The City of Orono has historically licensed this marina site for 114 slips - 66 on Tanager Lake and 48 on Browns Bay. It appears that the net number of slips will not be increasing beyond the existing level of 114. Further, the proposed site plan reduces the number of slips on Tanager Lake from 66 to 56, and increases the number on Brown's Bay to 58. Because virtually all vehicle parking serving this marina is on the Browns Bay side of CR15,this potentially reduces by 15%the amount of pedestrian traffic having to cross CR15, which we see as a benefit of the proposed configuration. To the extent that the currently proposed amenities in support of the Special Density License differ from those approved in 1990, we would recommend that all amenities listed in the 1990 approval continue to be provided. The Applieant was represented by Mr. Byron Heimark and Ms. Beth Whittaker. The Applicant owns property in the City of Orono having frontage on Brown's Bay and on Tanager Lake. Applieant seeks approval to expand its facilities from 41 to 47 boat storage units (BSUs) on 8rown's Bay and from 25 to 67 BSUs on Tanager Lake. The property has 3310 feet of frontage, ineluding a breakwater. Counting the frontage of the breakwater, the proposed facility would provide one slip per 29 feet of frontage. Without the breakwater frontage there would be one slip per 19 feet of frontage. In either ease, the proposed is well within the maximum density allowed under LMCD Code, 3ection 2.05. The amenities proposed by the Applicant changed during the course of consideratton of this mattec, partly in response to concerns expressed by the LMCD, the City of Orono or the public. The final proposal is as set forth in the following Order. Owners in the victnity of the proposed facility expressed concern about additional boat traffie on Tanager Lake and the Channel between Tanager Lake and Brown's Bay with the associated impact on aesthetles and safety. However, the Board finds that the review criteria of LMCD Code, Sections 2.03 and 2.05, are met and that the amenities hereinafter set forth are suffteient to justify issuance of a speeial density ltcense for the proposed facility. j The District has prepared an Envlronmenta! He added that the ordinance states that the amenity is subject to acceptance by the Board and is not obligated to accept the amenities the applicant is proposing. Minnetonka Boat Works (Orono) proposed amendment to � amenities required by Special Density License granted on 9/26/90 . Nybeck suggested no action be taken by the Board. He added the amenities approved in the 1990 SDL are • currently being provided. MOTION: Zwak moved, Reese seconded to amend amenity b of the approved 9/26/90 SDL Order deleting, •at least three times per year" and addinq, "with minimum of 100 people served per season" . Ordinance Amendment, 2nd reading of an ordinance relating to reconfiguration of non-conforming docks on Lake Minnetonka; adding new Section 2 .015 to the LMCD Code of Ordinances . MOTION: Zwak moved, Reese seconded to approve the 2nd reading of the ordinance. DISCUSSION: Reese stated that he still had a problem with using square footage rather than linear for slip size measurements. He suggested the Board reconsider the use of linear measurements because it would be simpler.
