B, Stormwater Management; and WHEREAS,the property that is the subject of this agreement is legally described in the Declaration into which tlus Attachment is incorporated and the facilities on the property to which these maintenance requirements apply aze as follows: WHEREAS,MCWD Rule B provides, "A maintenance agreement shall be submitted for: stormwater treatment ponds, outlet structures for such ponds, culverts, outfall structures and a11 other stormwater facilities. This maintenance agreement shall specify methods, schedule and responsible parties for maintenance and must include at a minimum,the elements contained in the District's Maintenance Agreement Form. NOW,THEREFORE: 1. Hennepin County shall inspect the stormwater retention and treatment basin(s) at a minimuxn of once a year to determine if the basin's retention and treatment characteristics are adequate. A storage treatment basin will be considered inadequate if sediment has decreased the wet storage volume by %Z of its original design volume. Based on this inspection, if the stormwater basin(s) is identified for sediment cleanout, Hennepin County sha11 restore the basin(s)to its original design contours within one year of the inspection date. 2. Hennepin County shall inspect the grit chambers, sump catch basins, sump manholes,outlet structures, culverts,outfall structures or other stormwater facilities for the project in the spring and fall of each year. Hennepin County shall remove a11 sediment and debris during the inspections such that the stormwater facilities operate as designed and permitted. 3. This Declazation and agreement shall be in full force and effect upon the date of execution for a seven year period. ' 4. Violation of the inspection and/or maintenance provisions of this Agreement is a violation of the MCWD permit for the project for which the MCWD may take action against Hennepin County. ' Hennepin County agrees that it will be responsible for its own acts and the results thereof,to the extend authorized by the law, and shall not be responsible for the acts of the other party and the results thereof. At the August 24`�Board Meetin.g Guy Nowlan of Hennepin Couniy had sta.ted tha.t the wetland/pond where excava.tion was being proposed was a si�rmwatcr pond created by the Counry. After th�permit was tabted,the County � further investi�ated the status of the pond i.n.question. District sta££met with Hcnnepin County representatives on December l 3 to rc;vicw aerial photos. 1'he site vc�as predominantly wetland prior to developznent arotmd 1957. Distr.ict sta££agreed wilh the Cottnty that a progtessian of alterations to the wctland area in question has occuired over time. I3oweve�,District staff called for a TEP review of the aerial�hotos to confinn that tk�e pond had been altercd,where filling . occurred sometime between 1�57 and 1964, �nd axeavatin� for stormwatex in the same area sometune betwee�i 1979 and 1989. The TEP confumed the dates listed above whr;re alterations lo ihe wetland area oceurred and classified i.he vvctland as ineid.ental. Under WCA incidental wetlands do not require r�placement. Rul�� The erosion control plarl meets Rule B requirements a�.d anclucies sill fenee,hay bales sunrounding catch basins, and reseeding of the site. �Ta su�ety is required. ��n Two wetlands azc located on the p.roperty; neither wel•land will be impactcd by the project. ln addi.tion, one incidental wetland is loeated on the site.
