' , �/ �' �S�y�.�, r�RESOLU'�I�N G�tANTING A CONDITIONAL USE PERMIT FOR A SPORTS AND HEALTH CLUB PER SECTION 78-644 FILE NO. 10-3466 .� �K��.�: t���`;'�' s � O� O 0 C ITY of ORONO ,� , � ti ti RESOLUTION OF THE CITY COUNCIL �L`9kESI3���G NO. �' �lT A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR A SPORTS AND HEALTH CLUB PER SECTION 78-644 FILE NO. 10-3466 WHEREAS, Narrows LLC, (hereinafter "the Owner") is the owner of the property (hereinafter "Propert}�') located at 3380-3382-3384-3386 Shoreline Drive within the City of Orono (hereinafter the "City") and legally described as: That part of Lot Five (5), Block Three (3), Townsite of Langdon Park, Hennepin County, Minnesota, described as follows: Commencing at the Southwest corner of said Lot Five (5), Block Three (3), Townsite of `� Langdon Park, thence easterly along the Southerly line of said Lot Five (5) a distance of 112.0 feet; thench Northerly at an angle of 89.10 � ��� degrees a distance of 100 feet; thence Westerly at an angle of 90.10 degrees a distance of 112.0 feet, more or less, to the Westerly line of � �,�'' said Lot Five (5); thence Southerly along said Westerly line of said Lot �� Five (5) 100 feet to the point of beginning, all according to the map or � � plat thereof on file and of record in the office of the Register of Deeds '� in and for said County of Hennepin and State of Minnesota. and WHEREAS,Andrea Odenwald(hereinafter"the Applicant")has made application to the City of Orono for a conditional use permit for a sports and health club to be located on the Property; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on May 17, 2010, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. Page 1 of 3 � o� 0 0 CITY of ORONO ,� ; �., ti ��� �G~' RESOLUTION OF THE CITY COUNCIL `9kESfIOg' NO. � q� 7 NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS l. This application was reviewed as Zoning File#10-3466. 2. The Planning Commission reviewed this application on May 17, 2010 and on a vote of 6 - 0 recommended approval of the conditional use permit based the request complying with the requirements of Orono Code Section 78-916. 4. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by Ciry staff, comments by the applicant and the public, and the effect of the proposed conditional use on the health, safety and welfare of the community as well as the impact on properties in the vicinity. 5. The City Council fmds that the proposed location of the conditional use is in accord with the objectives and purposes of the B-1 Retail Sales zoning district in which the site is located and with the comprehensive municipal plan and that the proposed sports and health club would not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a conditional use permit for a sports and health club, subject to the following conditions: 1. The sports and health club shall occupy only the premises commonly known as 3384 Shoreline Drive, as shown on the attached Exhibit A. The premises consist of the first floor and basement, comprising in total about 1,950 square feet. 2. The sports and health club shall not be open before 6:00 am or after 10:00 pm. 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5.
