WH$RSAS, Robert J. Ritchie (hereinafter "the
applicant") has an interest in the property Iocated at 3572
Shoreline Drive within the City of Orono (hereinafter "City") and
Iega3.Iy described as Lots 18 & 19, Block 7, Navarre Heights,
Hennepin County, Minnesota (hereinafter "property"); and
WHEREAS, the applicant has applied to the City of Orono
for a conditional use permit to permit a veterinary clinic for
smal. 3. animals per Municipal Zoning Code Section 10.44 ,
Subdivision 4 (A).
NOW, THER$FORE, BB IT RESOLVED by the City Counci Z of
Orono, Minnesota:
� FINDINGS
• 1. This application was reviewed as Zoning File #1478.
2. The property is 3.ocated in the B-5 Limited Neighborhood
Business District requiring 20,000 square feet in area." The
property consists of 13,450 square feet.
3. On November 20, 1989, the Orono Pl.anning Commission
reviewed the application and recommended approval of an
amended proposal based on the fol.Iowing findings:
A) The proposed use meets the intent of the B-5
Limited Neighborhood Business District and the _ .
Comprehensive Plan of the City.
B) More intense commercial uses of this substandard
site have existed on the property without any negative
impact on the adjacent properties.
C) The veterinary clinic would be Iimited to the use
of one veterinarian.
D) The clinic wil�. not maintain animals in outside
kennels or pens.

4 . The City Council has considered this application _
including the findings and recommendations of the PZiicant `
Commission, reports by staff and comments of the app �
and the affect of the proposed use on the health, safety, :
and weZfare of the community. • �
5. The City Council finds that granting a conditional use !
� permit to allow a veterinary clinic will. not be be
detrimental to the health, safety or general welfare of the
publ.ic, would not adversely affect light, air nor pose a
fire hazard or other danger to neighboring properties, nor
will. its use depreciate surrounding property values and that
the proposed level of use of the property will be in keeping
with the intent and objectives of the Zoning Code and
Comprehensiye Plan of the City. �
CONCLIISIONS, ORDffit AND CONDITIONS
• Based upon one or more of the above findings, the Orono
City Council hereby grants a conditional use permit per Municipal.
Zoning Code Section 10.44 , Subdivision 4 (A) to permit a
veterinary c3inic on the property Iocated at 3572 Shoreline
Drive, subject to the following conditions:
1. Prior to the issuance of a buiZding permit for internal
improvements within the existing structure, appZicant must
apply for the legal combination of Lots 18 and 19, Slock 7,
Navarre Heights.
2. Applicant must fi3e for a commercia3 site plan review
prior to the February 23, 1990 fi7.ing deadline for the March
19, 1990 meeting of the Planning Commission. App3.icant is
further advised that commercial site plan application must
deal with the following items:
* Signage
* Lighting
* Landscaping
* Approved Parking
* Drainage Improvements
* P3.ans for the Exterior of the Building
3. AIl site improvements required as a resu3t of the
• commercial site plan review must be installed by September
15, 1990.

4. Any change in the 1.evel of use by an addition of a I�
veterinarian, expansion of examination roo�oval of a�new
� additions to the facility would require app ;
conditional use permit. ;
5. Authorities granted by this resolution run with the ,
property not with the applicant, but are permissive onl.y and i
must be exercised by application for a commercial site plan f
review by February 23, 1990 or this conditionaZ use permit I
may be revoked by the Council at their first regular meeting i
after the deadline date.
6. Violation of or non-compliance with any of the terms and
conditions of this resol.ution shall constitute a violation
of the Zoning Code, shall automatically terminate any
authority granted � herein, and sha3.1 be punishable as a
misdemeanor. �
7. The undersigned applicant, Robert J. Ritchie and Janet
" Roshar, a licensed veterinarian, have read, understood and
• hereby agree to the terms of this resolution and on behalf
of themse3ves, their heirs, successors and assigns, hereby
agree' to the� recording of this resolution in the chain of
title of the property.
Adopted by the Orono City CounciZ on this llth day of
December, 1989.
