Project Description: The applicant has submitted new multiple dock and special density license
applications to reconfi�ure the conformin�ple dock facility on Browns
Bav and Tana�er Lake. The applicant has proposed to widen existin�
Storage Units (BSUs) or slips to make them more usable. Thev are proQosing
to install a new dock alon�; the breakwater on Browns Bay and relocate
displaced BSUs on this dock. The overall number of BSUs is not proposed to
increase from 114. The special densitv license application has been submitted
to update the public amenities that thev will provide.

Dear Mr. Harper:
Thank you for providing the City of Orono the opportunity to review the above referenced
application.
The City of Orono has historically licensed this marina site for 114 slips - 66 on Tanager Lake
and 48 on Browns Bay. It appears that the net number of slips will not be increasing beyond the
existing level of 114. Further, the proposed site plan reduces the number of slips on Tanager
Lake from 66 to 56, and increases the number on Brown's Bay to 58. Because virtually all
vehicle parking serving this marina is on the Browns Bay side of CR15,this potentially reduces
by 15%the amount of pedestrian traffic having to cross CR15, which we see as a benefit of the
proposed configuration.
To the extent that the currently proposed amenities in support of the Special Density License
differ from those approved in 1990, we would recommend that all amenities listed in the 1990
approval continue to be provided.

IN RE: APPLICATION OF MINNETONKA BOAT WORK3 (ORONO)
The hearing on the application for a special density license and new dock
license for the Minnetonka 8oat Works was held at 7:30 a.m. on April 8, 1989, at
the Lake Minnetonka Conservation District offices, City of Wayzata. The
Applieant was represented by Mr. Byron Heimark and Ms. Beth Whittaker.
The Applicant owns property in the City of Orono having frontage on
Brown's Bay and on Tanager Lake. Applieant seeks approval to expand its facilities
from 41 to 47 boat storage units (BSUs) on 8rown's Bay and from 25 to 67 BSUs on
Tanager Lake. The property has 3310 feet of frontage, ineluding a breakwater.
Counting the frontage of the breakwater, the proposed facility would provide one
slip per 29 feet of frontage. Without the breakwater frontage there would be one
slip per 19 feet of frontage. In either ease, the proposed is well within the
maximum density allowed under LMCD Code, 3ection 2.05. The amenities
proposed by the Applicant changed during the course of consideratton of this
mattec, partly in response to concerns expressed by the LMCD, the City of Orono
or the public. The final proposal is as set forth in the following Order.
Owners in the victnity of the proposed facility expressed concern about
additional boat traffie on Tanager Lake and the Channel between Tanager Lake and
Brown's Bay with the associated impact on aesthetles and safety. However, the
Board finds that the review criteria of LMCD Code, Sections 2.03 and 2.05, are
met and that the amenities hereinafter set forth are suffteient to justify issuance
of a speeial density ltcense for the proposed facility.
j The District has prepared an Envlronmenta! Assessment Worksheet for the
proposed facility and has concluded that�the construction and maintenance of the
facility will not have a significant adverse environmental impact.

, ORDER
On the basis of the forego[ng, it is ordered that a new dock license and
special density license be granted to the Appltcant on the following conditions:
1. The license9 are granted for construction and maintenance of facilities for
47 83Us on Hrown's Bay and for 67 83Us on Tanager Lake in accordance
wtth the dock plan attached hereto as Attaehment One and hereby made a
part of this Order.
2. The llcenses are condittoned on the continuing maintenance of the following
publie amenitIes, each of whIch has been suggested and agreed to by the
Applicant.
a. One slip shall be maintained for use by the Sheriff's Water Patrol for
emergency purposes.
b. Licensee shall provlde a boat for charter purposes to groups or

shall annually report on the same to the District.
c. LIcensee shall provide boats with a professional guide for fishing
exeurstons for underprivileged or handicapped children or adults, at

persons, at no charge, and shall annually report on the same to the
District.
d. Licensee shall maintaln a public pay phone.
e. Licensee shall maintain an MCWD approved skimming and ponding
basin for runoff.
f. Licensee shall maintain landscaping on the grounds.
g. Ltcensee shall provide a loading zone for Tanager Lake customers,
allowing such customers to load a boat at the Brown's 8ay facilities
which shall be handlcapped accessible.

h. Licensee shall malntain one additional restroom on Tanager Lake �
side.
i. Licensee shall make available its shop boat for emergeney use by fire
departments which add the name of licensee as an additional insured
on liability lnsurance policIes.
The licenses granted herein shall confec no vested rights to the use of Lake
Minnetonka. All such use is subject to continued regulation by the District to
assure the public of reasonable and equitable access to the Lake.

LeFevere pointed out that an applicant should not be
penalized for an amenity because it is already being
provided. He added that the ordinance states that the
amenity is subject to acceptance by the Board and is not
obligated to accept the amenities the applicant is
proposing.
Grathwol asked if the slips beyond 200 ' has been removed?
Nybeck replied that they have been.
AMENDID VOTE: Motion carried unanimously.

B. Minnetonka Boat Works (Orono) proposed amendment to
� amenities required by Special Density License granted on
9/26/90 .
Nybeck suggested no action be taken by the Board. He
added the amenities approved in the 1990 SDL are

MOTION: Zwak moved, Reese seconded to amend
amenity b of the approved 9/26/90 SDL

people served per season" .

C. Ordinance Amendment, 2nd reading of an ordinance relating
to reconfiguration of non-conforming docks on Lake
Minnetonka; adding new Section 2 .015 to the LMCD Code of
Ordinances .
MOTION: Zwak moved, Reese seconded to approve the
2nd reading of the ordinance.
DISCUSSION:
Reese stated that he still had a problem with using
square footage rather than linear for slip size
measurements. He suggested the Board reconsider the use
of linear measurements because it would be simpler. He
encouraged feedback from the marina owners on their
preference.
