The City also has received complaints of dumping of debris and other materials at the rear of the site which constitutes filling for which no required permits have been obtained. The extent of filling and materials filled has not been documented by the City. City files contain a long history of violations in regard to use of the property. If the property had been granted a"non-conforming conditional use permit" pursuant to Zoning Code Section 10.03, Subd. 5, it would be considered legally non- conforming; however, no such permit is documented as having been applied for nor granted. The existing use as of 1-1-75 has remained in most respects unchanged; no new structures have been added, the level of activity has not substantially intensified, but the area of the property devoted to such use appears to have expanded based on review of aerial photos from various years. The property cannot be used for any commercial use other than the bulk landscaping material storage that is occurring on the property. The City will not a11ow expansion of the current commercial use should a new owner wish to continue the current use. Expansion would include such activity as adding any retail components to the site such as an office, signage, paving of storage areas, increased traffic or activity not related to the mere storage of bulk natural landscaping materials, or any increase in size of the physical area devoted to the commercial activity. The City will continue efforts to gain compliance with City ordinances in terms of clean- � up of junk and debris from the site. Sohns • 3770 Shoreline Drive Orono, Minnesota 55392 Re: Zoning Violations Dear Mr. Sohns: The City has received complaints regarding operations at 3770 Shoreline Dr. An inspection revealed the following zoning code violations: 1) Storage of unlicensed inoperable vehicles - violation of Orono Municipal Code Section 9.50. 2) Exterior storage of building materials,fuel oil tanks, scrap piles, asphalt,boats,bntsh and other junk and debris -violation of Orono Municipal Code Section 9.55, Subd. 1. 3) Filling without a grading permit approval from the City - violation of Orono Municipal Code Section 10.03, Subd. 19. 4) Filling within 26' of a wetland-violation of Orono Municipal Code Section 10.55, Subd. 8. The City has notified you in the past of these ongoing violations and realizes the clean up could take a fair amount of time. However,the City expects progress to be made before March 18, 1996 and the entire property cleaned up and fill removed from the 26' setback azea before June 1, 1996. The City will not hesitate in issuing citations and taking whatever legal actions are necessary to eliminate these violations. On April 9, 1991 an inspection was conducted and many code violations were found. 1. Land fill operation. It appears that you are operating a 1 and f i 11. Pi 1 es of concrete, bri ck, garbage, house demolition debris, etc. are piled on the property. This is a violation of Orono Municipal Code Section 9.55 and Section 10.03, Subdivision 19. 2. Unlicensed, inoperable vehicles. The property has many unlicensed, inoperable vehicles parked all over. This is a violation of Orono Municipal Code Section 9.50. � The City must require you to remove the demolition debris, piles of concrete, brick, garbage, etc. before April 29, 1991. This includes items that have already been buried. The unlicensed, inoperable vehicles must be removed, or licensed and ' made operable, or stored inside a legal structure before June l, 1991. If these deadlines are not met the City will issue citations and refer the matter to the City Attorney for further legal action. Box 2, Navarre, Minnesota. This is in a secluded spot �leither visible to the front nor the rear. I was alerted to it by the Spring Park inspector checking on elm disease. There are three trees.. that are suspect for the disease to be verified by Monday or Tuesday. This is presently zoned Commercial in front and Industrial in the rear by the tracks. The land is being used for a landscaping business, which is perhaps legal. What is illegal is using the property to dump trash and covering it and piling wood and brush, , probably from diseased treeS, the aftermath of their business, on the premises. I had your office send a letter to this party early this year to remove a mobile home from the premises which was ho�ising somebody. It i� still there but does not appear to being used. I will further ' verify this. I talked to Dick Benson and we decided instead of sending notices to expedite the matter by signing a complaint against Mary Sohns,which I will gladly do. My allegations will be verified by numerous photos and the Spring Park inspector who was with me. If there is anything I can do to help, please call.
