necessary to provide access to the handicapped, the Board may permit a variance from the requirements of the
Code, or may require a variance from what is otherwise permitted the Code provided that such variance with
whatever conditions are deemed necessary by the Board, does not adversely affect the purposes of this
ordinances, the public health, safery, and welfare, and reasonable access to or use of the Lake by public or

FINDINGS
On November 12, 2014, at 7:00 p.m., pursuant to due notice, a public hearing was held
by the Lake Minnetonka Conservation District ("LMCD") Board of Uirectors at the Wayzata
City Hall in the City of Wayzata, Minnesota. The hearing. was��ield to consider the
application by Berta Kvamme ("Applicant") for a dock length,variance for property at 2050
Shoreline Drive in the City of Orono(the "Site"). � �� �

The Applicant seeks a length variance for construction`of a docic�t�the Site, which has
approximately 291 feet of shoreline at elevation 929:4 NGVD. The varian�e requested is to
authorize construction of a dock extending 200 feet from the shoreline at �le�ation 929.4
NGVD.
The hardship cited by Applicant as justification for,t[�e variance is shallow water in the
dock use area. The Applicant submitted evidence that it is'necessary to extend the dock 200
feet from the shoreline to reach a depth of 4.8 feet of water when the lake level is at elevation
929.4 NGVD. � � � �`-�

The dock depicted on the site plan proposed by the Applicant, which is attached at
Attachment One and hereby made a part of these findings, will conform to side setback
requirements along both sides of the dock use area for the Site.
The Board finds that the shallow water at the Site is a hardship within the meaning of
LMCD Coc��, 5�c�ti4�n 1.07 and that granting the variance requested on the conditions
hereinafte�``'set forth, i�,��i,t�,sistent with the spirit and intent of the Code.

The a dock lengfh variance for construction of a dock extending 200 feet from the
shoreline at elevatioriW929.4 NGVD is granted subject to the following conditions:
a. The dock shall be constructed and maintained in conformance with the site plan
attached as Attachment One.
b. The dock structure at the Site may not be used to moor or store more than three
restricted watercraft as defined in the LMCD Code, Section 1.02.

The issuance of this variance shall grant no vested rights to the use of Lake
Minnetonka. Such use shall, at all times, remain subject to regulation by the District to assure
the public of reasonable and equitable access to the Lake.
