Deax Ms. Mabusth:
Grm-Tom Partnership, the cwners ag 341Z-2o Shoreline Drive,
Navatre, have asked me as pxoperty manager for their building ta '
write to the city of Orona to request reselution of an onging
situation. This beirg the us of a portion of the parkirg area a
the rear of the,r property by the City as a public thoraugh.fare.
The legal descriptiort of the property owned by Germ-Tom Pattnership
is: LQts. 2 3, 2 4, 25 & 2 6, B.ock C, Navarre Heights. R'he street
address is as stated abave.
We do acknowiedg that the City has a 15 eaement over the west
15' of Iot 23, lock c, Navarre Hights. Hwver i.t is .plain to
see that t}te drxying pattern of the cars wishing o ue• the
municipal parking 1ot located north of the subject praprty have
gone well outside the easemnt granted. Specifical.y, hey are
using a .arge port.on of the north end of Lot 23, which is not par
of the eaemerit, and a saal.er portion of the ncrth end og Lot 24,
a1.sa not part of the easemnt,
Another factor that complicates this matter is that several paxking
spaoes have been lined by the City w.thin the 25 $sement area.
Because of thxs, anyone dzivfng to ox from Shoreline Dxive has to
drive outside the easement ixt order to gt hre.
The encrQachment described above effecti.ve1y denies the owners of
34],2,2p shozelin Drve the use of sveral parking spaces on ther
praPy. The need for these spaces is beooming increas3.ngly
Paant as rew tenants move into the lowe leve3 of their
building. Due to this, w are asking that th city address th,
problem and communicate heir suggested solutian in the near future
so that we may resolv this mate=,

Dear Mr. Hunziker:
Thank you for faxing the copy of Court MacFarlane's letter of November 15, 1992. As I
suspected, the City never received a copy of Court's original letter.
I have copied John Gerhardson, Public Works Director for the City, as John would be the key
staff person to deal with the concerns expressed in the November 15th letter.
It would certainly seem beneficial if all parties with an interest in the use of the parking lot meet
to discuss the issues raised and how any modifications to the design and use of the parking lot
may impact the City's needs and obligations.
Once again, your contact person would be John Gerhardson and he will be in contact with you
as soon as he has familiarized himself with your specific concerns.
Sincerely,

Dear Ms. Mabusth:
Grm-Tom Partnership, the awners af 3412-20 Shpreline Drive,
Navarre, have asked ne as pxcperty manager for their building to
write to the city of Oena to request resolution of an onging
situation. This bing the use of a portion of the parking area a
the rear af hei.r proprty by the City as a public thoraughfare.
The legal description of the property owned by Germ-Tom Partnership
is; Lots 2 3, 2 4, 25 & 2 6, Block C, Navarre Heights. The streat
ddrss is as stated above.
We do acknowledge that the City has a 15 easement over th west
5' of lot z3 , 81ock c, Navarre Hights. Hwever, it is ,plain. ta
see tht the driving pattern of the cars wishing to us the

'gane well outside the easement granted. Specifial].y, hey are
using Iarge part.on f the north erld of Lot 23, which is not part
of the easenent, and a smaller pvrtian pf' the north end of Lot 24,
alsa nct part af the easement.
Another factor that complYGats this mattr .s that several paxking
spaces have been lined by the Gity with:in the .5 esement area.
Because of thzs, anyane driyi.ng to oz from Shoreiin Drive has to
drive vutside the easement in arder ta gt hexe_
The encroachmen described bove effectively denis the awners of
3412-20 Shore2ine Drzve the use of several parking spaces on th.r
property. The need or these spaces is becoming increasingly
impertant as rw tenants move into the lowe level Qf their
building. Due te this, we are asking that the City addrss th.s
prablexn and counicate their suggested soution in the ner futur
sa that w aay resolve this matte.
