A RESOLUTION GRANTI\-G VARIANCES
TO MUNICIPAL ZONLti'G CODE
SECTION 78-282,AND SECTION 78-305,SUBDIVISION B
FILE NO. 03-2953 �
WHEREAS, Raymond K. Newkirk and Nylene J. Newkirk, husband and
wife (hereinafter "the applicants") aze the owners of the property located at 1489
Shoreline Drive within the City of Orono (hereinafter the "City") and legally described as
follows:
Lots 3 and 4,N J Stubbs ls` Subdivision Lot No 2, Hennepin County, Minnesota
(hereinafter the"property"); and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-282 to allow a hardco�-er
. level of 35.7%where 25% is normally allowed in order to construct a new home.
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-305, Subdivision B to allo«�a
new residence to be construcuted on a lot with substandazd lot area and lot width.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Minnesota:
� FINDINGS
1. This application was reviewed as Zoning File#03-2953.
2. The property is located in the LR-l:� Zonirig District, �vhich requires a
minimum lot are of 2.0 acres and 200' of width.
3. The Planning Commission reviewed this application at a public hearinas
held on October 20, 2003 and No��ember 17, 2003 and recommended
� approval of the lot area, lot width and hardcover variances based on the
following findings:

a. The property ha�a total area of 0.71 acre and 132' of lot width.
b. A hardship exisU with respect to driveway hardcover due to the nature
and location of the shared drivewav and the inabilitr to park vehicles
along County Road 1�. � '
c. No additional land is available for acquisition by the applicants to
make the propem-conforming in area or width.
d. The property is::rved with municipal sewer.
e. The combination of 2 lots with a total lot size of 0.71 acre is typical of
lots in the immediate neighborhood. �
f. A single famil�- residence can be constructed on the property without
the need for further variances.
• 4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the aFplicants and the public, and the effect of the proposed
variance on the healw, safety and welfare of the communit�-.
5. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other propem- in this zoning
- district; that granti.na the vaziance «•ould not adversel�• affect traffic
conditions, light, air nor pose a fire hazard or other danaer to neighboring
property; would not merely serve as a convenience to the applicants, but is
necessary to alleviat: a demonstrable hardship or difficuln-; is necessary to
preserve a substantial property right of the applicants; and would be in
keeping with the spli�it and intent of the Zoning Code and Comprehensive
Plan of the City. '
COVCLUSIO�S, ORDER AND CONDITIO\S
Based upon one or more of the above findings,the Orono City Council hereby '
grants a variance to Orono MuniciFal Zoning Code Section 78-282 and 78-305
Subdivision B to allow construction of a new residence on the 0.71 acre property and
hardcover level within the 7�'-2�0' setback to be at 3�.7%where 25% is normally
• allowed, subject to the follo�ving conditions:

1. Council approval is based on the site plan submitted by the applicants and
annotated by City staff, attached to this Resolution as Exhibit A. Any
amendments to the site plan�vh.ich are not in conformity with City codes will
require further Planning Commission and City Council review.
2. Hardco�er in the 0-75' zone shall not increase above 0%. Hardcover in the 75-
250' zone shall be limited to 3�.7%. or 7,575 s.f. per the proposed plan and
hazdco�•er allowance summary as depicted on Exhibit A. Applicants are advised
that any-future requests to increase hardcover or change the nature of
existinQ'approved hazdcover shall require City approval, and increases in
hardco�-er will not likely be approved without concurrent reduction in existing
hardco�-er.
3. Applicant shall remove all plastic or fabric liner material from the decorative
� landscape beds on the propert�-to ensure their permeability as non-hardcover
• surfaces.
4. Required removals of structure and hardcover shall be completed by the footing
inspection for the new residence.
5. Authorities granted by this resolution run with the property not with the applicant,
but are permissive only and must be exercised by obtaining a building permit for
the ne��-construction within one �-ear of the date of Council approval, or the
variance will expire on that date (November 24, 2004). .
6. Violation of or non-compliance��-ith any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically �
terminate any authority granted herein, and shall be punishable as a misdemeanor.
7. The undersigned applicant has read, understood and liereby agrees to the terms of
this resolution and on behalf of the applicant and the applicant's heirs, successors -
and assi�s, hereby aarees to the recording of this resolution in the chain of title
of the property.
Adopted by the Orono City Council on the 24th day of November, 2003.
