Dear Jerry:
I am writing this letter in regard to work that was done in the right-
of-way at the above subject property. In 1989 a new house was
constructed on the property. When excavation work was being done for
the septic system, the contractor discovered an eight inch pipe buried
about 6'+ in the ground. The pipe had an intermittent water f low that
smelled like swamp water. An investigation of the site and
surrounding area was conducted to locate the source. No source could
be located. It was decided that the pipe would be plugged to stop the
water flow. If water backed up somewhere, then we could locate the
source. Time passed and there was no backups or complaints from
neighbors. Then the owner of the new home (Bruce Boni 473-4638 )
started experiencing water problems in his basement. He called the
septic instal ler (Patnode Bros 420-3793) and had him connect on to the
pipe and run it to the road where it dumps the water on the shoulder.
It then runs to a storm sewer and under the road (see attached
diagram). This work was done without the City's approval and without
a permit or inspections.
The City at this point does not have a problem with the work and feels
it was necessary to alleviate a problem. At this time it is not
causing an erosion problem but when the ground thaws it may. The pipe
could be run underground to the culvert that runs under County Road

Outlet of Private Water onto Right-of-Way
Dear Mr. Oman:
Based on your let�er dated February 6, 1992, and allowing staff to study
the situation, we see problems within the right-of-way caused by the water
being dumped at its present location. In extremely cold weather, the
water would be a source of ice buildup reaching the traveled portion of
CSAH 15, creating a hazard and an unnecessary maintenance problem. The
problem of erosion also exists. Allowing the water to run off at its
present location is detrimental to the public welfare.
Re-routing the private plastic drainpipe (all on private property) so that
it would daylight and flow into the existing 24" culvert at the southeast
corner of Mr. Boni 's property, would avoid these problems. This work
would not require a county permit and would be at the property owner's
expense.
We see this as an adequate solution to the situation which will serve all
parties well . We would like to see this work done as soon as weather
permits. Please advise us of the time schedule when it is established.
