SUSJECT: James Rivers - 1442 Shoreline Drive
Variance - Lakeshore Setback F Expand Fxisting Non-Confornung, .. &,:

Mr. Rivrs (Windward Marine) is considerin reaching an agreement with '"
hfir. A4cMahan whereby he would lease or purchase Mr. PtcMahan's property to the ' , .,
s north of the Windward Marine. This would include the residence behind Mac's . ' `
' PizzaBuildin. ."
` The existing residence is now anly 38' from the shoreli.ne (Mr. River's measure- `:
ment) . However, the water level is extremely low this year.
   :
IIr. Rivers is requesting approval for an addition to the house (non-conforming
- residence in B-Z Zoe) . The proposed acldition would be 414 sq, ft. in area
and extend 9' coser to the shoreline. This would result in a 29' lakeshore
setback from the present shoreline. I don't have the data as to where the
shoreline wauld be if the water level were at a 929.4 elevation. .

In order to comensate for this additional hardcover, Mr. Rivers has agreed to
remove the existing hardcover surface extending to the shoreline between the
Wu.dwarci Mari.ne building srtd tac's Pizza build.ing. This concrete aspha.lt slab
;, is approximately 2,000 sq. ft in area. Apprcaximately 1,200 sa. ft. of this
slab is located within the 75 shareline setback line. If approved, he woulc3 .
also remove the building that previously was used as Mac's Pizza azid more
recently as a bait shop. ;
In review of th.s proposal, we might consider several cond.itions, boat display
alog the Cty road and the present sewage disposal system for aII buildings.

' No part of this buildi.ng lies witlun the 75' lakeshore setback, but if this
slab is also removed, seepage and filtration would be improved. ` _ ` `
