As requested, we have reviewed the Vegetation Management Plan for 1910 Shoreline Drive. We offer the
following observations, comments and recommendations for your consideration.
l. The Vegetation Management Plan prepared by Arrowhead Environmental Consulting, dated
September 1 l,2012 is acceptable.
2. The Certificate of Survey prepared by Sathre-Bergquist should be revised to indicate a 50' wetland
buffer and a 20' building setback from the buffer.

Dear Melanie:
As requested, we have reviewed the wetland boundary and buffer area at 1910 Shoreline Drive. We offer the
following observations, comments and recommendations for your consideration.
1. I reviewed the wetland boundary and buffer in the field on August 30,2012 and agree with the
wetland boundary as marked. However, final approval of the wetland boundary is the responsibility of
Minnehaha Creek Watershed District(MCWD). A copy of any permits and approvals required from
MCWD should be submitted to the City prior to any land disturbing activities.
2. The proposed construction has the potential to adversely impact the wetland which will trigger the
wetland protection ordinance requirements. Therefore,the following should be considered:
a. This wetland is listed as a"preserve"wetland in the MCWD's Functional Assessment of
Wetlands inventory, which requires a 50 foot buffer per City code.
b. Common buckthorn, Tatarian honeysuckle and Garlic mustard were found in the wetland
buffer area and are considered to be invasive plant species. Any invasive plant species found
within the buffer area must be removed. Therefore, a Vegetation Management Plan including
methods for removal and control of all invasive plants should be submitted for review.
c. Wetland Buffer markers should be placed at the upland boundary of the buffer edge located at
lot lines and changes of buffer edge direction and spaced a maximum 200 feet apart.
d. A $2,000 escrow should be submitted by the Owner to cover the cost of buffer development if
not completed by the applicant.

Specie Management Plan for the proposed Wetland Buffer related to your project at 1910

Wetland Buffer Management
Non-native species, most notably common buckthorn (Rhmanus cathartica) will be
managed within the existing buffer area. Buckthom with stumps 1.5" or greater will be
cut and the stumps treated with an appropriate herbicide (glyphosate or triclopyr, any
work within the wetland area will require aquatic safe herbicides). Smaller buckthorn (5'
in height or less) will be treated with a foliar spray or pulled by hand. A foliar spray
should occur in the fall (ideal time is between September 15`t'—November 1S`). The cut-
stump method should be performed any time after September 15th and before March 15th.
Garlic mustard (Alliaria petiolata) is problematic as well; garlic mustard can be sprayed
in the fall as well as in the spring (preferably before May ls`) with a non-selective
herbicide containing glyphosate.

management(2012-2013).

Once the buckthom and garlic mustard aze eliminated the area should be lightly tilled and
re-seeded with a native seed mix (mesic forest short-grass/forb mix). Native shrubs/trees
can be planted as well,if desired by the landowner.
The buffer will be maintained with standard practices such as occasional mowing and
herbicide treatment. A full management plan will be developed by the seeding
contractor.

I have reviewed the survey for the proposed new house at 1910 Shoreline Drive and have the following
comments:
• There is a sanitary sewer main and presumably an easement in the front yard of the property which is
not shown on the submitted survey. This should be reflected on the survey.
• The benchmark elevation is from Minnehaha Creek Watershed District as measured on August 31,
2009. This should be based on the lake levels the day the survey was taken and not an elevation from
3 years ago.
• Earthwork calculations show more than 500 CY of material will be disturbed which would require a
CUP.
• Wetland delineation needs to be reviewed and approved.

BUILDING PERMIT ESCROW AGREEMENT
Orono Building Permit#2012-00828
AGREEMENT made this ��ay of , 20�by and befinreen the CITY OF ORONO,
a Minnesota municipal corporation ("City") and ' d ("Owners").
Recitals
1. A building permit application has been filed for a building permit located at 1910 Shoreline Drive,
the ("Subject Property"), legally described as Tract C and Tract D, RLS No. 96, according to the recorded plat
thereof, Hennepin County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the Ciry to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the wo�lc (including planning,
engineering, or legal consultant review) associated with building permit #2012-00828 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consuftant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe ouUined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written not�cation is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

WETLAND BUFFER ESTABLISHMENT ESCROW AGREEMENT

a Minnesota municipal corporation ("City")and�;_,_d i �F�,r,�����.,r,,•ski ("Owners").
Recitals
1. A building permit application has been filed for a new home located at 1910 Shoreline Drive, the
("Subject Propert�'), legally described as Tract C and Tract D, RLS No. 96, according to the recorded plat thereof,
Hennepin County Minnesota.
2. The City has reviewed and approved this application.
3. The scope of the project which is the subject of building permit #2012-00828 triggers the
application of the City's wetland buffer requirement as established by City Zoning Code Article XI Wetlands
Protection will commence its review of the application and incur costs associated with said review only if the
Owner establishes an escrow to ensure reimbursement to the Ciry of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS: .

the wetland buffer. The escrow wifl also guarantee reimbursernent to the City for all out-of-pocket costs the City
has incurred associated with pertnit #2012-00828 if compliance with the wetland buffer establishment is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
