Attached are the Information Update memos from July 23 and 30 for reference if Council wishes
to discuss any of these items.

• Regarding the recent ruling by the MN State Supreme court—the attached letter is a request from a
resident who made a recent application for lot width and hardcover variances to construct a new
residence. Their application was submitted on June 23rd, coincidentally the day before the Supreme
Court's June 24th ruling. They were clearly disappointed when staff advised them of the ruling and
what it would mean for their hardcover variance request,however did not decide to request a tabling
until after the staff report—containing a denial recommendation—was published. Their letter
requests to be tabled for up to 12 months and a refund of their fees should they decide to withdraw.
As long as Soren approves, staff can honor his request for a"tabling" for up to 12 months. However,
staff does not support refunding the application fees as the legal publication and mailings were sent,
the engineer review was conducted,the variance analysis was done and the staff report was written.
Additionally, this resident may appear before the Council at the public comments portion of your
meeting in the upcoming month or so. I believe he will be seeking a response on the ruling from the
Council. (MC)
• Based on the attached email from Terry Post,Long Lake plans to attend the Met Council meeting on
August 16th to"echo their earlier concerns"about our Comp Plan. They finally released the water
capacity report from their Eng-ineer and Tom Kellogg has been asked to review it for accuracy and to
provide comments.
• The attached special event permits have been issued:
o Private party with fireworks to be held on Saturday, July 24,2010 at 3565 Frederick Street.
o Long Lake Fire Station#1 SK Fun Run/Walk& 1K Kids Fun Run to be held on Saturday,July
31,2010 in the Hackberry Park area.
o End of Summer Party with music to be held on Saturday,August 14,2010 at 2630 Countryside
Drive West.
• The attached letter was mailed to residents of the North Farm Road neighborhood inviting them to an
informational meeting on Wednesday,July 28�'at 6:30 p.m.regarding a potential sewer project.
• Planning staff inet with representatives of the Long Lake Fire Depariment on Monday to discuss a
fire fighter memorial for Station#1. Plans are being developed but will essentially result in minimal
grading of the site—which will alleviate drainage issues they have dealt with since construction—and
monuments which will surround the flag pole. Plans will be brought to Council when they are
finalized to receive Orono's authorization to commence construction. Fire Deparhnent reps will
continue to work with Staff to assure that all permits and approvals are obtained. (MC)
• Many police officers and council members attended the Police Services RFP interview on Monday
night. We received the following update from Terry Post on the rest of the process:
"One of the agenda items on the work session agenda prior to the regular August 3,2010 council
meeting,will be a discussion of the police services provider topic. While all of our work sessions
are public meetings,the discussion of this topic will be held in council chambers with Long Lake
residents and businesses encouraged to ask questions, or comment, on the process and/or the
respondents. The Council will process this information and be prepared to make a RFP agency
selection at the regular meeting of August, 17,2010."

� Reminder—The first Council work session in August will be on Wednesdav,August 11,not Tuesday,
August 10, due to the Primary Election. The main topic of discussion will be the 2011 budget.
• Filing for city offices begins on Tuesday,August 3 and is open through August 17,2010. Attached is
a short overview of the filing process. The"Affidavit of Candidacy"and packet of candidate filing
information is available at City Hall.
� The attached special event permit has been issued:
o Mosquite Man Duathlon, sponsored by Gear West,to be held on Saturday, September 4, 2010 on
the Orono School grounds and surrounding areas. Approximately 200 participants are expected.
• Casco Point Beach was closed on Tuesday evening due to evidence of bacteria(notice attached). The
beach has been re-opened as of Friday, July 30, 8:00 am.
• A list of neighborhood parties/events that have been registered with the Orono Police Department for
National Night Out is attached.
• Yesterday the Planning Commission and Planning Staff conducted a by-boat tour of the lakeshore.
We were able to see a few homes where native plantings have been incorporated into the lake yard
landscaping and/or rip rap. It is amazing the difference some plants can make. The PC enjoyed the
tour and told staff that they appreciated the first hand views of recent projects and the discussions on
board. (MC)
• This week Tom Kellogg,Mike Gaffron and I met with representatives of Xcel. They are planning to
update their existing substation at 3960 Sixth Ave. They are planning to convert from a 69 kV single
line to a 115kV"looped"line. With my limited lrnowledge of these things I understand that it will
mean a greater capacity for Orono residents and people living west of Orono as well as provide for
fewer to no power outages. More detail will follow in the coming months. Xcel has chosen to follow
the local government unit permitting path(ours)as opposed to the State's permitting path. Ours is
faster. 'This will mean that our PC will hold an additional informational meeting in September—an
Environmental Assessment scoping meeting—which must happen ahead of the CUP public hearing
(possibly at the October PC). No action will be taken at the September meeting on this application.

• Attached is the Planning Commission's August legal notice. There are two City initiated applications
for code amendments on this notice.Please contact me with any questions. (MC)
• An update from the Long Lake Fire Department advisory meeting: the current year's budget is on
track,the preliminary 2011 budget will be reviewed in August(predicting an increase of less than
3%), and the Fire Chief is looking at a training room usage policy that will also be reviewed in
August.
• The agenda for the August 3rd Long Lake work session is attached. The meeting to accept public
input on the police RFP's begins at 5:30 nm on Tuesdav_.

Assistant City Administrator for Long-Term Strategy Mike Gaffron, Finance Director Ron Olson, City
Clerk Lin Vee,State Senator Gen Olson, Gabriel Jabbour
1. Discussion with State Senator Gen Olson
Senator Gen Olson provided background information related to the legislation introduced by Senator
Chaudhary to abolish the Lake Minnetonka Conservation District(LMCD). Although the bill did not pass, its
introduction generated discussion among Lake Minnetonka cities about the role of the LMCD and other
agencies with authority over lake management. Senator Olson is seeking input from cities regarding their
experiences with the LMCD.
Uue to the current financial and economic climate, Senator Olson commented that informal discussions have
taken place about restructuring of government and exploring ways in which cities and counties might be able
to coordinate services.
Senator Olson expressed her appreciation for the support of the Orono Council and encouraged Council to
contact her with any ideas and issues related to the district she represents.
2. Parking Options Along Dakota Rail Trail
Gaffron provided airphotos and maps of the Dakota Rail Trail from Wayzata to Spring Park. Council discussed
potential sites for public parking. The area behind the Navarre Fire Station and possibly an area near Blaine
Street were identified as options for further consideration.
3. Comments Regarding Information Updates
There were no comments.
4. Other Issues of Current Interest
Gaffron distributed a draft web page of Big Island Park Rules for Council review and comment.
