DECLARATION OF
RESTRICTIVE COVENANT
This Declaration is made the�-day of 1999, by Douglas M.
Head and Martha Head, husband and wife, and Sarabelle H. Bosanko a/k/a Sally H.
Bosanko and Michael Bosanko,husband and wife,hereinafter referred to as "Declarants".
WITNESSETH:
WHEREAS, Declarants are the owners of certain property in the City of Orono,
' County of Hennepin, State of Minnesota, which is more particularly described on Exhibit
A attached hereto and made a part hereof("Property").
WHEREAS,pursuant to City of Orono Resolution of the City Council No. 4341,
the City has agreed to extend municipal sanitary sewer service to the Property provided
that Declarants place these restrictive covenants on the Property.
WHEREAS, Declarants desires to establish certain restrictions for the Property
relating to limitation of the future development of the property and the maximum number
of dwelling units to be constructed and maintained on the Property.
NOW THEREFORE, Declarant hereby declares that the Property shall be held,
sold and encumbered subject to the following restrictions and covenants:
1. There shall be no more than two dwelling units constructed and
maintained on the Property at any time.
2. The Property shall not be subdivided into any more than two buildable
lots.
3. This covenant may only be amended or terminated with the written
consent of Declarants, their successors and assigns, and the City of Orono.
4. The City of Orono may enforce this restriction and may seek judicial
enforcement of it.

5. This covenant shall run with the Property and be binding on Declarant's
successors and assigns.
