RE: Exterior Storage Violation
3435 Shoreline Drive
City staff received a complaint regarding garbage storage at 3435 Shoreline Drive. On
March 5, 2013, City Staff performed a property inspection at the above address. During the
inspection Staff noted an over-flowing garbage dumpster and a boat trailer tocated on the south
side of the building.
Long-term storage of garbage, refuse and litter is not permitted per City Code Section 54-32(3).
Exterior storage of boats and boat trailers is not a permitted use in the B-1 Zoning District. This
letter will serve as your notice that the property must be brought into compliance by
March 25, 2013 in order to avoid legal action by the City. In order to bring your property into
compliance the dumpster must be emptied and the trailer must be removed from the property or
stored in an enclosed building by March 25, 2013.

Sec. 54-32.-Storage.
(a) It is unlawful for any person to store refuse on residential dwelling premises for more than one week. All
such storage shall be in five- to 50-gallon metal or plastic containers with tightfitting covers, which shall be
maintained in a clean and sanitary condition. Tree leaves, weeds and grass clippings may be stored in
plastic bags and tree limbs must be stored in bundles weighing no more than 75 pounds and no longer than
four feet.
(b) It is unlawful for any person to store refuse on multiple dwelling premises for more than one week. Such
storage shall be in containers as for residential dwelling premises; except that containers, sometimes
referred to as dumpsters,with closefitting covers may be substituted.
(c) It is unlawful for any person to store refuse on commercial establishment premises for more than 48 hours.

(d) It is unlawful to store organic refuse unless it is drained and wrapped.
(e) All refuse and garbage deposited in containers for pickup must be kept behind the yard setback line for the
district in which the property is located. Refuse must be deposited at one place, at ground level, on each
property. Refuse containers must be returned and placed behind the yard setback line by the owner or
tenant on the same day that the garbage or refuse is collected. The intent of this subsection is to allow only
on the prior evening and the day of collection the garbage or refuse container to be in front of the yard
setback line.

Sec.58-1. Maintenance of private property.
(a) It is the duty of the owner of every vacant property and the owner and occupant of every occupied
property to maintain the property in a neat, clean and presentable manner free of any junk, debris,
refuse, litter, dead trees, or noxious weeds, and to remove all other public health or safety
hazards from the property.
(b) The owner or occupant of every lot or parcel shall regularty cut or otherwise maintain all grass
and weeds on the property at a height of not more than six inches.
(c) Any violation of this section is declared to be a nuisance and a public safety and welfare hazard,
and upon seven days' written notice to the owner, as shown by the records of the office of the
county auditor, of private premises on which such material is found or any conditions in violation
of this code section exist, the city may remove such matter or correct any conditions in violation,
and certify the cost of such removals or corrections as any other special assessment.

Sec.78-643.Permitted uses.
Within any B-1 retail sales business district, no structure or land shall be used except for one of the
following uses or uses deemed similar by the council:
(1) Retail and service businesses. The following neighborhood retail sales and service businesses
supplying commodities or pertorming a service primarily for residents in the surrounding
neighborhood:
a. Arts and school supplies store.
b. Banks and insurance companies.
c. Barbershops and beauty shops.
d. Bicycle sales and repair.
e. Books, magazines, record shop.
f. Drugs, candy, ice cream, soft drinks, cosmetics and other usual drugstore merchandise.
g. Dry cleaning and laundry pickup stations, including incidental pressing and repair.
h. Garden supplies, florist shop.

j. Hardware store, paint store.
k. Hobby shops, camera and photographic supply stores.

y. Sporting goods store.
z. Tailor shops.
aa. Temporary sales, such as Christmas tree lots.
bb. Travel bureau.
cc. Variety store.
dd. Wearing apparel store, shoestore.
ee. Off-sale liquor store.
ff. Home and garden equipment rental.
gg. Massage therapy centers.
(2) Municipal buildings. Municipal buildings where the use conducted is customarily considered to be
an ofFce use.
