(Lunds) at the Lunds Navarre site, located at the address referenced above (the Site),did not constitute conduct that woutd associate Lunds with the release or threatened release of hazardous substances, pollutants or contaminants at the Site for the purpose of Minn.Stat.§ 1158.03,subd.3(4) (2014). ' The Minnesota Pollution Control Agency(MPCA) staff in the Voluntary Investigation and Cleanup(VIC) Program has reviewed the documents submitted for the Site.The Site is comprised of 3.15 acres of land originally developed in the 1930s through the 1970s for commercial purposes.The Site has been historically occupied by an automobile filling station,automobile sales and service,a drycleaner,an office, and a restaurant. In 1976 the Site was re-developed as a grocery store that remains in use today. Lunds has been leasing and operating the Site since 2003. Several sub-surface investigations were completed at the Site in 2015. Multiple borings identified tetrachloroethene(PCE),trichloroethene (TCE}, and vinyl chloride in soil vapo�at varying concentrations greater than regulatory values at several locations across the Site.Additionally,three sub-slab samples within the building footprint identified PCE,TCE,and vinyl chloride in soil vapor at concentrations less than their respective industrial intrusion screening values. For the purposes of this letter,the identified release is comprised of PCE,TCE and vinyl chloride in soil vapor(the Identified Release). Based upon a review of the information provided to the MPCA VIC Program,and subject to the ' conditions set forth in this letter, a determination is hereby made pursuant to Minn.Stat. § 115B.178, subd. 1(b)that the past actions (Past Actions)as described in a letter from Adam Zobel of Wenck Associates, Inc. to Andrew Nichols of the MPCA, dated August 7,2015 (Past/Proposed Actions Letter), and as described in the Affidavit of Jennifer Kent (Affidavit) will not associate Lunds with the Ms.Jenifer Kent Page 2 October 19,2015 Identified Release for the purpose of Minn.Stat.§ 115B.03,subd. 3(4)(2014).This determination is being sought for lunds and the determination is retroactive to the date that Lunds leased the Site.This determination applies to the following Past Actions: • Leasing of the building and grounds since 2003;and • Operation of the Site as a grocery store. Based upon a review of the information provided to the MPCA VIC Program,and subject to the conditions set forth in this letter,a determination is hereby made pursuant to Minn.Stat.§ 115B.178, subd.l(a)that the proposed actions(Proposed Actions)as described in the Past/Proposed Actions Letter will not associate Lunds with the Identified Release for the purpose of Minn.Stat.§1156.03, subd.3(4)(2014).This determination applies to the following Proposed Actions: • Purchase of the Site; • Continued operations at the Site as a grocery store;and • Future re-development of the Site under a MPCA approved Response Action Plan(RAP). The representations made in the Past/Proposed Actions Letter and Affidavit are accurate and the Past Actions were carried out as described in the Past/Proposed Actions Letter and Affidavit; . 2. The Proposed Actions shall be carried out as described in the Past/Proposed Action Letter; 3. Lunds shall cooperate with the MPCA, its employees,contractors, and others acting at the MPCA's direction,in the event that the MPCA takes,or directs others to take, response actions at the Site to address the Identified Release or any other as yet unidentified release or threatened release of a hazardous substance, pollutant,or contaminant, including, but not limited to,granting access to the Site so that response actions can be taken;and 4. Lunds shall avoid attions that contribute to the Identified Release or that interFere with response actions required under any MPCA-approved response action plan to address the Identified Release. Pursuant to Minn.Stat.§1156.178,subd.l,when Lunds takes the Proposed Actions in accordance with the determination in this letter,subject to the conditions stated herein,the Proposed Actions will not associate Lunds with the Identified Release for the purpose of Minn.Stat. § 1158.03,subd.3(4)(2014�. The MPCA staff in the VIC Program has reviewed the documents submitted for the Site.The Site is comprised of 3.15 acres of land originally developed in the 1930s through the 1970s for commercial purposes.The Site has been historically occupied by an automobile filling station, automobile sales and service,a drycleaner,an office,and a restaurant. In 1976 the Site was redeveloped as a grocery store that remains in use today. Lund Food Holdings, Inc. has been leasing and operating the Site since 2003. Several sub-surface investigations were completed at the Site in 2015. Multiple borings identified tetrachloroethene(PCE),trichloroethene(TCE),and vinyl chloride in soil vapor at varying concentrations greater than regulatory values at several locations across the Site. Additionally,three sub-slab samples within the building footprint identified PCE,TCE,and vinyl chloride in soil vapor at concentrations less than their respective industrial intrusion screening values. For the purposes of this letter,the identified release is comprised of PCE,TCE and vinyl chloride in soil vapor(the Identified Release). Based on a review of the information provided to the MPCA,a determination is hereby made to take no action with regard to the Identified Release; specifically,the MPCA staff will not refer the Identified Release to the U.S. Environmental Protection Agency for inclusion on the Comprehensive Environmental Response, Compensation and Liability Information System list,to the State Site Assessment staff for evaluation, or to the MPCA Commissioner for the placement of the Site on the Permanent List of Priorities. This determination is based solely on the results of the soil vapor investigation conducted on the Site.
