• � • • USE PERMIT FOR WILLIAM GREGORY FOR A '
GUEST HOUSE ON A PROPERTY LOCATED AT '
- 1410 SHORELINE DRIVE
WHEREAS , the City of Orono is a municipal corporation organized
and existing under the laws of- the State of Minnesota; and
WHEREAS , pursuant to State Statutes 412 et. seq. and 462 et. seq.
the City Council of the City of Orono has adopted zoning regulations for
the protection of the public heaZth, safety and general welfare; and
WHEREAS , pursuant to Ordinance 34 .027 William Gregory, hereinafter
referred to as the applicant , has applied for a conditionaT use permit to
permit construction of a principal dwelling and a11ow the existing dwelling
to remain as a guest house on the property 1egally described as follows and
hereinafter referred to as the property:
. That part of Government Lot 4, Section 2 , Township
117, Range 23 formerly platted as B1.ocks �5 , 16
and 18 of Orono now vacated, together with a7.1
• vacated avenues , (except that portion of Brackett
Avenue comprising County Road 15 , ) streets and alleys
• abutting and adjoining said blocks . �
That part of Section 2 , Towriship 117, Range 23
lying East of said Bra,^kett Avenue and known and
designated in the plat of Orono, now vacated, as
public reserve which Zies Southerly of the following
described 1ine: Commencing at the meander corner on �
the South line of said Section, thence North 4 degrees
15 minutes East 323. 7 feet to a point on the East
line of said Brackett Avenue, said point being the
beginning of the line to be described; thence South
29 degrees 25 minutes East 65 feet to the shore of

Lake Minnetonka.
A11 that part of Government Lot 1 , Se.ction 11 ,
Township 117 , North, Range 23 West of the Sth
Principal Meridian, des�ribed as follows : Commencing
at the intersection of the North line of said Lot 1
with the shore of Lake Minnetonka thence West along
the North line of said Lot 1 to the Southeasterly
boundary line of the right of way of the Great
Northern Railway Company thence Southwesterly along; and
WHEREAS , the City Council has reviewed the application, the recom-
�endations of staff and the Plannin� Commission and the 1.etters and comments
o� the app'licant' s attorney.

A�OW, THEREFORE, BE IT RESOLVED that the Council o� the City of _
Orono hereby approves a conditional use permit for William Gregory to permit
the construction of a new residence to remain as a guest house based on one
or more of the following findings of facts :
1 . The property is located within the LR-lA Zoning District
requiring a minimum of 2 acres in area for each residential
lot. The Gregory property consists of a total of 10 . 71 acres
as follows: �
7.87 a�res of dry land .
2 .64 acres of wetlands .
2. The property contains 1000 `+ of widtfi along the building line.
The LR-lA Zonin� District. require a minimum of 200 ' per resi-
dential lot. �
3 . The site evaluation report for the William Gregory property
. dated 3-27-82 , and on file with the City confirms that both
residences have adequate area and satisfactory soils for on
site septic systems . •
4. The proposed guest house -�s currently being rented out by ,
the. Gregorys but wi11 cease being rented prior to the issuance
of a certificate of occupancy for the new residence.
5 . The quest house sha11 be for the sole use of the Gregory
family, their domestic employees and/or their non paying
guests .
6. The principal residence and guest house will share a single
residential dock. '
� � 7 . Both residences wi11 be served by the existing �access on
Shoreline Drive. ,
8 . In the absence of specific direction in the Zoning Code
concerning setback standards for dwelling units on a single
1ot, Section 31 .370 of the Orono Zoning Code wi11 be applicable.

9. A11 new structures ,additions, repairs , alterations or improvements
on the property sha11 be built in strict conformance with the
current edition of the State of Minnesota Uniform Building Code.
10 . The proposed use is in accord with the objectives of the
Orono Zoning Code, the LR-lA Zoning District and the Com-
prehensive land use p1an.
11 . The proposed use and location of that use wi11 not be
detrimental to the public health, safety, or welfare.
12 . The proposed use and location of that use wi7.1 not have
detrimental effects on the surrounding property values.
Council further advises the applicant that if at some future date the property
legally described above is to be subdivided, and that division may result in
�he separation of the guest house from the principal dwelling, in accordance
ith the standards of the LR-lA Zoning District, a minimum setback of 60' must
separate the two dwellings .
Adopted by the City Council of the City of Orono at a regular meeting held
