The work for which this permit is issued shall be performed according to
the approved plans and specifications,applicable City approvals,and the
State Quilding Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of 180 days at any time afrer work has commenced.
The applicant is responsible for assuring all required inspections are
requested in conformance with the State Building Code.This permit may be

LEASE OF PRQPER'FY. Landlor�}eases to'�enani the property described above at the
location shown on attached EXHIBTT A, which exhibit is made a part hereof. The property is to
be used for the purposes of housing a temporary sales facility from which the sale of state�
Legall.4G (Class C) consumer fireworks and novelty items will be conducted in accordance with
appiicabte faw. I.andiord specifically gives pertnission to the'�enaut to tocate a temporaiy stand,
kiosk or tent on the property, which stand, kiosk or tent will be the vehicle from which the
products will be sold. Such consumer fireworks shali not be lit, "set off', activated or otherwise
used at the property or adjoining center.
T�RM. The term is for the�eriod:June 23rd,2017 through July Sth,2Q 17.

REN'T. Tenant agrees to pay rent to the Landlord in the aggregate amount of TWO
THOUSAND DOLLARS{$2,000.00)per year,for the property named above vnder site

TENANT'S PROPERTY. All of Tenant's personat property shatl be on the teased
property at Tenant's sole risk.

OPERATORS. The Landiord acknowtedges that the Tenant sometimes s�zblets the sa�e of
the fireworks to independent operators. Landlord approves of all such arrangements, provided
that the Tenant is not relieved from any obligations hereemder.Tenan,t shall be the only temporary
stand, kiosk or tent engaged in firework sales on property at ali times during the duration of this
iease.
�TSUItANCE. Tenant shaE�provide generat liability insmance covering the Tenant's,and �
its subcontractors, use and occupation of the property's, including, without Iimitation, product
liability, bodily injury, personal injury and property damage, on an occurrence basis, with
coverage in the aggregate amount of TWO MILLION DOLLARS {$2,000,000.00). The
insurance shatt aame the Lanc�fiord as an ad�tionat insured under Tenant's insurance po�icy "�s
Landlord's interest may appear." Prior to occupancy, Tenant shall deliver a Certificate of
: Insurance to Landlord evidencing the insurance required hereunder.
INDEMNTTY. Tenant shall indemnify and hold the Landlord harinless from any claums,
inctuding attorneys' fees,in connection with any injury or dama$e caus$d to any person or
property aristng out of Tenant's use or occupancy of ihe pmperty nr any brea.ch by tenant af this
. agreement.
SURRENDER OF PROPERTIES& RIGHTS. Tenant agmees to surrender possession of
the property to the Landlord upon ternunation of this agreement in as good condition and repair as
tlxe same sh�ll lse vn tlxe ctate Ten�nt �tst occnpies the progerties under this lease agr�tn�nt --
ORDINARY WEAR AND TEAR EXCEPTED. The Tenant shall make any and alI repairs
necessary to restore any portion of the property where such restoration is necessitated by the
Tenant's use of the property.
CHANGE IN LAW. In the event chat the sale of consumer fueworks is prohibited for any
pc�rtis�n of the term by any l�vel of judicial, l�gisslativ�or executive law,order,rule or regulati4n,
Ehis lease sha11, upon notice from the Tenant�t�e i.andlc>rd,terminate,whereuport any advanced
rental payment shall be returned to the Tenant on a pro rata{number of days of term occupied)
basis and the Tenant shall be relieved from any further liability hereunder.
�ERlt�fiTTINE's. �lris agrcerttent is ccmtin�nt upon'�'e�taztt securin� a� requir� �
and state iicenses and permits to sell I.4g(Class C)consumer fireworks on the leases premises. Xf
Tenant is unable to s�cure such license and permits this lease agreement will become null and
void. Tenant shall not take possession of the property until such required Iicenses and permits
have been secured.
PROPERTY. If the property is i��essible or u�u�ab�e�iue ta Const.ruc�o�oF t�le IiIG�,
then this Iease is su�sject to revision.
ENTIRE AGREEMENT. This lease agreement and any incorporated exhibits or
attachments contain alt of the agreements between the parties and cannot be modified in any
�atmeF other tk�an by at�agt�ee�eaat si�ed by t�e�at��es wi��#�e same fo�al�t�es attenc}a�E to t�e
execution of this lease agreement. Each agreement, term and provision of this lease agreeement
shall be construe�to be a pzomis$,covenant and condition.
PROVISIONS BINDING. The agreements k�erein shau be binding upon and inure to the
benefit of the heirs,executots,administratois,personal representatives,successors and assigns of
t�e parries.
