In that letter you identified the desire to connect your property to the sanitary sewer system at County Road 15. The City has received similar requests from other rural residential land owners where sewer lines run adjacent to their properties. In fact a similar request was made by the previous owner of your property in 1981 after the 80-1 sewer project was assessed and construction plans approved. Resolution #1180 (approved August 1980) excluded the property from the 80-1 sewer project because the property contained approximately 2.9 acres and owner had not elected to join in the project. In 1981, the owner sought two sewer connections so that the 2.9 acre parcel could be subdivided. The City advised that a rezoning application would have to be filed as the property did not contain the required 4 acres in area. The owner never followed through on the rezoning application and later divided off the additional .9 acres for combination with the adjacent Gregory property. You should be aware that in Council ' s review of such requests, that it is the burden of the petitioner or applicant to provide proof that the property is not suitable for septic expansion if a new system was required because the existing system was inadequate or failing. It would be appropriate that you contact a consultant trained in the evaluation of rural properties for potential septic development. Such consultant would provide appropriate soil borings, percolation tests, and analysis of slope conditions on the property to determine if area for septic expansion is available. Your consultant should confer with Michael Gaffron before he proceeds to make the necessary evaluation as part of your formal petition for sewer. . This type of permit application would not only require approval from the City, but also possibly the Metropolitan Council. The on-site septic� evaluation wil 1 play a major part in that review of your application by both the City and Metropolitan Council. You should be aware that the cost of connecting to the municipal sewer for the year 1989 is determined at 56,267.00. This rate increases each year to cover the cost of inf lation. In addition, you would be asked to make a payment of a SAC charge of $575.00. I have reviewed the materials that you provided and I am confused as to why you are suggesting that I '�appeal the language of the variance." It is difficult for me to understand why the City, after reviewing and approving the building permit application and the land alteration permit application that were submitted and found to be in accordance with the zoning ordinance and applicable variance, has decided to change its position on the approval of the work. As I understand the history of this site, in April, 2001, the property owner applied for the re-issuance of a variance that had initially been granted in 1999. The initial variance granted certain exceptions from the City's setback and hardcover ordinances. The City characterized the 2001 application as "renew[ing] the variance as approved by the Council on September 27, 1999." Through the variance, the City found that the '�findings and conditions of Resolution No. 4353 [were] still valid." The City approved the re-issuance of this variance in May 2001. Following this process, building permit applications and land alteration permit applications were submitted to the City for review. As you have noted, the survey that was submitted with the permit applications, and reviewed by City stafF, delineates a bluff line that is different than what you reference in your November 4 letter. The bluff line designation used in all of the permit applications to the City was recognized by both the properly owner and the City, and this recognition was memorialized in a letter dated August 16, 2001, from Keith Waters to Mr. Paul Weinberger, the Planning Director at the time. The August 16 letter explains that the blufF line was staked by Coffin & Gronberg and that the City reviewed and approved the new blufF line location. Based on this, the only issue in question is the 75' lakeshore setback. While I am confident that you are working in the best interest of the City, I am also confident that appreciate the fact that this issue is not completely clear. I remain confused as to why I must"appeal the variance language." I simply do not understand what it is you are asking me to appeal since I am not unhappy with the variance itself. I am even more confused by the City's objections to the work that I have done since the land alteration permit application included a landscape plan showing the bluff, the hardcover and the pond. In your facsimile, you indicate that you intend to take legal action to remove the hardcover that already exists if I do not have an appeal application and all required submittals to the City by Tuesday, November 16"'. Based on the confusion that exists over this matter, I would respectFully request that we schedule a meeting no later than Monday, November 15�', during which I, and my legal counsel, have an opportunity to discuss this issue with yourself, Mr. Moorse and the City's attorney, Mr. Tom Barrett. Obviously, the time deadline that you have imposed requires that we coordinate this meeting immediately. As I explained during our on-site meeting held on November 3`d, the variance and building permit permitting construction of the house did not permit construction of any landscaping. You are correct that a land alteration permit was issued, but the plan submitted and used as a means for approval of that permit did not show any landscaping within 75' of the lake. I've enclosed a copy of that plan for your reference. The reason you were given the opportunity to appeal the variance language is because at our on-site meeting you indicated to staff that your belief was that variance Resolution #4353 gave permission to construct the landscaping. Staff's position is that Resolution #4353 only gave permission for construction of the house in a location encroaching on the required 30' bluff setback, not landscaping. This is why you were given the option of appealing the resolution language in an attempt to receive final clarification from the City Council on whether the resolution permitted landscaping or hardcover within 75' of the lake. Also, Section 78-1288 (a) of the Zoning Ordinance prohibits any impervious surfaces within 75' of the lake (enclosed for your review). Your letter mentions a letter to former City Planner Paul Weinberger dated August 16, 2001 regarding establishment of a new bluff setback line. The City has no record of this letter, and because this letter came after the May, 2001 approval we believe it was never accepted and, because the bluff setback and the 0-75' hardcover limitations are mutually exclusive sections of the code, granting of a bluff setback variance, regardless of the location of the top of the bluff, can in no way be construed as granting a hardcover variance to permit the landscaping. If you w'ish to appeal staff's interpretation of the resolution language you must submit the required materials (noted in the letter from our City offices to you dated November 4, 2004)by November 16�'in order to be heard at the November 22"d City Council meeting.
