Page 1 of 3 � o� 0 0 CITY of ORONO ,� ; �., ti �� G~' RESOLUTION OF THE CITY COUNCIL `9kESfIOg' NO. � q� 7 NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS l. This application was reviewed as Zoning File#10-3466. 2. The Planning Commission reviewed this application on May 17, 2010 and on a vote of 6 - 0 recommended approval of the conditional use permit based the request complying with the requirements of Orono Code Section 78-916. 4. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by Ciry staff, comments by the applicant and the public, and the effect of the proposed conditional use on the health, safety and welfare of the community as well as the impact on properties in the vicinity. 5. The City Council fmds that the proposed location of the conditional use is in accord with the objectives and purposes of the B-1 Retail Sales zoning district in which the site is located and with the comprehensive municipal plan and that the proposed sports and health club would not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a conditional use permit for a sports and health club, subject to the following conditions: 1. The sports and health club shall occupy only the premises commonly known as 3384 Shoreline Drive, as shown on the attached Exhibit A. The premises consist of the first floor and basement, comprising in total about 1,950 square feet. 2. The sports and health club shall not be open before 6:00 am or after 10:00 pm. 3. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5.
