THTS DSCLARATION AND AGREE�dENT is made this day of

SCOTT, husband and wife (herei.nafter collectively referred to as
�Declarants") .

located in Hennepin County, Minriesota, described as follows:
Lots I1, 12, 17 and 18, Block 6, Navarre Heights; and
WHBR.EAS, said Declarants wish to create easements for
driveway ingress and egress purposes c�ver par�s oE said
properties as hereinafter described, a.nd furCher wish to pravide
for an allocation of the costs of maiLtenance, repair and
replacement of the driveway easement area hereinafter described;
NOW, THSREFORE, Dec3�arants do heY•eby give notice to all ,
owners and encumbrances, future purchc.3ErS and their heirs,
representatives, successors and �ssigr.�s of any lot cr lots
hereinabove described and to whosoevex• it may concexn that said
properties are, and each and every corsveyance of any of the
abovs described lots will, in the future, be subject �o the
following Declaration of Easement and Maintenance Agreement:
1. Declaration pf Easements.

an easement �or driveway inlress and egre�s purposes

purpoeee.
(0�) The foregoing easement descriptions ahall hereinaftez
co}.lectively be referred to as the "drive�aay area" .
2. Main�enance Ag7reement.,
Each of said Lots 17 and 18, BI.ock 6, Nav3rre Heights
and the owners thereof shall be charged with paying
fifty percent {50�) o£ the cost of mainte�ance of the
driveway area. "Maintenance", as the Cerr is used
herein, shall mean normal, ordinary maint�nance,
repair and replacemen� og the driveway araa,
including, without limitation, snowp3.owin�, patching,
overlaying and replacement as is necessary to maintain
a driveway consistant with rer>iden�ial standards in
the community in which the property is located.
Each owner of each said Lo� I7 and Lat 18 sha13. be
personally, jointl.y and saverally responsible to pay
his or her respective fi£ty percent (5D�) allacati�n
of said costa. In addition, any such unpaid costs
shall constitute a ].ien upan the property pf such
owner, inferior, however, to �he lien of any first
mortgage recorded or to be recorded thereon,and also
inferior to any mortgage af record on the date hereof.
Delinquent payments shall r�ear interest aL eight
percent (8�? per annum frocr. their due date until paid.
Any owner of said Lot 17 ox• said Lot 18 nay bring an
action under paragraph 4 hEreof on behalf of �he non-
deFaulting owner(s) to callect a defaulting owner�s
share of such costs, and, i� such event, shall be
entitled to recover such reasonable attor•ney's fees
and all necessary costs anc� disbursements incurx-ed in
cvnnection with said col2er.tion action.
The driveway area is intencled to be used for ordir�ary,
residential traEEic by the owners of saic. Lots 17 and
1B, alad their guests. Any use which is t�ut o� the
ardinary, such as construc�ion traffic wY..ich causes

damage to the driveway area, wi11 be repa:ired at Che
cost of the owner who creat+:d the traffic which caused
such damage.
3 . Restrictions.
No owner of any of said Loto3 Z1, 12, 17, ,3nd 18
shall obatruct or interfere in any way wi•=h the rights
and privileges of other ownars in the dri•ueway area,
, and noChing shall be plante�3, altered, co;lstructed
upon or removed by any owne:r from the dri�veway area.
If an otvner shall violate t:ais provisiorz, the
� remaining owner(s) shall ha•ve the right t� restore the
driveway area to its pri.or �ondi�ion and �ssess the
costs of such restoration a��ainst the ownar who
violated this provisian, Any such assesa•nent shall be
due and payable as if it were a maintenan�e cost.
4. Dispute Rsso].ution.
Any disputes arising under this Deciaration of
Easement and Maintenance Agreement shall be settled in
arbitration according to the ru3.em then in effect ot
the American Arbitratian Association. This provision,
however, shall not prevent any one of the Declarants
or their heirs, representatives, successors or assigns
from recording a lien notice against a defaulting
party's property for the purposes af providing notice
of the alleged unpaid maintenance charges.
