Dear John:
The current driveway from County Road 15 to the Navarre Public Parking area is on private
property as determined by our site visit. The property owner would like the City to correct
the situation.
The driveway access should have a minimum driving surface of 20 feet to accommodate two-
way traffic. We would recommend a minimum easement width of 25 feet, as shown on the
attached drawing. We would take a triangular strip of land from Lots 22 and 23 for the
easement. The area of each of the easements is 670 square feet. The proposed easements
will allow the City to maintain two-way traffic with a minimum reconstruction expense.

Dear Mr. Gerhardson:
Thank you for your letter of June 1, 1994 wherein the City
offers to pay the swa of $2,900.00 or $1.00 per square foot for
the easement over the property located at 3416 Shoreline Drive,
Navarre, Minnesota which is owned by myself and Mr. Germundsen.
Back in 1988, the County undertook to upgrade County Road 15
which runs in front of our property. At that time, condemnation
proceedings were commenced and the County took a permanent
easement of 1,497 square feet and a temporary slope easement of
655 feet for a one (1) year period of time.
Following an Award made by the Commissioners in 1989, this
matter was appealed to the Hennepin County District Court wherein
the County and the undersigned settled our claim for compensation
on the property taken for the gross sum of $14,000.00. I enclose
for your review a copy of the Stipulation for Settlement executed
by myself and Mr. James H. Gaffney, Assistant Hennepin County
Attorney.
It is my belief that the compensation owing to Germ-Tom
Partnership for the easement at issue should be in line with the
amount paid by Hennepin County back in 1989, and increased by the
rate of 3 percent per annum (the normal appreciation rate for
commercial property) .

IT IS HEREBY STIPULATED by and between the County of
Hennepin, upon approval of its Board, and Germ-Tom Partnership,
Respondent/owners as to Parcel No. 60, and their respective
counsel, as follows :
1 . The appeals of the County of Hennepin and �
Respondents herein from the award of Commissioners filed March 7,
1989, in the sum of $9,700 .25 as to Parcel No. 60 in the above-
entitled proceedings, are hereby settled and compromised for the
total gross sum of $14,000 . 00; and the appeals are dismissed with
prejudice, each party to pay their own costs and disbursements
and no costs or disbursements shall be taxed.
2 . The County of Hennepin, having heretofore
paid $$7,275 . 19, a 3/4 payment pursuant to M.S. 1988, § 117 . 155
in favor of and on account of the owners, shall pay the sum of
$6 , 724 . 81 to Germ-Tom Partnership. The payment of $542 . 15 as

interest on the 3/4 payment and the payment of $500 .00 for
appraisal fee by the County are not part of the settlement figure
of $14,000 . 00 .
3 . The terms and conditions, if any, of the award of
commissioners as to these parcels shall remain in full force and
effect.
4 . In consideration of the payment of the aforesaid
sum, the undersigned agree that said payment and acceptance
thereof shall constitute full accord and satisfaction of any and
all claims for damages and interest, past, present and future, of
any kind or nature occasioned by the taking of the tract affected
herein and known as said parcel no. 60 as more particularly
described in the proceedings, herein, hereby intending forever to
settle any and all claims as and for the taking as to said
parcels .
5 . This Stipulation shall be considered as a
substitute for the award made as to said parcels . Any further
proceedings may be had as though no appeals had been taken.

Dear Tom:
For several months Court McFarland and I have been discussing the City acquiring a road
easement across part of your property in Navarre and in particular the west entrance/exit to the
Navarre public parking lot.
Court and I have determined that the amount of additional easement as shown on the attached
sketch will be adequate for the City's needs and will provide a public road that is in fact being
used as a road today.
The City is willing to compensate you $1.00 per square foot (2,900 s.f.) for the easement and
«�ill prepare and record all documents necessary in the chain of title at the City's expense,
assuming that you have marketable title.
If this is satisfactory to you, please contact me so that I can get started on the preparation of the
