the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of 180 days at any time after work has commenced.
The applicant is responsible for assuring all required inspections are
requested in conformance with the State Building Code.This permit may be
revoked at any time for e cause.

violation;

LEASE MODTFICATION AGREEMENT
� This Lease Modification Agreement,made and entered into this day of�1ati_2011,by
and between Brook Investment Group, LLC, hereinafter referred to as "Landlord" and O'Reilly
Automotive Stores, Inc., hereinafter referred to as "Tenant".
WITNESSETH:
Whereas,under Lease dated November 12,2010,(hereinafter"the Lease"),Landlord leased
to Tenant the premises located at 3423 Shoreline Drive,Orono,MN,as more particularly described
in"the Lease"and on the terms and conditions set out therein, and;
Whereas, the parties hereto desire to amend, modify, and supplement the Lease such as to
modify Section 14, replace the existing Exhibit B-2 and add Exhibit B-3.
Now therefore,in consideration of the promises,covenants and agreements hereinafter set out
it is agreed by and between the parties as follows:
1. Landlord and Tenant mutually agree to delete the existing Section 14 in its entirety and
replace with the following:
Tenant shall be allowed to install its national sign, logo and color to the front exterior
surface of the Demised Premises,as shown on Exhibit B-1 and shall also have the option
of placing its prototypical red background behind Tenant's building signage,as shown on
the attached Exhibit B. Landlord grants Tenant the right to construct a multi-tenant sign,

2. Landlord and Tenant agree that the attached Exhibit B-2 shall replace the existing B-2.
3. Landlord and Tenant mutually agree to add the attached Exhibit B-3.
4. All sections,paragraphs,provisions,covenants and agreements set forth and stated in the
Lease as amended which are not specifically altered,amended or supplemented hereby
are ratified by the parties hereto and shall remain in full force and effect.

day and year above written.
