Schiefelbein on March 23, 1990 . The Order was executed by Judge Schiefelbein on March 27, 1990 . A copy of the Order is enclosed. A Discharge Notice of Lis Pendens, and the Agreement were sent to Hennepin County the week of March 26, 1990. Once we obtain confirmation of filing dates and document numbers, we will transmit �that information to you. I would like to point your attention to items 3 ( f) and 3 (g) of the Agreement which require follow-up action by the City. Item 3 ( f ) requires Smith ' s Bay to engage a licensed electrician and licensed furnace technician to make inspections at the cabins and s , �iy I k ! Smith ' s Bay has fifteen (15 ) days within the date of the Agreement to contract with the licensed tradesmen. Within thirty (30 ) days of the inspection, any repairs itemized must be made. Item 3 (g) requires Smith ' s Bay to contract with a septic disposal company to pump the tanks for the cabin. The City is to be provided with a copy of the contract . This Agreement outlines repairs and subsequent razing and removal of the three cabins located upon your client ' s property in Orono . We are now approaching June, 1, 1991, which is listed as the "termination date" per Item No . 3 (a) of the Agreement . Within two weeks of the termination date, your client is to remove the cabins at his expense, disconnect all services and utilities, remove all debris and restore the site to a reasonable condition including seeding or sodding . Should your client not raze the cabins and remove the debris per Item No . 3 (a) of the Agreement, Item No . 3 (b) authorizes the City to pertorm 'tne task and aSSc�S its costs against the property to be payable in a single year . It is possible that your client is already preparing for the razing and removal of these buildings . The City and Smith' s Bay in mutual consicleration 17ereby agree as follows : a . The City agrees to permit the cabins to remain, tipon the conditions stated herein, until June 1, 1991 (hereinatter the "termination date" ) . Within two weeks of the termination date, Smith' s Bay shall remove the cabir►s at its sole and complete expense . Removal shall include destruction of the cabins ( including foundations) , all appurtenant structures such as porches and landings, prooer disconnection of all services and utilities , removal of all debris, and restoration of the cabin sitt�s co a reasonable condition, including seediny or_ so�uinc; , Smith ' s Bay shall have vacated all tenants and any personal property from the cabins by the termination date. Smith' s Bay shall provide any necessary notice to tenants or other persons, and shall obtain all necessary permits and approvals, so that removal can be completed in accorclance with the terms of this Agreement . b. Should Smith' s Bay not beqin or complete removal within two weeks of the terminatiun date, the City is expressly- atithorized to enter upon the property wi�hout r�oti.ce at any time to raze and remove the cabins . Rem�val in this case shall include the same elements ;lescribed ir� the previous paragr�ph. Smith' s Bay shall repay the City for any and all costs, includiny attorney' s fees, incurred in rernoving the cabins, to be collected as an assessment against the property payable in a single year . Said assessment may be imposed without notice or hearing or other process and Smith ' s Bay expressly waives any right thereto . c . Within 15 days of the date of this Agreement, the City :�hall initiate dismissal without prejudice of the current: Yiazardous b��ilding proceecJing against the cabins . A copy of said contract shall be provided to the City. The tanks shall be monitored weekly and shall be pumped as needed to avoid any septic discharge. h. Smith' s Bay will report to the Building Inspector any material change in the condition of either Cabin 1 or Cabin 2 durin.g the pendency of this Agre�rneti�. . �m�.f�?i ' s Bay agrees to subr�it i:o per:iodic external and internal inspection of tne cabins upon reasonable notice. This does not waive the City' s lawful right to enter the ptoperty without notice should , conditioris warrant . i . Smith' s Bay agrees to pay all City costs, charges, ati:orney' s fees, and any other expenses incurred in enforcing this Agreement or any part thereof . j . By this Agreement the City does not waive any of its poiice power authority to regulate conditions related t;o the property or the cabins . Nothing in this Agreement precludes the City from initiating a hazardous building action against the cabins should conditions arise posing a threat to health and safety which did not exist or which the City was not aware of as of the date of this Agreement . 4 . Mi_seellaneous . This Agreement contains the entire agreement between tlle parties pertaining to the subject matter herein and shall be modified only by written agreement signed by the partie� . Toberman' s property, which were to be removed by June 14 , 1991, are still located upon the property. You will recall from our letter dated May 22 , 1991, that we asked you to remind your client of the Agreement he signed on February 12, 1990, which, among other things, required removal of the cabins on the property by June 14 , 1991, at Mr . Toberman' s expense. In the alternative, the Agreement allows t?�e City to enter the property and raze and remove the cabins . All costs involved in this process would be assessed as a lien against Mr . Toberman' s property. At this juncture, the City is obtaining bids for the razing and removal of the cabins . It is the City' s intention to have the work completed as soon as possible. On June 20, the City received a letter from Ms . Cynthia Johnson of Toberman Management, requesting a demolition permit .
