HomeMy WebLinkAbout#5417-Driveway easements-2006• • CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 5417 A RESOLUTION APPROVING CREATION OF DRIVEWAY EASEMENTS INVOLVING PROPERTIES LOCATED AT 3472 & 3480 SHORELINE DRIVE AND 3477 LYRIC AVENUE - FILE #05-3168 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of Orono (hereinafter "City Council") has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a Class I subdivision by Lyle C. Scott and Joyce E. Scott, husband and wife (hereinafter "the applicants") per Orono Municipal Code Section 82-15(a)(3) to create a driveway easement involving properties known by PIN No.s 17-117-23 43 0088;17-117-23 43 0089;17-117-23 43 0093; and 17-117-23 43 0094, said properties legally described as: Lots 11, 12, 17, and 18, Block 6, "Navarre Heights", Hennepin County, Minnesota (hereinafter "the properties"); and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on January 17, 2006 at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, the Planning Commission reviewed the proposed driveway easement to provide legal access from Lyric Avenue to the two lots abutting Shoreline Drive, and on a vote of 5-0 recommended approval of creation of the proposed easements; and WHEREAS, the applicants have completed all requirements of the City for the creation of a driveway easement for ingress and egress in favor of Lot 17 over Lot 12, and in favor of Lot 18 over Lots 11 and 12. Page 1 of 3 L_J CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 5417 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves the creation of the proposed ingress/egress easements as shown on the Certificate of Survey by Danial G. Nickols, a licensed surveyor of Schoell & Madson, Inc. dated November 23, 2005, attached hereto as Exhibit "A", subject to the following conditions: Applicant shall be responsible for the creation and filing of the aforesaid easements in the chain of title of the affected properties. 2. Nothing in this approval shall be construed as granting any variances, zoning approvals, or waivers of any development standards established by the City of Orono. • 3. The aforesaid easements shall be filed with either the Hennepin County Recorder's Office or Registrar of Titles Office within one year of the date of this Resolution. If said easements have not been filed within one year, this approval will expire and it will be necessary to file a new application with the City of Orono for easement approval.
